2001 A BILL FOR An Act to amend the Racing and Betting Act 1980

s1 4 s4 Racing and Betting Amendment Bill 2001 The Parliament of Queensland enacts-- 1 1 Short title Clause 2 This Act may be cited as the Racing and Betting Amendment Act 2001. 3 2 Act amended Clause 4 This Act amends the Racing and Betting Act 1980. 5 3 Amendment of s 43 (Vacation of office) Clause 6 (1) Section 43(1)(d) and (f)-- 7 omit. 8 (2) Section 43(1)(c), (e) and (g)-- 9 renumber as section 43(1)(b) to (d). 10 (3) Section 43(2A) and (3)-- 11 omit. 12 4 Insertion of new s 47A Clause 13 After section 47-- 14 insert-- 15 `47A Disclosure of interests 16 `(1) This section applies to a member of the Harness Racing Board (the 17 "interested member") if-- 18 (a) the interested member has a direct or indirect financial interest in 19 an issue being considered, or about to be considered, by the 20 Harness Racing Board; and 21 (b) the interest could conflict with the proper performance of the 22 member's duties about the consideration of the issue. 23 `(2) As soon as practicable after the relevant facts come to the interested 24 member's knowledge, the member must disclose the nature of the interest 25 to a meeting of the Harness Racing Board. 26

s5 5 s5 Racing and Betting Amendment Bill 2001 `(3) Unless the Harness Racing Board otherwise directs, the interested 1 member must not-- 2 (a) be present when the Harness Racing Board considers the issue; 3 or 4 (b) take part in a decision of the Harness Racing Board about the 5 issue. 6 `(4) The interested member must not be present when the Harness 7 Racing Board is considering whether to give a direction under 8 subsection (3). 9 `(5) If there is another member of the Harness Racing Board who must, 10 under subsection (2), also disclose an interest in the issue, the other 11 member must not-- 12 (a) be present when the Harness Racing Board is considering 13 whether to give a direction under subsection (3) about the 14 interested member; or 15 (b) take part in making the decision about giving the direction. 16 `(6) If-- 17 (a) because of this section, a member of the Harness Racing Board is 18 not present at a meeting of the Harness Racing Board for 19 considering or deciding an issue, or for considering or deciding 20 whether to give a direction under subsection (3); and 21 (b) there would be a quorum if the member were present; 22 the remaining members of the Harness Racing Board present are a quorum 23 of the Harness Racing Board for considering or deciding the issue, or for 24 considering or deciding whether to give the direction, at the meeting. 25 `(7) A disclosure under subsection (2) must be recorded in the minute 26 book.'. 27 5 Amendment of s 84 (Vacation of office) Clause 28 (1) Section 84(1)(d) and (f)-- 29 omit. 30 (2) Section 84(1)(c), (e) and (g)-- 31 renumber as section 84(1)(b) to (d). 32

s6 6 s6 Racing and Betting Amendment Bill 2001 6 Insertion of new s 88A Clause 1 After section 88-- 2 insert-- 3 `88A Disclosure of interests 4 `(1) This section applies to a member of the Greyhound Authority (the 5 "interested member") if-- 6 (a) the interested member has a direct or indirect financial interest in 7 an issue being considered, or about to be considered, by the 8 authority; and 9 (b) the interest could conflict with the proper performance of the 10 member's duties about the consideration of the issue. 11 `(2) As soon as practicable after the relevant facts come to the interested 12 member's knowledge, the member must disclose the nature of the interest 13 to a meeting of the Greyhound Authority. 14 `(3) Unless the Greyhound Authority otherwise directs, the interested 15 member must not-- 16 (a) be present when the authority considers the issue; or 17 (b) take part in a decision of the authority about the issue. 18 `(4) The interested member must not be present when the Greyhound 19 Authority is considering whether to give a direction under subsection (3). 20 `(5) If there is another member of the Greyhound Authority who must, 21 under subsection (2), also disclose an interest in the issue, the other 22 member must not-- 23 (a) be present when the authority is considering whether to give a 24 direction under subsection (3) about the interested member; or 25 (b) take part in making the decision about giving the direction. 26 `(6) If-- 27 (a) because of this section, a member of the Greyhound Authority is 28 not present at a meeting of the authority for considering or 29 deciding an issue, or for considering or deciding whether to give 30 a direction under subsection (3); and 31 (b) there would be a quorum if the member were present; 32

s7 7 s7 Racing and Betting Amendment Bill 2001 the remaining members of the authority present are a quorum of the 1 authority for considering or deciding the issue, or for considering or 2 deciding whether to give the direction, at the meeting. 3 `(7) A disclosure under subsection (2) must be recorded in the minute 4 book.'. 5 7 Insertion of new pt 9 Clause 6 After section 279-- 7 insert-- 8 `PART 9--VALIDATION PROVISION 9 `280 Validation of certain actions 10 `(1) This section applies if, apart from this section, because of the 11 existence of a relevant circumstance at the relevant time and the operation 12 of section 43(1)(f) of the Act as in force before the commencement, John 13 Crowley's office as member or chairperson of the Harness Racing Board 14 became vacant. 15 `(2) It is declared that section 43(1)(f) of the Act as in force before the 16 commencement did not at the relevant time operate, because of the relevant 17 circumstance, to vacate John Crowley's office as member or chairperson of 18 the Harness Racing Board. 19 `(3) In this section-- 20 "commencement" means the commencement of this section. 21 "company" means Bryan Byrt Ford Pty Ltd (ACN 010 100 517). 22 "relevant circumstance" means-- 23 (a) the entering into a contract for or on behalf of the Harness 24 Racing Board for the purchase by the Harness Racing Board 25 from the company of a motor vehicle; or 26 (b) the purchase by the Harness Racing Board from the company of 27 a motor vehicle. 28 "relevant time" means any time from 19 May 1995 to 23 August 2000.'. 29 30
