Action after decision to cancel exclusion
134 Action after decision to cancel exclusion
(1) If the chief executive decides to cancel a person’s exclusion under this
division, the chief executive must—
(a) cancel the exclusion; and
(b) give
the person a notice about the cancellation.
(2) The chief executive may
decide a disability worker screening application made by the person after the
exclusion is cancelled without conducting a risk assessment of the person
unless the chief executive is aware of information that—
(a) was not known
to the chief executive when the decision to cancel the exclusion was made; and
(b) is relevant to whether the person poses a risk of harm to people with
disability.
