The Parliament of Queensland enacts-- 1
PART 1--PRELIMINARY 2
1 Short title
Clause 3
This Act may be cited as the Sugar Industry Reform Act 2004. 4
2 Commencement
Clause 5
(1) Sections 3, 27 to 29 and 36(1) and (5) of this Act commence on 6
assent. 7
(2) Sections 9 to 18, 24 and 36(3), (6) and (9) of this Act commence on 8
1 July 2004. 9
(3) The remaining provisions of this Act, other than sections 7 and 36(4) 10
and (8), commence on 1 January 2005. 11
(4) Sections 7 and 36(4) and (8) of this Act commence on 12
1 January 2006. 13

`Division 1--Cane supply is governed by supply contracts 10
`7 Purpose of pt 1 11
`(1) The purpose of this part is to provide an interim system for cane 12
supply and supply contracts in the crushing season for 2005 that will 13
promote sound economic outcomes for the sugar industry and encourage 14
changes necessary to make the industry viable in the long term. 15
`(2) The purpose is to be achieved mainly by-- 16
(a) allowing growers the flexibility to be parties to individual 17
contracts or collective contracts; and 18
(b) providing a system of compulsory mediation and arbitration for 19
disputes in negotiating supply contracts; and 20
(c) preventing a small group of growers using the compulsory 21
mediation and arbitration system to affect the supply contracts to 22
which a larger group of growers are a party; and 23
(d) enabling access, by growers, mill owners and interested third 24
parties, to mediation and arbitration for disputes about the terms 25
of supply contracts. 26

"bargaining representative", for a group of growers, means a person with 1
the written authority of each grower who is a member of the group. 2
"eligible collective" see section 14. 3
"group of growers" see section 11(1). 4
"interested third party" means a person with a direct or indirect 5
monetary interest in-- 6
(a) the supply by growers of cane to a mill; or 7
(b) the milling of cane. 8

"supply contract" means a written contract between a grower of cane and 14
a mill owner that governs supply by the grower to the mill and the 15
payment to the grower in return. 16
`9 Supply contract 17
`(1) A grower may supply cane to a mill for a crushing season only if the 18
grower has a supply contract with the mill owner for the season. 19
`(2) A supply contract may be for 1 or more than 1 crushing season. 20
`(3) However, if a supply contract has been negotiated under the dispute 21
resolution process mentioned in division 2, subdivision 1,1 the supply 22
contract ends, or is taken to end, on or before 31 December 2005. 23
`(4) A supply contract may be either an individual contract or a 24
collective contract. 25
`(5) An interested third party may be a party to a supply contract 26
between a mill owner and a grower. 27
`(6) Each of the parties to a supply contract must sign the contract. 28
`(7) However, if a supply contract has been arbitrated under section 23,2 29
the parties are not required to sign the supply contract. 30

`10 Individual contract 1
`An individual contract-- 2
(a) is a supply contract made directly between a grower and a mill 3
owner; and 4
(b) may be for all or part of the supply of cane grown by the grower. 5
`11 Collective contract 6
`(1) A collective contract is a supply contract made between 2 or more 7
growers (a "group of growers") and a mill owner. 8
`(2) Each grower in a group of growers must sign the collective contract. 9
`(3) A group of growers may appoint a bargaining representative to 10
negotiate a collective contract on behalf of the group. 11
`(4) There may be more than 1 collective contract in force at the same 12
time for a mill. 13
`(5) A grower may be a party to more than 1 collective contract. 14
`12 Variation of supply contract 15
`(1) The parties to a supply contract may, in writing, vary the contract. 16
`(2) The varied supply contract is taken to be the supply contract for this 17
part. 18

(a) a dispute arises during negotiations for a collective contract 23
between an eligible collective and a mill owner who are the 24
proposed parties to the collective contract; and 25

`An "eligible collective", for a mill, means a group consisting of 4
growers who sign an intention to contract under section 19 to supply to the 5
mill in the crushing season for 2005 at least 75% of the average production 6
of cane that was supplied to the mill in the crushing seasons for 2000 7
to 2004. 8

`The proposed parties can not use the dispute resolution process under 10
this subdivision to attempt to resolve disputes about-- 11
(a) applying a formula, commonly known as `the cane price 12
formula', to distribute between a mill owner and growers the 13
payments mentioned in section 100(3)3 in relation to the sugar 14
vested in QSL; or 15
(b) exemptions under chapter 3, part 2;4 or 16
(c) whether a person is a supplier. 17

(a) mediation of the dispute; and 21

2004 may, for the dispute resolution processes under this subdivision, act 3
as a member of the eligible collective only if the mill owner agrees. 4

