174 Statute Law Revision SCHEDULE 1 (continued) 1 Explanatory note 2 Most of the amendments of the Health Act are of 2 types. First, there are 3 amendments that change numerous references in the Act from the Director-General 4 (of Health and Medical Services) to the chief health officer. Continued use in the 5 Act of the older title of Director-General is the source of confusion. Second, there 6 are a number of amendments that transfer regulation making power from the chief 7 health officer to the Governor in Council. This is consistent with the proper 8 respective roles of non-elected officials and the executive government in a 9 Westminster system of government such as Queensland's. The opportunity has also 10 been taken to update regulation making powers in accordance with current drafting 11 practice and to remove unnecessary provisions. In addition to amendments of these 2 12 types, the amendments of the Act include a broad range of minor updating changes. 13 These are outlined below. 14 Amendment 1 omits a redundant definition dealing with the Act's commencement. 15 Amendments 2 and 3 simplify the definition "licence" and are consequential on 16 changes in relation to the use of the title Director-General. Amendment 3 also 17 inserts a definition "approved form" which is consequential on amendments allowing 18 the use of approved forms rather than prescribed forms. 19 Amendments 4, 5, 6, 57, 65, 75, 140, 143, 144, 145, 149, 152, 172, 176, 177, 178, 20 188, 194, 196 and 221 give effect to current drafting practice by providing that the 21 statutory instruments used under the Act are regulations. These amendments will 22 ensure that all instruments under the Act of a legislative character are subject to 23 Parliamentary oversight. 24 Amendment 7 omits a provision that is now outdated, redundant and contrary to 25 current drafting practice. 26 Amendment 8 updates provisions dealing with the appointment of, and delegations 27 by, the chief health officer. The amendment also omits unnecessary provisions. 28 Amendment 9 omits outdated and unnecessary provisions. The Act contains ample 29 power to make regulations covering the matters dealt with in the omitted provisions. 30 Amendments 10 and 14 omit, in accordance with Government policy, provisions 31 dealing with internal government administrative arrangements.
