(1) A regulation may prescribe a thing to be a prohibited thing.
(2) A
prisoner in a corrective services facility must not deal, or attempt to deal,
with—
(a) a prohibited thing; or
(b) something intended to be used by a
prisoner to make a prohibited thing.
Penalty—
Maximum penalty—2
years imprisonment.
(3) However, subsection (2) does not apply to—
(a)
making or attempting to make a thing if the prisoner has the chief
executive’s written approval to make it; or
(b) possession of a thing if
the prisoner has the chief executive’s written approval to possess it.
(4)
The finding of a prohibited thing in a prisoner’s room that is not shared
with another prisoner, or on the person of a prisoner, in a corrective
services facility is evidence the thing was in the prisoner’s possession
when it was found.
(5) In this section—
"deal with" , a thing, means make, possess, conceal or knowingly consume the
thing.
