482 Obligations relating to unstamped instruments or ELN transaction documents

(1) A person who acts under an instrument or ELN transaction document that has not been properly stamped must immediately give notice in the approved form to the commissioner.

Penalty—

Maximum penalty—200 penalty units.

(2) However, a person does not commit an offence against subsection (1) if the person proves the person did not know and could not reasonably have been expected to have known that—

(a) duty is imposed on the instrument or transaction to which it relates; or

(b) the instrument or ELN transaction document was not properly stamped.
