2000 A BILL FOR An Act to amend certain Acts relating to superannuation, and certain other Acts

 


 

s1 6 s2 Superannuation and Other Legislation Amendment The Parliament of Queensland enacts-- 1 ART 1--PRELIMINARY 2 P title 3 Short Clause 1. This Act may be cited as the Superannuation and Other Legislation 4 Amendment Act 2000. 5 6 Commencement Clause 2.(1) Sections 4(2), 21, 23 and 25 are taken to have commenced on 7 1 July 1999. 8 (2) Section 6 is taken to have commenced on 1 July 2000. 9 (3) Sections 7(1), 9(3) and 10 commence on the polling day for the 10 general election under the Electoral Act 1992 next happening after the date 11 of assent. 12 (4) The schedule, to the extent it amends the Motor Accident Insurance 13 Amendment Act 2000, is taken to have commenced on the date of assent of 14 that Act.1 15 (5) The schedule, to the extent it amends the Parliamentary 16 Commissioner Act 1974 and the Tourism Queensland Act 1979, 17 commences on a day to be fixed by proclamation. 18 19 1 The Motor Accident Insurance Amendment Act 2000 was assented to on 8 June 2000.

 


 

s3 7 s5 Superannuation and Other Legislation Amendment ART 2--AMENDMENT OF PARLIAMENTARY 1 P CONTRIBUTORY SUPERANNUATION ACT 1970 2 amended in pt 2 3 Act Clause 3. This part amends the Parliamentary Contributory Superannuation Act 4 1970. 5 of s 5 (Definitions) 6 Amendment Clause 4.(1) Section 5, definition "widow"-- 7 omit, insert-- 8 ` "widow" see section 5B.'. 9 (2) Section 5-- 10 insert-- 11 ` "index" means the all groups consumer price index for Brisbane 12 published by the Australian Statistician. 13 "June index", for a financial year, means the index for the last quarter of 14 the financial year.'. 15 of new s 5B 16 Insertion Clause 5. Part 1, after section 5A-- 17 insert-- 18 of "widow" 19 `Meaning `5B.(1) "Widow", of a member or former member, includes-- 20 (a) a widower of the member or former member; and 21 (b) a person who, on the day of the member or former member's 22 death, was living in a connubial relationship with the member or 23 former member. 24 `(2) However, a person is not the "widow" of a former member if the 25 person was not married to the former member, or living in a connubial 26

 


 

s6 8 s7 Superannuation and Other Legislation Amendment relationship with the former member, on the day the former member ceased 1 to be a member.'. 2 of s 15 (Deductions from salaries of members) 3 Amendment Clause 6. Section 15(2)-- 4 omit, insert-- 5 `(2) Subsection (1) does not apply if the member or person is 70 years or 6 more.'. 7 of s 17 (Members' superannuation benefit) 8 Amendment Clause 7.(1) Section 17(2), after `subsection (4)'-- 9 insert-- 10 `and section 18A'. 11 (2) Section 17(3)(a), after `20,'-- 12 insert-- 13 `20AA,'. 14 (3) Section 17(3A)(b)-- 15 renumber as section 17(3A)(e). 16 (4) Section 17(3A)(a)-- 17 omit, insert-- 18 `(a) for a member, under 70 years, who died before completing 19 8 years of service as a member--the amount calculated using 20 formula `A' mentioned in section 20(1)(a); or 21 (b) for a member, under 70 years, who died on or after completing 22 8 years of service as a member--the amount calculated using 23 formula `A' mentioned in section 20(1)(b); or 24 (c) for a member who died at 70 years or more and had completed 25 less than 8 years of service as a member before the member's 26 70th birthday--the amount that would have been payable to a 27 widow of the member, under section 20AA(3), if the member 28

 


 

s8 9 s8 Superannuation and Other Legislation Amendment was a new member; or 1 (d) for a member who died at 70 years or more and had completed 2 8 years or more of service as a member before the member's 3 70th birthday--the amount that would have been payable to a 4 widow of the member, under section 20AA(8), if the widow had 5 made an election under section 20AA(7) on the day of the 6 member's death; or'. 7 (5) Section 17-- 8 insert-- 9 `(4A) This section is subject to section 17A.'. 10 of new s 17A 11 Insertion Clause 8. After section 17-- 12 insert-- 13 payable to a person who ceases to be a member, and ceases 14 `Benefits to be entitled to a salary, on or after the person's 70th birthday 15 `17A.(1) This section applies to a person who ceases to be a member, 16 and ceases to be entitled to payment of a salary, on a day (the "cessation 17 day") that is on or after the person's 70th birthday. 18 `(2) Subsection (3) applies if the person-- 19 (a) is a person mentioned in section 17(1)(a) or (b); and 20 (b) completed at least 8 years of service as a member before the 21 person's 70th birthday. 22 `(3) Despite section 17(1), the person is entitled to receive a pension that 23 is the same amount as the pension the person would have been entitled to 24 receive on the cessation day, under this Act, had the person ceased to be a 25 member, and ceased to be entitled to payment of a salary, on the day before 26 the person's 70th birthday. 27 `(4) Subsection (5) applies if the person-- 28 (a) is a person mentioned in section 17(1)(a) or (b); and 29 (b) completed less than 8 years of service as a member before the 30

