Clause 1. This Act may be cited as the Trading (Allowable Hours) Amendment 3

Clause 2. This Act amends the Trading (Allowable Hours) Act 1990. 6

(a) a public holiday under the Holidays Act 1983; or 12
(b) a day that would have been a public holiday had there not been a 13
substitution under the Holidays Act 1983, section 2(2) or (3) 14

`Definition
`49. In this part-- 4
"trading hours order" means the order titled Trading 5
Hours--Non-exempt Shops Trading by Retail--State made by the 6
industrial commission on 27 November 1992 as varied by the 7
industrial commission from time to time. 8

`Displacement
`50.(1) This part applies only to a non-exempt shop to which the trading 10
hours order applies. 11
`(2) Despite section 28, 2 the trading hours order does not apply to a 12
non-exempt shop to the extent that the order is inconsistent with this part. 13

`51. On Tuesday 28 December 1999, the occupier of a non-exempt shop 15
must ensure the shop is closed at all times other than the times at which it 16
may be open under the trading hours order on a Saturday that is not a public 17
holiday. 18

`52. Section 51 does not apply so as to amend the meaning of the 21
allowable trading hours for the definition "core trading hours" in the 22
Retail Shop Leases Act 1994, section 51.3 23
