The Parliament of Queensland enacts-- 1

Short
Clause 1. This Act may be cited as the Road Transport Reform Act 1999. 4

Commencement
Clause 2.(1) Parts 3 and 4 and the schedule commence on 1 December 1999. 6
(2) For subsection (1), provisions of the schedule, part 1 that relocate 7
provisions of the Traffic Act 1949 commence immediately after the 8
amendments of that Act under part 3, division 1 and the schedule, part 1. 9
(3) The remaining provisions commence on a day to be fixed by 10
proclamation. 11

` "convicting" a person includes-- 3
(a) a court finding the person guilty, or accepting the person's plea of 4
guilty, whether or not a conviction is recorded; and 5
(b) the person paying a penalty under the Justices Act 1886, part 4A. 6
"doctor" means-- 7
(a) a medical practitioner; or 8
(b) a person registered as a medical practitioner under a law of the 9
Commonwealth or another State corresponding to the Medical 10
Act 1939. 11
"escort vehicle" means a vehicle that-- 12
(a) travels with an oversize vehicle to warn other road users of the 13
oversize vehicle's presence; and 14
(b) under the Transport Operations (Road Use Management) Act 15
1995, is required to be driven by an escort vehicle driver. 16
"escort vehicle driver" means a person who holds an appointment under 17
the Transport Operations (Road Use Management) Act 1995 as an 18
accredited person with the functions of an escort vehicle driver. 19
"off-street regulated parking area" see section 44BB. 20
"oversize vehicle" has the meaning given under the Transport Operations 21
(Road Use Management) Act 1995. 22
"pilot vehicle" means a vehicle that-- 23
(a) travels with an oversize vehicle to warn other road users of the 24
oversize vehicle's presence; and 25
(b) under the Transport Operations (Road Use Management) Act 26
1995, is required to be driven by a pilot vehicle driver or an escort 27
vehicle driver. 28
"pilot vehicle driver" means a person who holds an appointment under the 29
Transport Operations (Road Use Management) Act 1995 as an 30
accredited person with the functions of a pilot vehicle driver. 31

"previously convicted" means in relation to a conviction (the "later 1
conviction"), convicted before the later conviction, whether the 2
offence the subject of the later conviction was committed before the 3
earlier conviction or after it.'. 4

about a person's driver's licence or traffic history to-- 18
(a) on receiving an application in the approved form-- 19
(i) the person; or 20
(ii) with the person's written consent--another person; or 21
(b) the commissioner; or 22
(c) a person who issues drivers' licences under a corresponding law 23
to this Act; or 24
(d) an entity that, under an agreement between the State and other 25
governments, maintains a database containing information about 26
drivers' licences and traffic histories. 27

`(2) Before releasing information to a person or entity under 1
subsection (1)(c) or (d), the chief executive must be satisfied any release of 2
the information by the person or entity will be limited to circumstances 3
similar to those mentioned in subsection (1).'. 4

(b) attempt to put a motor vehicle in motion; or 26

`187.(1) To remove any doubt, it is declared that the relocated provisions 2
were not re-enacted by the Road Transport Reform Act, but merely moved 3
(without re-enactment) to this Act. 4
`(2) Without limiting subsection (1) and to further remove any doubt, it 5
is also declared that the relocation did not-- 6
(a) impliedly repeal or amend, or otherwise affect the operation of, 7
the existing provisions of this Act, the relocated provisions or the 8
provisions of any other law; or 9
(b) affect the meaning or effect that the existing or relocated 10
provisions, or the provisions of the other law, had because of the 11
respective times when they were enacted. 12
`(3) However, definitions in this Act apply to all provisions of this Act. 13
`(4) Further, it is declared that anything made or done or not made or 14
done under a relocated provision before it is relocated is taken, after it is 15
relocated, to have been made or done or not made or done under the 16
provision as relocated. 17
`(5) In an Act or document, a reference to a provision of the Traffic Act 18

`188.(1) From the commencement of this section-- 23
(a) a person's traffic history is not affected by the relocation and 24
renumbering of provisions from the Traffic Act to this Act by the 25
Road Transport Reform Act; and 26
(b) anything done or not done, including any conviction recorded, 27
under a relocated provision, before it is relocated, is taken, after it 28
is relocated, to have been done or not done under the provision as 29
relocated. 30

"footpath" means an area open to the public that is designated for, or has 10
as 1 of its main uses, use by pedestrians. 11
"foreign driver licence" means a licence to drive a motor vehicle issued 12
under the law of another country. 13
"learner licence" means a licence to drive a motor vehicle, while receiving 14
driver training, issued under this Act. 15
"left" for a person means-- 16
(a) the person's left hand side; or 17
(b) for a line, sign or something else--the left hand side of the line, 18
sign or other thing when viewed from the person's perspective. 19
"loading zone" means a length of road to which a loading zone sign 20
applies. 21
"motorbike" means-- 22
(a) a 2 wheeled motor vehicle, whether or not a sidecar is attached to 23
it; and 24
(b) a 3 wheeled motor vehicle that is ridden in the same way as a 2 25
wheeled motor vehicle. 26
"open licence" means a licence to drive a motor vehicle issued under this 27
Act that is not-- 28

"parking bay" means-- 6
(a) an area for parking a single vehicle (other than a combination) that 7

(ii) a different road surface; or 10
(b) a designated parking space; or 11
(c) a parkatarea space. 12
"parking permit for people with disabilities" means a permit issued 13
under this Act, or a corresponding law to this Act, with a people with 14
disabilities symbol. 15
"pedestrian" includes-- 16
(a) a person in a motorised wheelchair that can not travel over 17
10 km/h; and 18
(b) a person in a non-motorised wheelchair; and 19
(b) a person pushing a motorised or non-motorised wheelchair; and 20
(d) a person in or on a wheeled recreational device or wheeled toy. 21
"people with disabilities symbol" means a picture of a person seated in a 22
wheelchair, as prescribed under a regulation. 23
"probationary licence" means a licence to drive a motor vehicle issued 24
under this Act that is first issued after the person has, under an order 25
made by an Australian court, served a period of disqualification from 26
holding or obtaining a licence. 27
"provisional licence" means a licence to drive a motor vehicle issued under 28
this Act that is subject to particular restrictions imposed because of the 29
holder's limited driving experience. 30

"Queensland driver licence" means any of the following licences-- 1
(a) a learner, probationary, provisional, open or restricted licence 2
issued under this Act; 3
(b) a current driver licence receipt issued under this Act for a learner, 4

"restricted licence" means a licence to drive a motor vehicle, issued under 6
this Act to give effect to a court order under section 87,6 that authorises 7
the holder to drive only in stated circumstances directly connected with 8
the person's means of earning a living. 9

(a) the person's right hand side; or 11
(b) for a line, sign or something else--the right hand side of the line, 12
sign or other thing when viewed from the person's perspective. 13
"road" means an area that is-- 14
(a) open to or used by the public and is developed for, or has as 1 of 15
its main uses, the driving or riding of motor vehicles; or 16
(b) dedicated to public use as a road; or 17
(c) declared under a regulation to be a road. 18