 


 

s8 10 s8 Superannuation and Other Legislation Amendment person's 70th birthday. 1 `(5) The person is not entitled to receive a pension under section 17(1). 2 `(6) Subsection (7) applies if the person is a person described in 3 section 17(2)(a) and (b). 4 `(7) Despite section 17(2)(c) and (d), the person is entitled to receive an 5 amount calculated using the following formula-- 6 A+B 7 where-- 8 "A" means the amount the person would have been entitled to receive, 9 under section 17(2)(c) or (d), had the person ceased to be a member on 10 the day before the person's 70th birthday. 11 "B" means the interest that would have been earned on the investment of A 12 during the period, had A been invested on a compounded basis during 13 the period, calculated by reference to-- 14 (a) if there is 1 interest rate for the period--the interest rate; or 15 (b) if there are different interest rates for different parts of the 16 period--the interest rates. 17 `(8) In this section-- 18 "interest rate", for the period or part of the period, means the interest rate 19 decided by the trustees as being indicative of the net interest earned on 20 the fund during the period or part of the period. 21 "net interest", earned on the fund, means the amount earned on the 22 investment of the fund after deducting-- 23 (a) the costs of administering the fund; and 24 (b) expenses incurred in effecting the investment; and 25 (c) taxes payable on income earned on the investment. 26 "period" means the period-- 27 (a) starting on the person's 70th birthday; and 28 (b) ending on the cessation day.'. 29

 


 

s9 11 s 10 Superannuation and Other Legislation Amendment of s 18 (Right to convert entitlement to lump sum 1 Amendment entitlement) 2 Clause 9.(1) Section 18, `section 17'-- 3 omit, insert-- 4 `section 17, 17A(3) or 19(4D)'. 5 (2) Section 18(4), after `section 19'-- 6 insert-- 7 `, other than section 19(4D)'. 8 (3) Section 18-- 9 insert-- 10 `(13) This section is subject to section 18A.'. 11 of new s 18A 12 Insertion Clause 10. After section 18-- 13 insert-- 14 amount 15 `Preserved `18A.(1) If a preservation cashing condition for a former member has 16 happened, none of a benefit payable to the former member under 17 section 17(2), 18 or 19A is a preserved amount for the fund. 18 `(2) Subsection (3) applies if a former member was a member before the 19 commencement day. 20 `(3) Subject to subsection (1), the part of the former member's benefit 21 payable under section 17(2), 18 or 19A that is a preserved amount for the 22 fund is the part that does not include the cashable amount of the benefit. 23 `(4) In this section-- 24 "cashable amount", of a former member's benefit, means the amount of 25 the benefit that-- 26 (a) would have been payable to the former member, under 27 section 17(2), if the former member had ceased to be a member 28 on the day before the commencement day; or 29

 


 

s 10 12 s 10 Superannuation and Other Legislation Amendment (b) would have been payable to the former member, under section 18 1 or 19A, if the former member made an election under the section 2 on the day before the commencement day. 3 "commencement day" means the day this section commences. 4 "preservation age" means-- 5 (a) for a former member born before 1 July 1960--55 years; or 6 (b) for a former member born between 1 July 1960 and 30 June 7 1961 inclusive--56 years; or 8 (c) for a former member born between 1 July 1961 and 30 June 9 1962 inclusive--57 years; or 10 (d) for a former member born between 1 July 1962 and 30 June 11 1963 inclusive--58 years; or 12 (e) for a former member born between 1 July 1963 and 30 June 13 1964 inclusive--59 years; or 14 (f) for a former member born after 30 June 1964--60 years. 15 "preservation cashing condition", for a person who is a former member, 16 means-- 17 (a) the person having become a former member by-- 18 (i) permanently retiring from the workforce after reaching 19 preservation age; or 20 (ii) dying; or 21 (iii) becoming totally and permanently disabled; or 22 (iv) reaching preservation age if the person has, before reaching 23 preservation age, permanently retired from the workforce for 24 a reason not mentioned in subparagraph (iii); or 25 (v) ceasing to be a member on or after reaching 60 years; or 26 (b) an event mentioned in paragraph (a)(i) to (iv) happening in 27 relation to the person while the person was a former member. 28 "preserved amount", for the fund, means a benefit payable to a former 29 member under section 17(2), 18 or 19A that must be retained in the 30

 


