Title of the Bill
Gambling Legislation Amendment Bill 2007
Objectives of the Amendments
The amendment aims to provide for the exercise of delegated power by the
chief executive for administrative efficiency or in situations where
approving grants from the Gambling Community Benefit Fund under the
Gaming Machine Act 1991 by the Minister could give rise to a potential
conflict of interest.
Achievement of the Objectives
The provisions dealing with the Gaming Machine Act 1991 are to be
achieved by the inclusion of an additional delegation power. This would
allow the chief executive to approve a grant when it was impractical for the
Minister to make the approval.
Alternative Ways of Achieving Policy Objectives
There are no other practicable ways of achieving the policy objective.
Consistency with Fundamental Legislative Principles
The amendment has been drafted with regard to fundamental legislative
principles.

Consultation
Government consultation was undertaken with the departments of Premier
and Cabinet; Child Safety; Communities and Disability Services; Education,
Training and the Arts; Emergency Services; Employment and Industrial
Relations; Health; Housing; Infrastructure and Planning; Justice and
Attorney-General; Local Government, Sport and Recreation; Main Roads;
Mines and Energy; Primary Industries and Fisheries; Public Works; Tourism,
Regional Development and Industry; the Environmental Protection Agency
and the Queensland Police Service.
Notes on Provisions
Gaming Machine Act 1991
Clause 1 omits clause 27 and replaces it with a new clause 27.
Clause 27 (Amendment of s 50 (delegations))
This amendment inserts a new section 50(1A) which provides that the
Minister may delegate to the chief executive the Minister's powers under--
· section 24(1)--to appoint a commissioner to act as chairperson
of the commission; and
· section 322(6)--to cause amounts to be paid out of the gambling
community benefit fund for the benefit of the community.
