Explanatory Notes for Amendments to be
moved during Consideration in detail by the

Notes on Provisions
Clause 1 amends clause 9 (Who is a worker) of the Bill by inserting
wording in subclause 9(1)(b) that the subclause applies to workers under a
contract "whether or not the contract is a contract of service". This makes it
clear that the subclause applies to work under a contract of service as well
as under other types of contractual arrangements (e.g. a contract for
service) in the circumstances described by the subclause. The amendment
brings the subclause into line with similar wording in subclause 9(1)(c) and
differentiates it more clearly from subclause 9(1)(a) which deals with
contracts of service only.