 

s 11 13 s 11 Superannuation and Other Legislation Amendment fund until a preservation cashing condition for the former member has 1 happened. 2 "total and permanent disablement", in relation to a former member, 3 means disablement to an extent that, in the opinion of the trustees after 4 obtaining the advice of not less than 2 medical practitioners, makes the 5 former member unlikely ever to be able to work again in an occupation 6 for which the former member is reasonably qualified by education, 7 training or experience.'. 8 of s 19 (Pension on retirement on ground of ill health) 9 Amendment Clause 11.(1) Section 19 heading, `Pension'-- 10 omit, insert-- 11 `Benefits payable'. 12 (2) Section 19(2), from `or where' to `this Act'-- 13 omit. 14 (3) Section 19(2), `pension entitlement under section 17'-- 15 omit, insert-- 16 `a benefit under section 17 or 17A'. 17 (4) Section 19-- 18 insert-- 19 `(4A) Subsection (4B) applies if a person who has applied to the trustees 20 for a pension under subsection (2) or (4)-- 21 (a) is 70 years or more; and 22 (b) completed less than 8 years of service as a member before the 23 person's 70th birthday. 24 `(4B) Despite subsection (2) or (4), the person is entitled to receive an 25 amount calculated using the following formula-- 26 A+B 27 where-- 28 "A" means the amount the person would have been entitled to receive, 29

 


 

s 11 14 s 11 Superannuation and Other Legislation Amendment under section 17(2)(c), had the person ceased to be a member on the 1 day before the person's 70th birthday. 2 "B" means the interest that would have been earned on the investment of A 3 during the period, had A been invested on a compounded basis during 4 the period, calculated by reference to-- 5 (a) if there is 1 interest rate for the period--the interest rate; or 6 (b) if there are different interest rates for different parts of the 7 period--the interest rates. 8 `(4C) Subsection (4D) applies if a person who has applied to the trustees 9 for a pension under subsection (2) or (4)-- 10 (a) is 70 years or more; and 11 (b) completed at least 8 years of service as a member before the 12 person's 70th birthday. 13 `(4D) Despite subsection (2) or (4), the person is entitled to receive a 14 pension that is the same amount as the pension the person would have been 15 entitled to receive under section 17A(3) had the person ceased to be a 16 member, on the day before the person's 70th birthday, for a reason 17 mentioned in section 17(1)(b).'. 18 (5) Section 19-- 19 insert-- 20 `(6) Subsection (5) does not apply to a person mentioned in 21 subsection (4C). 22 `(7) In this section-- 23 "interest rate", for the period or part of the period, means the interest rate 24 decided by the trustees as being indicative of the net interest earned on 25 the fund during the period or part of the period. 26 "net interest", earned on the fund, means the amount earned on the 27 investment of the fund after deducting-- 28 (a) the costs of administering the fund; and 29 (b) expenses incurred in effecting the investment; and 30 (c) taxes payable on income earned on the investment. 31

 


 

s 12 15 s 14 Superannuation and Other Legislation Amendment "period" means the period-- 1 (a) starting on the person's 70th birthday; and 2 (b) ending on the day the person ceased to be a member under this 3 section.'. 4 of s 19A (Right to convert s 19 entitlement to lump sum 5 Amendment entitlement) 6 Clause 12. Section 19A-- 7 insert-- 8 `(4) This section does not apply to a person who is entitled to receive a 9 pension under section 19(4D).'. 10 of s 20 (Benefit of widows of members other than 11 Amendment continuing members 12 Clause 13.(1) Section 20(c), definition "B", paragraph (b)-- 13 omit, insert-- 14 `(b) 40% of the basic salary on-- 15 (i) if the former member ceased to be a member before the 16 former member's 70th birthday--the day the former 17 member ceased to be a member; or 18 (ii) if the former member ceased to be a member on or after the 19 former member's 70th birthday--the day before the former 20 member's 70th birthday;'. 21 (2) Section 20-- 22 insert-- 23 `(2) This section is subject to section 20AA.'. 24 of new s 20AA 25 Insertion Clause 14. s 14 16 s 14 Superannuation and Other Legislation Amendment insert-- 1 payable to a widow of a new member who died on or after 2 `Benefits the new member's 70th birthday 3 `20AA.(1) This section applies to a widow of a new member who died 4 on or after the new member's 70th birthday. 5 `(2) Subsection (3) applies if the new member had completed less than 6 8 years of service as a member before the new member's 70th birthday. 7 `(3) Despite section 20(1)(a) or (b), the widow is entitled to receive an 8 amount calculated using the following formula-- 9 A+B 10 where-- 11 "A" means the amount the new member would have been entitled to 12 receive, under section 17(2)(c), had the new member ceased to be a 13 member on the day before the new member's 70th birthday. 14 "B" means the interest that would have been earned on the investment of A 15 during the period, had A been invested on a compounded basis during 16 the period, calculated by reference to-- 17 (a) if there is 1 interest rate for the period--the interest rate; or 18 (b) if there are different interest rates for different parts of the 19 period--the interest rates. 20 `(4) Subsection (5) applies if the new member completed at least 8 years 21 of service as a member before the new member's 70th birthday. 22 `(5) Despite section 20(1)(b), the widow is entitled to receive a pension 23 that is the same amount as the pension the new member would have been 24 entitled to receive under section 17A(3) had the new member ceased to be a 25 member, on the day of the new member's death, for a reason mentioned in 26 section 17(1)(b). 27 `(6) Subsections (7) and (8) apply if-- 28 (a) the new member died before the new member's 75th birthday; 29 and 30 (b) the widow is entitled to receive a pension under subsection (5). 31
