Racing (Race Fields) Amendment Bill 2006
The Parliament of Queensland enacts-- 1
Clause 1 Short title 2
This Act may be cited as the Racing (Race Fields) Amendment 3
Act 2006. 4
Clause 2 Commencement 5
This Act commences on a day to be fixed by proclamation. 6
Clause 3 Act amended 7
This Act amends the Racing Act 2002. 8
Clause 4 Insertion of new ss 326A 9
Chapter 8, part 1, division 5, before section 327-- 10
insert-- 11
`326A Restrictions on publication of race fields 12
`(1) A betting service provider must not, in the State or elsewhere, 13
publish, or otherwise make available, a race field for a race in 14
the course of business without the approval of the control 15
body under the control of which the race is to be held. 16
Maximum penalty--80 penalty units. 17
`(2) Subsection (1) does not apply to the following-- 18
(a) a race wagering licensee; 19
(b) a racing bookmaker. 20
`(3) In this section-- 21
betting contract means a contract, arrangement or 22
understanding to-- 23
(a) make a bet or wager; or 24
(b) enter into, or take a share or interest in, another 25
transaction that involves a bet or wager. 26

betting exchange means a facility of any type through 1
which-- 2
(a) offers to enter into betting contracts are regularly made 3
or accepted; or 4
(b) offers or invitations to enter into betting contracts are 5
regularly made that are intended to result, or may 6
reasonably be expected to result, directly or indirectly, 7
in the acceptance of the offers or invitations. 8
betting service provider means-- 9
(a) a person who, in the State or elsewhere-- 10
(i) operates a totalisator or betting exchange; or 11
(ii) carries on the business of, or acts as, a bookmaker; 12
or 13
(iii) gains, or tries to gain, the person's livelihood 14
wholly or partly by betting or wagering; or 15
(b) an employee or agent of a person mentioned in 16
paragraph (a). 17
publish means publish or disseminate, or cause to be 18
published or disseminated, in any form or by any method of 19
communication. 20
race field means information that identifies, or may identify, 21
the names or numbers of animals that-- 22
(a) are nominated for, or will take part in, a race at a race 23
meeting in the State; or 24
(b) have been scratched, or otherwise withdrawn, from a 25
race at a race meeting in the State. 26
