1998 A BILL FOR An Act to amend Acts administered by the Minister for Transport and Minister for Main Roads

 


 

s1 4 s4 Transport Legislation Amendment The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Transport Legislation Amendment Act 4 1998. 5 6 Commencement Clause 2.(1) Section 9 is taken to have commenced on 31 March 1998. 7 (2) Section 22(3) is taken to have commenced on 7 August 1998. 8 (3) Sections 15 and 22(4) and part 3 commence on assent. 9 (4) The remaining provisions of this Act are taken to have commenced 10 on 1 July 1998. 11 ART 2--AMENDMENT OF TRANSPORT 12 P INFRASTRUCTURE ACT 1994 13 amended in pt 2 14 Act Clause 3. This part amends the Transport Infrastructure Act 1994. 15 of new s 80 16 Insertion Clause 4. Chapter 6, part 4, before section 81-- 17 insert-- 18 for pt 4 19 `Definition `80. In this part-- 20

 


 

s5 5 s6 Transport Legislation Amendment "railway" includes a railway proposed to be constructed on future railway 1 land.'. 2 of s 84 (Granting accreditation) 3 Amendment Clause 5. Section 84(2)(d)-- 4 omit, insert-- 5 `(d) the applicant has a right-- 6 (i) of access to the land where the railway is constructed, or 7 proposed to be constructed, either under this Act or with the 8 agreement of the land's owner; and 9 (ii) to use rail transport infrastructure or other rail infrastructure 10 for the railway with the agreement of the infrastructure's 11 owner.'. 12 of s 85 (Accreditation conditions) 13 Amendment Clause 6.(1) Section 85(2)(a)-- 14 omit, insert-- 15 `(a) for the accreditation of a person as the manager of a railway-- 16 (i) constructing or maintaining the railway; or 17 (ii) managing the railway safely, considering the need for 18 efficient and competitive services; or'. 19 (2) Section 85(2)(c) to (e)-- 20 omit, insert-- 21 `(c) for all accreditations-- 22 (i) the person's financial capacity or public risk insurance 23 arrangements to meet reasonable potential accident liabilities 24 for the railway; or 25 (ii) paying accreditation fees; or 26 (iii) another matter prescribed under a regulation.'. 27

 


 

s7 6 s7 Transport Legislation Amendment of s 131 (Lease of land to railway managers) 1 Amendment Clause 7.(1) Section 131(4)(a)-- 2 omit, insert-- 3 `(a) if the manager agrees to meet the full costs of the acquisition-- 4 (i) for a term of not more than 100 years; and 5 (ii) for a rent, if demanded, of $1 per year; and 6 (iii) on other terms decided by the chief executive; or'. 7 (2) Section 131(6)-- 8 omit. 9 (3) Section 131(5) to (8)-- 10 renumber as section 131(7) to (9). 11 (4) Section 131-- 12 insert-- 13 `(5) A lease by the State under subsection (4)(a) may include an option to 14 renew the lease. 15 `(6) The terms of the option and the renewed lease are to be decided by 16 the chief executive.'. 17 (5) Section 131(7) (as renumbered), after `subsection (4)'-- 18 insert-- 19 `or a sublease to a railway manager granted under the exercise of an 20 option mentioned in subsection (5)'. 21 (6) Section 131(9) (as renumbered)-- 22 insert-- 23 ` "full costs", of an acquisition, includes (if the acquired land consists of a 24 lease to the State) all rent or other money payable by the State under 25 the lease granted to the State during the term of-- 26 (a) the lease of the acquired land from the State to the manager under 27 subsection (4); and 28 (b) any renewal of the lease to the manager.'. 29

 


 

s8 7 s 10 Transport Legislation Amendment of s 132 (Status of railway land) 1 Amendment Clause 8.(1) Section 132(1), after `corridor land is'-- 2 insert-- 3 `, for any rail transport infrastructure on the land or proposed to be 4 constructed on the land,'. 5 (2) Section 132(2), definition "corridor land"-- 6 insert-- 7 `(c) future railway land.'. 8 of new s 136 9 Insertion Clause 9. Chapter 7, part 7, after section 135-- 10 insert-- 11 works on corridor land 12 `Railway `136.(1) The chief executive, for works carried out on corridor land that 13 relate to rail transport infrastructure, must perform a function or exercise a 14 power that, under the Building Act 1975 or the Integrated Planning Act 15 1997, would be performed or exercised by a local government if this 16 section had not been passed. 17 `(2) In this section-- 18 "corridor land" means commercial corridor land, existing rail corridor 19 land, new rail corridor land, future railway land or non-rail corridor 20 land.'. 21 of s 228 (Continuation of harbours under Harbours Act 22 Amendment or port under Port of Brisbane Authority Act etc.) 23 Clause 10. s 11 8 s 13 Transport Legislation Amendment of s 232 (Harbours Corporation of Queensland) 1 Amendment Clause 11.(1) Section 232(7)-- 2 omit. 3 (2) Section 232(8), `4'-- 4 omit, insert-- 5 `5'. 6 of s 233 (Continuation of certain by-laws and provisions 7 Amendment of Harbours Act) 8 Clause 12.(1) Section 233(7) to (13)-- 9 omit, insert-- 10 `(7) For the purpose of the continuing effect of the Marine Land 11 Dredging By-law 1987, a reference in it to an authorised person or officer is 12 a reference to a person who, immediately before 1 July 1994, was an 13 authorised person or officer under the by-law. 14 `(8) This section has effect despite the repeal of the Harbours Act 1955. 15 `(9) This section expires on 1 July 1999 or, if an earlier date is prescribed 16 under a regulation, on that date.'. 17 of s 235 (Continuation of certain provisions of Harbours 18 Amendment Act about jetties and ramps etc.) 19 Clause 13.(1) Section 235(1), sixth dot point-- 20 omit. 21 (2) Section 235(5) to (7)-- 22 omit, insert-- 23 `(5) This section expires on 1 July 1999 or, if an earlier date is prescribed 24 under a regulation, on that date.'. 25

