The Parliament of Queensland enacts-- 1
1 Short title 2
This Act may be cited as the Yeppoon Hospital Site 3
Acquisition Act 2006. 4
2 Definitions 5
In this Act-- 6
Acquisition Act means the Acquisition of Land Act 1967. 7
commencement means the day on which the provision in 8
which the term is used commences. 9
Yeppoon land means the following land-- 10
(a) lot 12 on SP164801; 11
(b) the part of lot 525 on SP164801 shown as lot 1 on 12
AP16181, containing an area of about 2.95ha. 13

3 Taking of Yeppoon land 18
(1) The Yeppoon land-- 19
(a) is taken by the State for the purpose of a hospital and 20
associated health and medical facilities; and 21
(b) vests in the State and becomes unallocated State land, 22
free of any interest or obligation; and 23
(c) stays unallocated State land, until it is, having regard to 24
the purpose for which it is taken, dealt with as provided 25
for under an Act, other than this Act. 26
(2) This section has effect despite any other Act. 27

4 Application of Acquisition Act 1
(1) Subject to section 3, the Acquisition Act applies to the taking 2
of the Yeppoon land under that section with any necessary 3
changes, including the changes mentioned in this section. 4
(2) The provisions of the Acquisition Act stated in the schedule 5
do not apply to the taking of the Yeppoon land. 6
(3) A person whose interest in the Yeppoon land is taken under 7
section 3 has the right to claim compensation under the 8
Acquisition Act, section 12(5A) and (5B) and part 4 as if the 9
land had been taken under that Act. 10
(4) For applying the Acquisition Act-- 11
(a) the State is the constructing authority; and 12
(b) for section 24(2A) of the Act, a claimant refers the claim 13
for compensation to the Land Court by filing in the 14
office of the registrar of the court a copy of the claim 15
given by the claimant to the State; and 16
(c) the reference in section 24(5) of the Act to the date of 17
the gazette containing the gazette resumption notice 18
taking the land is taken to be a reference to the 19
commencement; and 20
(d) the reference in section 38(1) of the Act to land taken or 21
occupied under the Act is taken to be a reference to the 22
Yeppoon land. 23
5 Objection under Acquisition Act 24
(1) This section applies if, before the commencement-- 25
(a) a person with an interest in the Yeppoon land objected 26
under the Acquisition Act to a proposed taking of the 27
land under the Act; and 28
(b) the objection has not been finally dealt with under the 29
Act. 30
(2) On the commencement-- 31
(a) the objection is taken to have been withdrawn by the 32
person; and 33

(b) the Acquisition Act does not apply in relation to the 1
objection. 2
6 Regulation-making power 3
The Governor in Council may make regulations under this 4
Act. 5
