Offence of indemnifying surety
26 Offence of indemnifying surety
(1) Where a person indemnifies another person or agrees with another person to
indemnify that other person against any liability that that other person may
incur as a surety to secure the appearance in answer to bail and the surrender
into custody of a defendant the first mentioned person and that other person
commit an offence against this Act.
Penalty—
Maximum penalty—17
penalty units or imprisonment for 1 year.
(2) It is immaterial, in relation
to an offence defined in subsection (1) —
(a) whether the agreement is made
before or after the person to be indemnified becomes a surety; or
(b) whether
or not the person becomes a surety; or
(c) whether the agreement contemplates
compensation in money or money’s worth.