 


 

s 14 9 s 16 Transport Legislation Amendment of s 240 (Application of Acts Interpretation Act, s 20A to 1 Amendment this part) 2 Clause 14. Section 240(2), `4'-- 3 omit, insert-- 4 `5'. 5 of new ch 10, pt 5 6 Insertion Clause 15. Chapter 10-- 7 insert-- 8 ART 5--TRANSITIONAL PROVISIONS FOR 9 `P TRANSPORT LEGISLATION AMENDMENT ACT 10 1998 11 during retrospective period 12 `Offences `260.(1) This section applies to an offence against a provision of a 13 statutory instrument mentioned in section 232 or 235 that happened 14 between the 2 July 1998 and the commencement of this section. 15 `(2) Despite the retrospective commencement of sections 10, 11, 13 16 and 14 of the Transport Legislation Amendment Act 1998, a prosecution for 17 the offence can not be started, or if started, ends on the commencement. 18 `(3) This part expires at the end of the day on which it commences.'. 19 of sch 3 (Dictionary) 20 Amendment Clause 16.(1) Schedule 3, definition "railway manager"-- 21 omit. 22 (2) Schedule 3-- 23 insert-- 24 ` "railway", for chapter 6, part 4, see section 80. 25 "railway manager", for a railway or a proposed railway, means the person 26

This part amends the Transport Legislation Amendment Act 1997. 6 of s 132 (Insertion of new ss 92­92B) 7 Omission Clause 18. Section 132-- 8 omit. 9 ART 4--AMENDMENT OF TRANSPORT 10 P OPERATIONS (ROAD USE MANAGEMENT) ACT 11 1995 12 amended in pt 4 13 Act Clause 19. This part amends the Transport Operations (Road Use 14 Management) Act 1995. 15 of s 56 (Using documents voided for non-payment) 16 Amendment Clause 20. Section 56-- 17 insert-- 18 `(1A) However, this section does not apply to a licence or other 19 document specified under a regulation.'. 20

 


 

s 21 11 s 22 Transport Legislation Amendment of s 85 (Regulations) 1 Amendment Clause 21.(1) Section 85, heading-- 2 omit, insert-- 3 `Regulation-making power'. 4 (2) Section 85(3)(a), after `Act'-- 5 insert-- 6 `and the effect of non-payment'. 7 of ch 7 (Transitional provisions, amendments and 8 Amendment repeals) 9 Clause 22.(1) Chapter 7-- 10 insert-- 11 `PART 1--TRANSITIONAL PROVISIONS FOR 12 TRANSPORT OPERATIONS (ROAD USE 13 MANAGEMENT) ACT 1995'. 14 (2) Chapter 7-- 15 insert-- 16 `PART 2--TRANSITIONAL PROVISIONS FOR 17 TRANSPORT LEGISLATION AMENDMENT ACT 18 1998 19 `Transitional provisions for Motor Vehicles Control Act 1975 about 20 local laws 21 `94.(1) This section applies to a local law made under the repealed Motor 22 Vehicles Control Act 1975, section 35,1 and in force immediately before the 23 commencement of this section. 24 `(2) The law remains in force, until amended or repealed under the Local 25 Government Act 1993.'. 26 1 Section 35 (Function of local government to execute Act)

 


 

s 22 12 s 22 Transport Legislation Amendment `Transport Infrastructure (Roads) Regulation 1991 1 `95. For section 56,2 a certificate of registration under the Transport 2 Infrastructure (Roads) Regulation 1991 is a document to which section 56 3 does not apply.'. 4 (3) Chapter 7, part 2 (as inserted)-- 5 insert-- 6 `Carriage of Dangerous Goods by Road Regulation 1989--transition 7 of approvals 8 `96.(1) An approval of something given under the code that was in force 9 immediately before 7 August 1998 is taken to be an approval of the thing 10 under the Transport Operations (Road Use Management--Dangerous 11 Goods) Regulation 1998. 12 `(2) The approval is subject to the same conditions that applied 13 immediately before the commencement of this section. 14 `(3) In this section-- 15 "code" means the code under the Carriage of Dangerous Goods by Road 16 Regulation 1989.'. 17 (4) Chapter 7, part 2 (as inserted)-- 18 insert-- 19 `Carriage of Dangerous Goods by Road Act 1984--exemptions 20 `97.(1) This section applies to an exemption given under the repealed 21 Carriage of Dangerous Goods by Road Act 1984, section 24,3 that was in 22 force immediately before the repeal of that Act. 23 `(2) The exemption is taken to be an exemption under section 79C that 24 exempts the person to whom it was given from complying with a provision 25 of the Transport Operations (Road Use Management--Dangerous Goods) 26 Regulation 1998 that most closely corresponds to the provision stated in the 27 exemption. 28 `(3) Subsection (2) applies even though section 79C had not commenced 29 2 Section 56 (Using documents voided for non-payment) 3 Section 24 (Exemption from complying with this Act)

 


 

s 22 13 s 22 Transport Legislation Amendment on the repeal. 1 `(4) The exemption-- 2 (a) is, to the greatest practicable extent, subject to the same conditions 3 that applied immediately before the repeal; and 4 (b) despite paragraph (a), expires on 31 January 1999.'. 5 © State of Queensland 1998
