(1) For this division, each of the following persons is a
"relevant person" —
(a) a person who holds a clearance;
(b) a person who
has made a disability worker screening application that has not been decided
or withdrawn;
(c) a person to whom all of the following apply—
(i) the
person has purported to make a disability worker screening application;
(ii)
the application has not been properly made, including, for example, because
the application was not accompanied by the fee prescribed by regulation for
the application;
(iii) the application, as made, contains sufficient
information for the chief executive to establish the person’s identity with
certainty;
(d) a person who has made an application under section 130to
cancel the person’s exclusion and the application has not been decided or
withdrawn;
(ii) there is an undecided
appeal against a decision on an appeal or review under section 138J(2) or
138ZWrelating to the exclusion.
(2) Also, a person is a
"relevant person" for this division if the chief executive is aware that—
(a) the person holds an interstate NDIS clearance; or
(b) the person has made
an application under a corresponding law that corresponds to an NDIS worker
screening application and an NDIS worker screening unit has asked the chief
executive for information about the person in relation to deciding the
application.
(3) In this section—
"undecided" , in relation to an appeal, review or application, means the
appeal, review or application has been started or made but not decided.
