`33.(1) This section applies if, on or after the settlement day, a person 14
who is an officer or employee of SEQWB immediately before the 15
settlement day becomes an employee of SEQWCo under the sale of 16
business agreement. 17
`(2) A regulation may, under section 2(1), definition "unit of the State 18
public sector", paragraph (n), declare SEQWCo to be a unit of the State 19
public sector. 20
`(3) A declaration under subsection (2) operates only for the purpose of 21
this Act and must not be taken to indicate that SEQWCo has a status for the 22
purpose of any other Act. 23
`(4) If SEQWCo is declared to be a unit of the State public sector, the 24
only persons, in relation to SEQWCo, who may be declared eligible for 25

membership of the scheme, by a written notice under section 13(1), are 1
transferred employees. 2
`(5) In this section-- 3
"sale of business agreement" means the agreement called the Sale of 4
Business Agreement entered into between SEQWB and SEQWCo on 5
20 September 1999 under the South East Queensland Water Board 6
(Reform Facilitation) Act 1999, section 5(1). 7
"SEQWB" means the South East Queensland Water Board established 8
under the South East Queensland Water Board Act 1979. 9
"SEQWCo" means South East Queensland Water Corporation Limited 10

"settlement day" means the settlement day declared under the South East 12
Queensland Water Board (Reform Facilitation) Act 1999, section 8. 13
"transferred employees" means persons who are officers or employees of 14
SEQWB immediately before the settlement day and become 15
employees of SEQWCo under the sale of business agreement.'. 16
