2003 A BILL FOR An Act to amend the Water Act 2000, and for other purposes

 


 

s1 10 s4 Water and Other Legislation Amendment Bill 2003 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Water and Other Legislation Amendment 4 Act 2003. 5 PART 2--AMENDMENT OF INTEGRATED PLANNING 6 ACT 1997 7 2 Act amended in pt 2 Clause 8 This part amends the Integrated Planning Act 1997. 9 3 Amendment of s 3.2.1 (Applying for development approval) Clause 10 Section 3.2.1-- 11 insert-- 12 `(11) Subsection (3)(a)(ii) does not apply to an application if-- 13 (a) the application is for building work or operational work on land 14 designated for community infrastructure; and 15 (b) the building work or operational work is for the supply of the 16 community infrastructure.'. 17 4 Amendment of s 3.5.24 (Request to change development approval Clause 18 (other than a change of a condition)) 19 Section 3.5.24-- 20 insert-- 21

s 131 56 s 131 Water and Other Legislation Amendment Bill 2003 (a) first produces his or her identity card for the person's inspection; 1 or 2 (b) has the identity card displayed so it is clearly visible to the 3 person. 4 `(2) However, if for any reason it is not practicable to comply with 5 subsection (1) before exercising the power, the metering contractor must 6 produce the identity card for the person's inspection at the first reasonable 7 opportunity. 8 `977 Power to enter places for stated purposes 9 `(1) A metering contractor may enter land-- 10 (a) to inspect a site and any works on the site in preparation for 11 installing a meter on the site; or 12 (b) to carry out preparation work on the site; or 13 (c) to install a meter and any works necessarily associated with the 14 meter on a site; or 15 (d) to calibrate and test the meter; or 16 (e) to maintain, repair and replace meters; or 17 (f) to read meters. 18 `(2) However, the metering contractor may enter the land at any 19 reasonable time only if-- 20 (a) the occupier consents to the entry; or 21 (b) the metering contractor has given the occupier at least 22 10 business days notice of the entry and the purpose of the entry. 23 `(3) After entering the place, the metering contractor may carry out the 24 activity that is the purpose of the entry. 25 `(4) For carrying out the activity, the metering contractor may require the 26 occupier, or a person on the land, to give the metering contractor 27 information to help the contractor carry out the activity. 28 `(5) If there is no person on the land at the time of the entry under 29 subsection (2)(b), the metering contractor must-- 30 (a) leave a notice at the place; and 31

 


 

s 131 57 s 131 Water and Other Legislation Amendment Bill 2003 (b) ensure the notice is left in a reasonably secure way and in a 1 conspicuous position. 2 `(6) In this section-- 3 "land" means a parcel of land other than the part on which there is erected 4 a building or structure that is-- 5 (a) a dwelling place; or 6 (b) being used, at the relevant time, as a dwelling place. 7 `978 Obstructing metering contractors 8 `A person must not obstruct a metering contractor exercising a power 9 under this Act, unless the person has a reasonable excuse. 10 Maximum penalty--200 penalty units. 11 `979 Giving notice of damage 12 `(1) If the metering contractor, in the exercise or purported exercise of a 13 power under this Act, damages anything, the metering contractor must 14 immediately give notice of the particulars of the damage. 15 `(2) The notice must be given to the person who appears to the metering 16 contractor to be the owner of, or in control of, the thing damaged. 17 `(3) If, for any reason, it is not practicable to comply with subsection (2), 18 the metering contractor must-- 19 (a) leave the notice at the place where the damage happened; and 20 (b) ensure the notice is left in a reasonably secure way and in a 21 conspicuous position. 22 `(4) This section does not apply to damage the metering contractor 23 believes, on reasonable grounds, is trivial. 24 `980 Compensation for damage 25 `(1) A person may claim compensation from the metering contractor if 26 the person incurs loss or expense because of the exercise or purported 27 exercise of a power under this Act by the metering contractor. 28 `(2) Payment of compensation may be claimed and ordered in a 29 proceeding for compensation brought in a court of competent jurisdiction. 30

s 137 61 s 137 Water and Other Legislation Amendment Bill 2003 (iii) an authorisation supplied from the Theodore or Gibber 1 Gunyah area channels in the Dawson Valley water supply 2 scheme--the medium A priority group; 3 (iv) to the extent allowed under the rules for conversion 4 contained in the resource operations plan, the part of an 5 authorisation, in the Dawson Valley water supply scheme, 6 that is for stock or domestic purposes--the high priority 7 group; 8 (v) an authorisation identified in the resource operations plan as 9 belonging to a priority group mentioned in schedule 8--the 10 priority group mentioned; 11 (vi) all other authorisations--the medium priority group; or 12 (e) an amendment of section 20(4) to state that the maximum rate at 13 which water may be taken under a water allocation converted 14 from an existing authorisation is the rate decided by the chief 15 executive having regard to-- 16 (i) the terms and conditions under which water may be taken 17 under the existing authorisation including-- 18 (A) the rate stated on the authorisation; and 19 (B) the pump size for the authorisation; and 20 (C) the area that may be irrigated under the authorisation; 21 and 22 (ii) the works associated with the authorisation; or 23 (f) an amendment of section 30(c) to allow an amendment of 24 schedule 6 if the amendment achieves an equivalent or improved 25 environmental outcome and does not adversely affect-- 26 (i) water allocations in the plan area; or 27 (ii) other outcomes for the plan; or 28 (g) an amendment of section 30(d) to allow the inclusion of 29 additional water allocation security objectives for new water 30 allocation priority groups added under section 30(d); or 31 (h) an amendment of section 30(d) to allow an amendment of a water 32 allocation security objective if the amendment does not adversely 33 affect existing water allocations, environmental flow objectives 34 or the outcomes of the plan; or 35

s 147 67 s 147 Water and Other Legislation Amendment Bill 2003 `1136 Transitional provision for the Water and Other Legislation 1 Amendment Act 2003 2 `(1) Subsection (2) applies to a decision or action mentioned in 3 section 851(1) that is the giving of a compliance notice, if the notice was 4 given before the commencement of this section. 5 `(2) The following sections apply to the decision or action as if 6 amendments to the sections, effected by the Water and Other Legislation 7 Amendment Act 2003, had not commenced-- 8 · section 864(4)(b) 9 · section 865(1) 10 · section 877(1).'. 11 147 Amendment of sch 4 (Dictionary) Clause 12 (1) Schedule 4-- 13 insert-- 14 ` "criminal history", of a person, has the meaning given by the Criminal 15 Law (Rehabilitation of Offenders) Act 1986, section 3, but does not 16 include convictions for which the rehabilitation period has expired, 17 and has not been revived, under that Act. 18 "metering contractor" means a person appointed as a metering contractor 19 under section 973. 20 "nominal volume" means-- 21 (a) for a water allocation managed under a resource operations 22 licence--the number used to calculate the allocation's share of 23 the water available to be taken by holders of water allocations in 24 the same priority group; and 25 (b) for a water allocation not managed under a resource operations 26 licence--the number used to calculate the allocation's share of 27 the water available to be taken by holders of water allocations in 28 all water allocation groups in a water resource plan area. 29 "proposed Barlil Weir" means the new weir at Barlil mentioned in the 30 Water Infrastructure Development (Burnett Basin) Act 2001, 31 section 4(c). 32
