Obtaining particular information from police commissioner about particular persons
280 Obtaining particular information from police commissioner about particular
persons
(1) This section applies in relation to a person if—
(a) the
person—
(i) has a current positive notice; or
(ii) is the subject of an
application for a prescribed notice that has not been decided or withdrawn at
the commencement; or
(iii) has made an application for the cancellation of
the person’s negative notice, or the cancellation of the suspension of the
person’s positive notice, that has not been decided or withdrawn at the
commencement; and
(b) under section 117, the chief executive requested
information from the police commissioner, or access to the police
commissioner’s records, about the person before the commencement.
(2) If,
at the commencement, the police commissioner has complied with the request,
the chief executive may ask the police commissioner for information, or access
to the police commissioner’s records, to enable the chief executive to learn
whether there is any new police information about the person.
(3) Section 117
applies in relation to the chief executive’s request under subsection (2) as
if it were made under section 117(2) in relation to only new police
information.
(4) If, at the commencement, the police commissioner has not
complied with the request, section 117 as in force from the commencement
applies in relation to the request.
(5) In this section—
"new police information" means information mentioned in section 117(7) or (8).
