(1) Subsection (2) applies to the owner of a shared pool on regulated premises if the owner is given a notice under section 246ATF (c) relating to the sale of the premises.
(2) The owner must ensure there is a pool safety certificate in effect for the pool within—(a) generally—90 days after the day of settlement under the contract of sale for the premises (the
"usual period" ); or(b) if, during the usual period, the owner becomes a party to a proceeding before QCAT relating to the barrier for the pool—the usual period plus a further period equal to the number of days the owner was a party to the proceeding.Penalty—Maximum penalty—165 penalty units.
(3) Subsection (4) applies to the owner of a shared pool on regulated premises if the owner is given a notice under section 246ATI relating to an accommodation agreement for the premises.
(4) The owner must ensure there is a pool safety certificate in effect for the pool within—(a) generally—90 days after the day the accommodation agreement is entered into (the
"usual period" ); or(b) if, during the usual period, the owner becomes a party to a proceeding before QCAT relating to the barrier for the pool—the usual period plus a further period equal to the number of days the owner was a party to the proceeding.Penalty—Maximum penalty—165 penalty units.
