Erratum to Explanatory Notes
Title of the Bill
Gambling and Other Legislation Amendment Bill 2009
Reason for Erratum
As a result of an editing error during the drafting and review process, a
minor amendment is required to page 25 of the Explanatory Notes. The
wording of the note on clause 12 currently implies a different meaning to
what was intended, and is not consistent with the provisions of the Casino
Control Act 1982 to which it applies.
The note states, `Clause 12 amends section 127 to provide that the chief
executive may also make regulations about tournaments for games, the
naming of a game or wager, the permissible minimum and maximum wager
for a game, and the maximum denomination of currency that may be
inserted in a note acceptor in a casino.'
There is no provision in Casino Control Act 1982 for the chief executive to
make a regulation. Section 127(1) provides that the Governor in Council
may make regulations under this Act. It was also never intended that the
chief executive may make a regulation under section 127(2) and the
provision in the Gambling and Other Legislation Amendment Bill 2009
does not provide for this.

Therefore, the note on clause 12 should state, `Clause 12 amends section
127 to provide that a regulation may also be about tournaments for games,
the naming of a game or wager, the permissible minimum and maximum
wager for a game, and the maximum denomination of currency that may be
inserted in a note acceptor in a casino.'
Notes on Provisions
The amendment is required to the note on clause 12 on page 25 of the
explanatory notes. The note relates to an amendment to section 127 of the
Casino Control Act 1982.
Omit the note on clause 12 and insert--Clause 12 amends section 127 to
provide that a regulation may also be about tournaments for games, the
naming of a game or wager, the permissible minimum and maximum
wager for a game, and the maximum denomination of currency that may be
inserted in a note acceptor in a casino.
