The Parliament of Queensland enacts-- 1

This Act may be cited as the Vocational Education, Training 4
and Employment and Other Acts Amendment Act 2006. 5

`(1) This section applies if-- 28
(a) a supervising registered training organisation for an 29
apprentice or trainee does not receive a notice under 30

section 72(3) from the apprentice's, or trainee's, 1
employer or the apprentice or trainee; and 2
(b) the organisation is reasonably satisfied the apprentice or 3
trainee-- 4
(i) has completed all the training required for the 5
apprenticeship or traineeship; and 6
(ii) is entitled to be issued a qualification or statement 7
of attainment for the apprenticeship or traineeship; 8
and 9
(c) the employer, or apprentice or trainee, refuses to sign a 10
completion agreement submitted by the organisation to 11
the employer, or apprentice or trainee, for signature; and 12
(d) the organisation gives the council a notice stating the 13
following-- 14
(i) the information mentioned in paragraphs (a) to (c); 15
(ii) who has refused to sign a completion agreement 16
under paragraph (c); 17
(iii) an outline of the facts and circumstances leading to 18
the organisation being reasonably satisfied about 19
the matters mentioned in paragraph (b). 20
`(2) The council may despite a completion agreement not being 21
signed under section 73(2), by fair procedures prescribed 22
under a regulation, authorise the organisation to issue the 23
qualification or statement of attainment stated in the training 24
plan for the apprentice or trainee to the apprentice or trainee. 25
`(3) The council may authorise the organisation to issue the 26
qualification or statement of attainment to the apprentice or 27
trainee only if the council is reasonably satisfied the 28
apprentice or trainee-- 29
(a) has completed all the training required for the 30
apprenticeship or traineeship; and 31
(b) is entitled to be issued a qualification or statement of 32
attainment for the apprenticeship or traineeship. 33
`(4) The council must, as soon as practicable after making its 34
decision under subsection (2), give the organisation, 35

employer, and apprentice or trainee an information notice 1
about the decision. 2
`(5) If, under subsection (2), the council authorises the 3
organisation to issue the qualification or statement of 4
attainment to the apprentice or trainee, sections 73(3) to (6), 5
74, 75 and 76(7) apply as if the organisation, employer, and 6
apprentice or trainee had signed a completion agreement on 7
the day the information notice about the decision is given 8
under subsection (4).'. 9
