COMMUNITY SERVICES (TORRES STRAIT) ACT 1984 - SECT 75

75 Discharge of Island police officers' functions etc.

(1) Island police officers appointed for a council area shall have and may exercise within that area the functions, duties and powers conferred on them by by-law of the Island council established for the area.

(2) Also, for the administration and enforcement of the liquor provisions in a council area, the police officer in charge for the area may authorise an Island police officer to exercise in the area the powers of--

(a) an investigator under the Liquor Act, 1992, part 7; or
(b) a police officer under the Police Powers and Responsibilities Act 2000, sections 60 to 62.

(3) For subsection (2)(b), the Police Powers and Responsibilities Act 2000, sections 60 to 62, apply as if a reference in the sections to a police officer were a reference to an Island police officer.

(4) If at any time a police officer is, in execution of the officer's duty, stationed in or present in a council area for which Island police officers are appointed they shall discharge and exercise their functions, duties and powers subject to the direction and control of that police officer.

(5) It is lawful for an Island police officer to use reasonable force in the discharge of the officer's function of maintaining peace and good order in the council area for which the officer is appointed.
