2003 A BILL FOR An Act to amend the Transport Operations (Road Use Management) Act 1995 and the State Transport (People Movers) Act 1989

 


 

s1 4 s3 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Transport Operations (Road Use 4 Management) and Another Act Amendment Act 2003. 5 2 Acts amended Clause 6 (1) Part 2 amends the Transport Operations (Road Use Management) 7 Act 1995. 8 (2) The schedule amends the State Transport (People Movers) Act 1989. 9 PART 2--AMENDMENT OF TRANSPORT 10 OPERATIONS (ROAD USE MANAGEMENT) ACT 1995 11 3 Amendment of s 50AA (Power to require information) Clause 12 Section 50AA-- 13 insert-- 14 `(6A) Subsection (6B) applies if the person is called as a witness in a 15 proceeding against someone else for the information offence. 16 `(6B) The person is not entitled to refuse to answer a question in relation 17 to the information offence because answering the question might tend to 18 incriminate the person for an information offence (the "particular 19 offence"). 20 `(6C) However, the person's answer, and any evidence directly or 21 indirectly derived from the answer, is not admissible against the person in a 22 civil or criminal proceeding for an information offence, whether or not the 23 particular offence. 24

 


 

s4 5 s4 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 `(6D) Also, nothing in subsection (6B) requires the person to answer a 1 question that might tend to incriminate the person of an offence that is not 2 an information offence.'. 3 4 Amendment of s 57B (Further liability provisions for extended Clause 4 liability offences) 5 (1) Section 57B(2)(a), after `influencing person', first mention-- 6 insert-- 7 `, or any associate of the influencing person,'. 8 (2) Section 57B(2)(b), `the influencing person was not'-- 9 omit, insert-- 10 `neither the influencing person, nor an associate, was'. 11 (3) Section 57B(2)(a) and (b), after `act or omission'-- 12 insert-- 13 `that is the offence'. 14 (4) Section 57B(3), definition "influencing person"-- 15 omit. 16 (5) Section 57B(3)-- 17 insert-- 18 ` "associate", of an influencing person, means any of the following persons 19 to whom the influencing person, whether or not for reward, has given 20 an interest, other than a security interest, in the vehicle-- 21 (a) for an influencing person who is a individual-- 22 (i) a spouse of the influencing person; or 23 (ii) a relative of the influencing person, whether by blood, 24 spousal relationship or adoption; or 25 (iii) an employee of the influencing person; or 26 (iv) an employee of a corporation of which the influencing 27 person is an executive officer; or 28 (v) a partner of the influencing person; or 29

 


 

s4 6 s4 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 (vi) a corporation of which the influencing person is an 1 executive officer; or 2 (vii) a corporation in which the influencing person holds a 3 controlling interest; 4 (b) for an influencing person that is a corporation-- 5 (i) an executive officer of the corporation; or 6 (ii) a spouse of an executive officer of the corporation; or 7 (iii) a relative of an executive officer of the corporation, whether 8 by blood, spousal relationship or adoption; or 9 (iv) an employee of the corporation; or 10 (v) a person who holds a controlling interest in the corporation; 11 or 12 (vi) a holding company of the corporation; or 13 (vii) a subsidiary of the corporation; or 14 (viii)a subsidiary of a holding company of the corporation; 15 (c) a person who is accustomed or under an obligation, whether 16 formal or informal, to act in accordance with the directions, 17 instructions or wishes of the influencing person or, if the 18 influencing person is a corporation, of the executive officers of 19 the influencing person; 20 (d) a person who, because of paragraph (a), (b) or (c), would be an 21 associate of someone who is an associate of the influencing 22 person if the associate were an influencing person. 23 24 Example of an associate-- 25 If the influencing person, by a verbal agreement, leases the vehicle to a 26 corporation that is a subsidiary of the influencing person, the corporation is 27 an associate of the influencing person.

 


 

s5 7 s5 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 "holding company" see the Corporations Act, section 9.1 1 "influencing person", in relation to a vehicle, means any or all of the 2 following persons-- 3 (a) the owner of the vehicle, or for a combination, of either of the 4 vehicles; 5 (b) the registered operator of the vehicle, or for a combination, of 6 either of the vehicles; 7 (c) a person, other than the owner or registered operator, who 8 controls or directly influences the loading or operation of the 9 vehicle. 10 "security interest" means an interest given by way of security for or in 11 relation to a liability, whether present, contingent or future. 12 "subsidiary" see the Corporations Act, section 9.'. 13 5 Amendment of s 78 (Driving of motor vehicle without a driver Clause 14 licence prohibited) 15 (1) Section 78(3)(d) to (f)-- 16 renumber as section 78(3)(f) to (h). 17 (2) Section 78(3)-- 18 insert-- 19 `(d) if the person committed the offence while the person was 20 disqualified from holding or obtaining a driver licence because 21 the person had been convicted of an offence against the 22 Queensland Road Rules, section 20,2 for driving more than 23 40 km/h over the speed limit--6 months; 24 (e) if the person committed the offence while the person's authority 25 to drive on a Queensland road under a non-Queensland driver 26 licence was suspended because the person had been convicted of 27 an offence against the Queensland Road Rules, section 20, for 28 driving more than 40 km/h over the speed limit--6 months;'. 29 (3) Section 78(6), definition "disqualified driver", paragraph (b)(ii)-- 30 1 Corporations Act, section 9 (Dictionary) 2 Queensland Road Rules, section 20 (Obeying the speed limit)

