Possession of objectionable film
41 Possession of objectionable film
(1) A person must not have possession of an objectionable film for the purpose
of sale.
Penalty—
Maximum penalty—
(a) in the case of a film that is
or would, if classified, be classified as an X 18+ film under the Commonwealth
Act—60 penalty units or imprisonment for 6 months; or
(b) in any other
case—250 penalty units or imprisonment for 2 years.
(2) A person must not
have possession of an objectionable film for the purpose of exhibition in a
public place.
Penalty—
Maximum penalty—250 penalty units or
imprisonment for 2 years.
(3) A person must not knowingly have possession
of a child abuse film.
Penalty—
Maximum penalty—150 penalty units or
12 months imprisonment.
