The Parliament of Queensland enacts-- 1
Clause 1 Short title 2
This Act may be cited as the Parliament of Queensland 3
Amendment Act 2007. 4

This Act amends the Parliament of Queensland Act 2001. 6

`In this part-- 16
advance allowance means an allowance of a particular type 17
payable to a member under the handbook in relation to a 18
period and in advance for the period. 19
handbook means the Members' Entitlements Handbook. 20
Members' Entitlements Handbook means the Members' 21
Entitlements Handbook setting out `benefits afforded 22
members and former members of the Queensland Legislative 23
Assembly' approved by the Governor in Council and includes 24
amendments of the handbook approved by the Governor in 25
Council from time to time and published in the Gazette. 26

prescribed rate of interest means interest at the Reserve Bank 1
of Australia cash rate plus 50 basis points, calculated daily. 2

pro rata amount of an advance allowance relating to the 6
remainder of a period means the proportion of the amount of 7
the allowance that is the same proportion that the remainder of 8
the period bears to the whole period. 9
`123E Liability of former members to repay amounts 10
advanced under handbook 11
`(1) If a member is paid an advance allowance and then stops 12
being a member before the end of the period in relation to 13
which the allowance is paid, the member is liable to repay the 14
pro rata amount of the allowance relating to the remainder of 15
the period (the overpaid amount). 16
`(2) If any part of the overpaid amount is unpaid after the end of 6 17
months after the day the member stops being a member, the 18
prescribed rate of interest is payable on the unpaid amount. 19
`(3) The overpaid amount together with any interest payable under 20
subsection (2) is a debt owing to the State and may be 21
recovered by the Clerk, with the approval of the Premier, in a 22
court of competent jurisdiction. 23
`123F Provision relating to member not returned at the 24
general election of 9 September 2006 25
`(1) This section applies to a person-- 26
(a) who was a member before the general election held on 9 27
September 2006 and was not returned at the election, 28
whether or not the person was a candidate for the 29
election; and 30
(b) who, before the election, was paid an advance allowance 31
in relation to the 6 month period from 1 July 2006; and 32
(c) who has not repaid the pro rata amount of the allowance 33
relating to the remainder of the period in relation to 34

which the allowance was paid, being the part of the 1
period after the election (the overpaid amount). 2
`(2) The person is liable to repay the overpaid amount. 3
`(3) If any part of the overpaid amount is unpaid after 30 June 4
2007, the prescribed rate of interest is payable on the unpaid 5
amount. 6
`(4) The overpaid amount together with any interest payable under 7
subsection (3) is a debt owing to the State and may be 8
recovered by the Clerk, with the approval of the Premier, in a 9
court of competent jurisdiction. 10

`A certificate signed by the Clerk stating any of the following 12
is evidence of the matter stated-- 13
(a) that a person was a member who had received an 14
advance allowance of a stated amount in relation to a 15
stated period; 16
(b) that under this part the person is liable to repay a stated 17
amount of the advance allowance and any accrued 18
interest; 19
(c) that the person at a stated date had not paid a stated 20
amount the person is liable to repay under this part.'. 21
