6 Oaths, affirmations and declarations
(1) Any commissioner may administer an oath to any person appearing as a
witness before the commission, whether the witness has been summoned or
appears without being summoned, and may take and receive an affirmation or
declaration instead of an oath where the witness would be permitted to make,
or the commissioner would be entitled to take and receive, an affirmation or
declaration instead of an oath, as a witness and as the presiding judge
respectively in an action or trial in the Supreme Court.
(2) The provisions
of the Oaths Act 1867, with any necessary adaptations, shall apply and extend
wherever possible to each and every oath, affirmation, and declaration
administered, made, or taken, as the case may be, under this section.