 


 

s6 8 s6 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 renumber as paragraph (b)(iii). 1 (4) Section 78(6), definition "disqualified driver", paragraph (b)-- 2 insert-- 3 `(ii) the person was convicted of an offence against the 4 Queensland Road Rules, section 20, for driving more than 5 40 km/h over the speed limit; or'. 6 (5) Section 78(6), definition "disqualified driver", paragraph (c)(ii)-- 7 renumber as paragraph (c)(iii). 8 (6) Section 78(6), definition "disqualified driver", paragraph (c)-- 9 insert-- 10 `(ii) because the person was convicted of an offence against the 11 Queensland Road Rules, section 20, for driving more than 12 40 km/h over the speed limit; or'. 13 6 Amendment of s 79 (Driving etc. whilst under influence of liquor Clause 14 or drugs or with prescribed concentration of alcohol in blood) 15 (1) Section 79, heading, after `blood'-- 16 insert-- 17 `or breath'. 18 (2) Section 79(2), from `whilst' to `150 mg of alcohol per 100 mL of 19 blood'-- 20 omit, insert-- 21 `, while the person is over the general alcohol limit but is not over the 22 high alcohol limit'. 23 (3) Section 79(2A), (2B) and (2D), from `whilst' to `50 mg of alcohol 24 per 100 mL of blood'-- 25 omit, insert-- 26 `, while the person is over the no alcohol limit but is not over the general 27 alcohol limit'. 28 (4) Section 79(2J), from `concentration' to `50 mg of alcohol per 29 100 mL of blood'-- 30 omit, insert-- 31

s7 10 s7 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 (a) the concentration of alcohol in the person's blood is more than 1 0 mg of alcohol in 100 mL of blood; or 2 (b) the concentration of alcohol in the person's breath is more than 3 0 g of alcohol in 210 L of breath. 4 `(2) For this Act, a person is over the "general alcohol limit" if-- 5 (a) the concentration of alcohol in the person's blood is, or is more 6 than, 50 mg of alcohol in 100 mL of blood; or 7 (b) the concentration of alcohol in the person's breath is, or is more 8 than, 0.050 g of alcohol in 210 L of breath. 9 `(3) For this Act, a person is over the "high alcohol limit" if-- 10 (a) the concentration of alcohol in the person's blood is, or is more 11 than, 150 mg of alcohol in 100 mL of blood; or 12 (b) the concentration of alcohol in the person's breath is, or is more 13 than, 0.150 g of alcohol in 210 L of breath. 14 `(4) For this Act-- 15 (a) the concentration of alcohol in a person's blood may be 16 expressed as-- 17 (i) a specified number of milligrams of alcohol in 100 mL of 18 blood; or 19 (ii) a percentage that expresses the specified number of 20 milligrams of alcohol in 100 mL of blood; and 21 (b) the concentration of alcohol in a person's breath may be 22 expressed as-- 23 (i) a specified number of grams of alcohol in 210 L of breath; 24 or 25 (ii) a specified number of grams in 210 L. 26 27 Examples for subsection (4)-- 28 1. The concentration of alcohol in a person's blood may be expressed as 63 mg of 29 alcohol in 100 mL of blood or as 0.063%. 30 2. The concentration of alcohol in a person's breath may be expressed as 0.063 g of 31 alcohol in 210 L of breath or as 0.063g/210 L.'.

16 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 SCHEDULE 1 AMENDMENT OF STATE TRANSPORT (PEOPLE 2 MOVERS) ACT 1989 3 section 2(2) 4 1 Insertion of new s 2-- 5 After section 1-- 6 insert-- 7 `2 Operation of Act after commencement of this section 8 `(1) After the commencement-- 9 (a) this Act has effect only for the purposes of existing systems; and 10 (b) a person can not commit an offence under section 17(1)(a) or (b)6 11 in relation to a people mover system, other than an existing 12 system for which there is a licence in force under this Act. 13 `(2) To remove any doubt, it is declared that, after the commencement-- 14 (a) the chief executive must not enter into an agreement under part 3 15 in relation to a people mover system; and 16 (b) this Act does not apply to the construction or operation of a 17 people mover system, other than the operation of an existing 18 system for which there is a licence in force under this Act. 19 20 Note-- 21 After the commencement, a people mover system could be constructed and 22 operated under the authority of the Integrated Planning Act 1997 and other 23 relevant law. This Act will not be relevant. `(3) Despite subsection (1)(a), the chief executive must not act under 24 section 19(1A)7 to issue a further licence to any person. 25 6 Section 17 (Construction and operation of people mover system) 7 Section 19 (Period of licence)

 


 

17 Transport Operations (Road Use Management) and Another Act Amendment Bill 2003 SCHEDULE (continued) `(4) Subsection (3) does not prevent the renewal of a licence in 1 accordance with the provisions of the licence. 2 `(5) In this section-- 3 "commencement" means the commencement of this section. 4 "existing system" means a people mover system that, immediately before 5 the commencement, was in operation under a licence under part 4.'. 6 © State of Queensland 2003
