Measurement of distance
37 Measurement of distance
(1) In applying a pre-2023 provision, distance is to be measured along the
shortest road ordinarily used for travelling unless there is a contrary
intention that distance is to be measured in a straight line on a horizontal
plane or in another way.
(2) In applying a post-2023 provision, distance is
to be measured in a straight line on a horizontal plane.
(3) In this
section—
"post-2023 provision" means a provision enacted after the commencement of the
Justice and Other Legislation Amendment Act 2023 , section 9 .
