Clause 1. This Act may be cited as the Superannuation (State Public Sector) 3

Clause 2. This Act amends the Superannuation (State Public Sector) Act 1990. 6
of s 13 (Membership of scheme) 7

Clause 3.(1) Section 13(6)-- 8
renumber as section 13(8). 9
(2) Section 13-- 10
insert-- 11
`(6) The Minister may, by written notice, declare that a person is eligible 12
for membership of the scheme if the person is the spouse of a member of 13
the scheme. 14
`(7) The notice must declare-- 15
(a) that membership of the scheme is discretionary; and 16
(b) any conditions applying to membership; and 17
(c) the membership category or categories for which the spouse is 18
eligible.'. 19
(3) Section 13(8), as renumbered, `subsection (1) or (4)'-- 20
omit, insert-- 21
`subsection (1), (4) or (6)'. 22

"spouse", of a member-- 2
(a) includes a person who, although not married to the member, lives 3
with the member on a genuine domestic basis as the member's 4
husband or wife; but 5
(b) does not include a person who permanently lives separately and 6
apart from the member.'. 7