`19 Before dispute resolution process 20
`Before an eligible collective for a mill or a mill owner can ask the 21
commissioner to refer to mediation a dispute about a proposed collective 22
contract, the eligible collective and the mill owner must enter into an 23
intention to contract that complies with section 20. 24
`20 Intention to contract 25
`(1) For section 19, an intention to contract must state the amount of 26
cane each member of the eligible collective for a mill intends to supply to 27
the mill in the crushing season for 2005. 28
`(2) A member of an eligible collective may be a party to more than 29
1 intention to contract. 30

`(3) However, the total amount of cane that the member states the 1
member intends to supply to all mills must not be greater than the amount 2
of cane the member produces in the crushing season for 2005. 3
`(4) Each member of the eligible collective and the mill owner must sign 4
the intention to contract. 5
`(5) The intention to contract must be lodged with the commissioner by 6
the day prescribed under a regulation. 7
`21 Effect of dispute resolution process 8
`(1) If the commissioner is satisfied the dispute has been resolved by 9
mediation under section 22, the eligible collective and the mill owner must, 10
as soon as practicable after mediation ends, enter into a collective contract. 11
`(2) If the dispute has been arbitrated under section 23, the parties to the 12
intention to contract are bound by the collective contract made under 13
arbitration. 14

`(1) A party to the dispute may ask the commissioner to refer the dispute 16
to mediation. 17
`(2) If the commissioner refers the dispute to mediation, the mediation 18
must be conducted by-- 19
(a) a person agreed to by the parties; or 20

`23 Arbitration 1
`(1) If the commissioner is satisfied the dispute has not, under 2
section 22, been resolved by mediation, the commissioner must refer the 3
dispute to an arbitrator. 4

(a) the name of the supplier; 4

`(2) The authority must not give QSL any periodic estimate given to the 7
authority under section 107C. 8

`(1) A supplier may make an exemption application to the authority. 12

(a) within a year's crushing season; and 14

season, be made after 16 September in the year only if the application-- 17
(a) is made within the year's crushing season; and 18
(b) is an application for which the maximum amount of sugar to be 19
exempted is 5 000 tonnes. 20
`(4) An exemption application made under subsection (3) is called a 21
"late exemption application". 22
`107F Requirements for application 23
`An exemption application must-- 24
(a) state the following-- 25

(i) the applicant's name and address; 1
(ii) the period of the exemption; 2
(iii) the proposed use of the sugar; 3

(i) evidence that the applicant is the supplier of the sugar to be 6
exempted; and 7
(ii) the reasonable fee fixed by the authority for deciding the 8
application that is no more than its actual costs of deciding 9
the application; and 10
(iii) for a late exemption application--a document to show the 11
applicant's contract, arrangement or understanding with the 12
on-user. 13
`107G Authority may seek further documents or information 14
`(1) This section applies if a supplier makes a late exemption application. 15
`(2) The authority may, after the application has been made, give the 16
applicant a notice requiring the applicant-- 17
(a) to give the authority a stated document or information relevant to 18
the application; or 19
(b) to verify the correctness of the document or information by 20
statutory declaration. 21
`(3) However, the notice may be given only within 15 business days 22
after the authority receives the application. 23
`(4) The application is taken to be withdrawn if, within the stated period 24
in the notice, the applicant does not comply with a requirement under 25
subsection (2). 26

`Subdivision 2--Deciding exemption application 1
`107H Decision on exemption application 2
`(1) Subject to section 107C(4),10 the authority must, within 7 days after 3
the last of the following events to happen, consider and decide either to 4
grant, grant on conditions11 or refuse each exemption application-- 5
(a) the making of the application; 6
(b) if the authority has, under section 107G, required the applicant to 7
give a document or information--the giving of the required 8
document or information. 9
`(2) If the authority does not make a decision within 7 days after the 10
event stated in subsection (1) happens-- 11
(a) the exemption application is taken to be granted 7 days after the 12
event happens; and 13
(b) the authority must, under section 107L,12 give the applicant a 14
signed exemption certificate. 15
`107I Criteria for decision 16
`(1) Subject to section 107C(4), the authority must grant an exemption 17
application if satisfied-- 18
(a) the applicant is the supplier of the sugar to be exempted; and 19
(b) the proposed use of the sugar to be exempted under the 20
application is an exempt use. 21
`(2) If the authority is not satisfied as mentioned in subsection (1), it 22
must refuse the application. 23
`107J Exemption conditions 24
`The authority may, in granting a late exemption application, impose 25
conditions on the exemption the authority considers necessary or desirable 26

