Possession of Aboriginal human remains
17 Possession of Aboriginal human remains
(1) This section applies to a person, other than the State, if the person has
in the person’s possession Aboriginal human remains that were in existence
immediately before the commencement of this section and the person does not
have the necessary traditional or familial links with the human remains to be
the owner of the human remains.
(2) The person must take all reasonable steps
to ensure that the human remains are taken into the custody of the chief
executive as soon as practicable.
Penalty—
Maximum penalty for
subsection (2) —200 penalty units.
