43 Persons to be consulted
(1) This section applies if the Minister is satisfied that there is a person
who ought to be consulted about, or whose agreement is required, to the grant
of a lease to satisfy the lease entitlement.
(2) Without limiting subsection
(1) , a person who ought to be consulted includes the holder of the
lease entitlement or, if the holder is deceased, any interested person in the
estate of the deceased holder.
(3) The Minister must consult with the person,
or seek the person’s agreement, before making the deferred grant.
