1 Short title

This Act may be cited as the Residential Services and Other Legislation 4
Amendment Act 2004. 5

This part amends the Residential Services (Accommodation) Act 2002. 9

omit, insert-- 15
`(2) The dictionary in the schedule defines what is a residential service 16
for this Act mainly by reference to the definition "residential service" under 17
the accreditation Act. 18
`(3) The accreditation Act establishes systems for the registration and 19
accreditation of residential services under that Act, to ensure the services 20
are conducted at an appropriate standard.'. 21

`132A Meaning of "independent student accommodation service" 7
`(1) An "independent student accommodation service" is a service 8
that-- 9
(a) is conducted mainly to provide accommodation to persons who 10
are enrolled in courses that, under the Social Security Act 1991 11
(Cwlth), section 569B, are approved courses of education or 12
study for section 569A(b)1 of that Act; and 13
(b) is of a type mentioned in the accreditation Act, section 4(1), (2) 14
or (3); and 15
(c) is not a service mentioned in the accreditation Act, 16
section 4(5)(e), (f) or (h). 17
`(2) For subsection (1)(b), in deciding whether a service is of a type 18
mentioned in the accreditation Act, section 4(1), section 4(4) of that Act 19
applies.'. 20

"residential service" means-- 1
(a) a residential service under the accreditation Act, section 4; or 2

(b) an independent student accommodation service. 3
"unregistered service" means-- 4
(a) a residential service that is not registered under the accreditation 5
Act; or 6
(b) an independent student accommodation service.'. 7