to ensure the exempt sugar under the application is used only for an exempt 1

`107K Period of exemption 3
`(1) An exemption application may be granted for 1 or more than 4
1 crushing season. 5
`(2) If the authority decides to grant an exemption application, the 6
exemption remains in force for the period-- 7
(a) commencing on the day when the authority makes its decision; 8
and 9
(b) ending on the last day of the period of the exemption. 10
`Subdivision 3--Action after decision on exemption application 11
`107L Grant of exemption application 12
`(1) If an exemption application is granted, the authority must as soon as 13
practicable give the applicant a signed exemption certificate. 14
`(2) The exemption certificate must state the following-- 15
(a) the applicant's name and address; 16
(b) the period of the exemption; 17
(c) the amount of sugar exempted. 18
`(3) However, if the exemption application granted is a late exemption 19
application, the exemption certificate must also state-- 20
(a) the on-user's name and address; and 21
(b) any other information the authority considers appropriate. 22
`107M Exempt use on copy of exemption certificate 23
`(1) The authority must-- 24
(a) keep a copy of the exemption certificate; and 25
(b) state on the copy-- 26
(i) the exempt use of the sugar; and 27

`(2) The information recorded, under section 107L, on the exemption 2
certificate and, under this section, on the copy of the certificate is the 3
applicant's "exemption certificate details". 4
`107N Information authority gives QSL 5
`(1) The authority must, for each supplier granted an exemption 6
application for a year's crushing season, give QSL the following 7
information-- 8
(a) the name of the supplier; 9
(b) the amount of the supplier's sugar that will, under section 100, 10
become the property of QSL. 11
`(2) The information mentioned in subsection (1) must be given-- 12
(a) on or before 30 September in the year; or 13
(b) for a late exemption application--within 2 weeks after the 14
exemption application is made; or 15
(c) if the authority requires, under section 107G(2),13 the supplier to 16
give the authority a stated document or information--after the 17
supplier gives the authority the document or information. 18
`107O Notice of refusal of exemption application 19
`The authority must, as soon as practicable after making a decision as 20
follows about an exemption application, give the applicant an information 21
notice about the decision-- 22
(a) a decision to refuse the application; 23
(b) a decision to impose an exemption condition. 24

`(1) A supplier may at any time apply to the authority for an amendment 3
of the supplier's exemption. 4
`(2) The application for amendment must-- 5
(a) state each of the following-- 6
(i) the applicant's name and address; 7
(ii) if the proposed use of the sugar (the "new use") is different 8
from the exempt use stated on the applicant's exemption 9
certificate--the new use; 10
(iii) if the period of exemption for which the applicant is 11
applying (the "new period of exemption") is different from 12
the period of exemption stated on the applicant's exemption 13
certificate--the new period of exemption; and 14
(b) be accompanied by the reasonable fee fixed by the authority for 15
deciding the application that is no more than its actual costs of 16
deciding the application. 17
`(3) However, if the supplier's exemption was for a late exemption 18
application, the application for amendment must also-- 19
(a) if the on-user (the "new on-user") is different from the on-user 20
stated on the applicant's exemption certificate--state the new 21
on-user's name and address; and 22
(b) be accompanied by-- 23
(i) if there is a new on-user--a document to show the 24
applicant's contract, arrangement or understanding with the 25
new on-user; and 26
(ii) if there is a new proposed use--a document to show the new 27
proposed use. 28

(a) if any of the sugar has been used for an exempt use--the amount 14

(c) evidence that the sugar was used for the exempt use or is in 18

`404 Transfer of mill suppliers' committee's assets and liabilities 18
`Subject to section 405, a mill suppliers' committee's assets and 19
liabilities are transferred to the following corporation (its "replacement 20
corporation") on the transfer day and become assets and liabilities of the 21
replacement corporation-- 22
(a) generally--the corporation appointed under the PIBR Act, 23
section 41,34 as the replacement corporation for the former 24
Queensland Cane Growers' Organisation; 25
(b) if under the PIBR Act, section 46(1)(a),35 another corporation has 26
replaced the corporation mentioned in paragraph (a) as trustee of 27
the replacement corporation trust--the other corporation; 28

`405 Purpose trust for eligible growers 5
`(1) This section applies only if the replacement corporation trust for a 6
replacement corporation had not been terminated under the PIBR Act, 7
section 46(1)(b), before the transfer day. 8
`(2) The assets (the "trust property") transferred to the replacement 9
corporation under section 404 are taken to be held by it under the 10
replacement corporation trust. 11
`(3) The trust property is taken to be the trust property of the 12
replacement corporation trust. 13
`(4) The PIBR Act, section 48,36 applies to the assets as if the transfer 14
day were the replacement corporation transfer day. 15
`(5) The PIBR Act, section 45,37 applies to the liabilities transferred 16
under section 404 as if the transfer day were the replacement corporation 17
transfer day. 18
`(6) In this section-- 19
"replacement corporation transfer day" means the transfer day under 20
the PIBR Act, section 10(3).38 21

`If the replacement corporation for a mill suppliers' committee is a 23
cooperative, the Cooperatives Act 1997, section 268,39 does not apply to the 24
transfer of a mill suppliers' committee's assets and liabilities to the 25
