CLASSIFICATION OF FILMS ACT 1991 - SECT 25CA

25CA Calling in unclassified film for classification
(1) This section applies if—
(a) the director has reasonable grounds to
believe an unclassified film is not an exempt film; and
(b) the film is being
published in Queensland, or the director has reasonable grounds to believe the
film will be published in Queensland; and
(c) if the film is being published
in Queensland—the film is not subject to a conditional cultural exemption in
relation to the publication.
(2) The director may, by written notice given to
the publisher of the film, require the publisher to submit an application for
its classification.
(3) The notice has effect only if it is published in the
Commonwealth gazette.
(4) The publisher must comply with the notice within 3
business days after receiving it.
Penalty—
Maximum penalty—20 penalty
units.
(5) It is a defence to a prosecution for an offence against
subsection (4) for the defendant to prove that the defendant did not intend to
publish the film, or cause it to be published, in Queensland.
