Erratum to Explanatory Notes

Local Government Bill 2009

Reason for Erratum
The erratum is necessary to include content in the explanatory notes to
ensure increased clarity of the intent and therefore operation of clause 172.




Notes on Provisions
Page 152, clause 172
The explanatory notes should include, in addition to the existing
explanatory note:
The clause does not apply if the matter is an ordinary business matter
(defined in the Schedule 3 Dictionary). This exemption is provided in
recognition that there are certain matters, which are central to the operation
of council, in which all councillors will have an interest. For example,
setting rates as a councillor that the councillor may then be liable to pay as
a ratepayer, or voting on councillor salaries. This exemption is carried over
from the LGA section 6(3).
