Queensland Consolidated Acts Queensland Consolidated Acts(1) An appeal under section 63(1) is by way of rehearing on the record and under the rules of court applying to the District Court or, in so far as those rules can not be applied to such appeals, in accordance with directions given by a District Court judge.
(2) An appeal against an order does not stay the operation of the order, but--
(a) if the order was a temporary protection order made by a magistrate--a Magistrates Court; or
(b) in any other case--the court that made the order;
may stay the operation of the order, or a condition imposed by the order, until the appeal is dealt with.
(3) Subsection (2) does not limit any other power to stay the operation of the order.
