The Parliament of Queensland enacts-- 1
Clause 1 Short title 2
This Act may be cited as the Racing Amendment Act 2006. 3
Clause 2 Commencement 4
This Act, other than sections 3 and 9, commences on 1 July 5

new thoroughbred control body means Queensland Racing 24
Limited ACN 116 735 374, approved as the control body for 25
thoroughbred racing. 26

`398 Dissolution of former board 1
`(1) On the commencement-- 2
(a) the former board is dissolved; and 3
(b) the members of the former board go out of office. 4
`(2) No compensation is payable to a member because of 5
subsection (1). 6
`399 New thoroughbred control body is legal successor of 7
former board 8
`(1) The new thoroughbred control body is the successor in law of 9
the former board. 10
`(2) The other provisions of this part do not limit subsection (1). 11
`400 Assets and liabilities etc. 12
`(1) On the commencement-- 13
(a) anything that was an asset or liability of the former 14
board immediately before the commencement becomes 15
an asset or liability of the new thoroughbred control 16
body; and 17
(b) an agreement or arrangement in force immediately 18
before the commencement between the former board 19
and another entity is taken to be an agreement or 20
arrangement between the new thoroughbred control 21
body and the other entity; and 22
(c) any property that was, immediately before the 23
commencement, held by the former board on trust or 24
subject to conditions continues to be held by the new 25
thoroughbred control body on the same trusts or subject 26
to the same conditions. 27
`(2) The registrar of titles or other person responsible for keeping a 28
register for dealings in property must, if asked by the new 29
thoroughbred control body, record the vesting of property 30
under this section in the new thoroughbred control body. 31

`401 Employees of former board 1
`(1) This section applies to a person who, immediately before the 2
commencement, was an employee of the former board. 3
`(2) On the commencement, the person becomes an employee of 4
the new thoroughbred control body. 5
`(3) The person-- 6
(a) must be employed on terms and conditions of 7
employment at least equivalent to those applying to the 8
person immediately before the commencement; and 9
(b) remains entitled to all rights of employment existing or 10
accruing immediately before the commencement. 11
`402 Proceedings 12
`(1) A proceeding that could have been started by or against the 13
former board before the commencement may be started by or 14
against the new thoroughbred control body. 15
`(2) From the commencement, an existing proceeding may be 16
continued and finished by or against the new thoroughbred 17
control body. 18
`(3) In this section-- 19
existing proceeding means a proceeding that-- 20
(a) was taken by or against a following person before the 21
commencement-- 22
(i) the former board; 23
(ii) a member of the former board in the capacity as a 24
member of the former board; and 25
(b) has not been finished before the commencement. 26
`403 Things done by former board 27
`(1) Anything done by the former board under this Act-- 28
(a) continues to have effect; and 29
(b) from the commencement, is taken to have been done by 30
the new thoroughbred control body. 31

`(2) Without limiting subsection (1), on the commencement-- 1
(a) a policy of the former board that was in effect 2
immediately before the commencement continues as if 3
it were a policy of the new thoroughbred control body; 4
and 5
(b) rules of racing made by the former board and in force 6
immediately before the commencement continue as if 7
they were rules of racing made by the new thoroughbred 8
control body; and 9
(c) a licence issued or taken to be issued by the former 10
board before the commencement that is in force 11
immediately before the commencement continues as if 12
it had been issued by the new thoroughbred control 13
body; and 14
(d) a racing calendar prepared by the former board for a 15
period ending after the commencement continues as if it 16
had been prepared by the new thoroughbred control 17
body. 18
`404 Rights and obligations of former board under this Act 19
`Without limiting any other provision in this part, a right or 20
obligation of the former board under this Act immediately 21
before the commencement becomes a right or obligation of 22
the new thoroughbred control body. 23
`405 Application of audit regime to new thoroughbred 24
control body 25
`From the commencement, a program approved by the 26
Minister under section 46(3)1 for 2006 applies to the new 27
thoroughbred control body to the extent it is stated to apply to 28
the former board. 29

`406 Provision for committee members 1
`(1) This section applies to a person who-- 2
(a) immediately before the commencement, was a member 3
of the committee and a member of the former board; and 4
(b) on the commencement, is a member or director of the 5
new thoroughbred control body. 6
`(2) Despite section 68C(g)(i),2 the person does not vacate office 7
as a member of the committee. 8
`407 Provision for application of s 68M 9
`(1) This section applies for section 68M3 in relation to the year in 10
which the commencement falls. 11
`(2) An amount of the former board's net UNiTAB product fee 12
paid under the section by the former board before the 13
commencement is taken to have been paid by the new 14
thoroughbred control body under the section. 15
`408 Appeals 16
`(1) If an appeal committee was established by the former board 17
and is in existence immediately before the commencement, on 18
the commencement the appeal committee-- 19
(a) continues as if it had been established by the new 20
thoroughbred control body under its rules of racing for 21
thoroughbred racing; and 22
(b) may continue to deal with an appeal under consideration 23
immediately before the commencement as if the appeal 24
had been started under the new thoroughbred control 25
body's rules of racing for thoroughbred racing. 26
`(2) Subsection (3) applies in relation to an appeal-- 27
(a) against a reviewable decision made before the 28
commencement; and 29

(b) started after the commencement. 1
`(3) The appeal may be dealt with by-- 2
(a) an appeal committee mentioned in subsection (1); or 3
(b) if there is no appeal committee established by the former 4
board and in existence immediately before the 5
commencement--an appeal committee established by 6
the new thoroughbred control body. 7
`(4) For subsections (1)(b) and (3), the steward's decision 8
appealed against is taken to be a decision made by the steward 9
for the new thoroughbred control body. 10
`(5) This section does not limit section 403(1). 11
`409 Continuation of action started against licensed club 12
under ch 3, pt 4 13
`(1) This section applies if, before the commencement, the former 14
board-- 15
(a) gave a licensed club a show cause notice under chapter 16
3, part 4;4 and 17
(b) has not decided whether to take action under the part in 18
relation to the club. 19
`(2) From the commencement, chapter 3, part 4 continues to apply 20
in relation to the show cause notice as if the notice had been 21
given by the new thoroughbred control body. 22
`(3) This section does not limit section 403(1). 23
`410 Pt 4 does not affect existing legal relationships 24
`Nothing done under this part in relation to the former 25
board-- 26
(a) places the new thoroughbred control body in breach of a 27
contract, trust or confidence or otherwise makes the new 28
thoroughbred control body guilty of a civil wrong; or 29

(b) makes the new thoroughbred control body in breach of 1
any instrument, including an instrument prohibiting, 2
restricting or regulating the assignment, transfer or 3
assumption of a right or liability; or 4
(c) is taken to fulfil a condition or otherwise constitute an 5
event-- 6
(i) allowing a person to terminate an instrument or be 7
released, wholly or partly, from an obligation or 8
modify the operation or effect of an instrument or 9
obligation; or 10
(ii) requiring money to be paid, or anything else to be 11
done, before its stated maturity; or 12
(d) releases a surety or other obligee, wholly or partly, from 13
an obligation. 14
`411 References to former board 15
`In an Act or document, a reference to the former board may, 16
if the context permits, be taken as a reference to the new 17
thoroughbred control body.'. 18
