The Parliament of Queensland enacts-- 1
1 Short title

This Act may be cited as the Parliament of Queensland Amendment 3
Act 2004. 4
2 Act amended

This Act amends the Parliament of Queensland Act 2001. 6
3 Amendment of s 70 (Meaning of "transacts business")

(1) Section 70(2)(a)(ii)-- 8
omit, insert-- 9
`(ii) the contract, to the extent of the member's interest, provides 10
for-- 11
(A) the provision by an entity of the State of goods or 12
services, that are available to the public, on the same 13
terms the goods or services are available to the public; 14
or 15
(B) the acquisition from an entity of the State of an interest 16
in land, that is available to the public, on the same 17
terms the interest is available to the public; or 18
(C) the acquisition by an entity of the State of an interest in 19
land on terms not less favourable to the entity than if 20
the sale were by a member of the public; or'. 21
(2) Section 70(2)(a), examples of subparagraph (ii)-- 22

`(1) During the transitional period, section 71(2)1 is taken always to have 3
applied in relation to a contract as if the amendment had commenced on 4
6 June 2002. 5
`(2) For deciding whether a member has contravened section 71(1) 6
during the transitional period, section 72(1)(h)2 is taken to apply as if the 7
amendment had commenced on 6 June 2002. 8
`(3) Section 159(6)3 has effect as if the amendment had commenced on 9
6 June 2002. 10
`(4) In this section-- 11
"amendment" means the Parliament of Queensland Amendment Act 2004, 12
section 3.4 13
"transitional period" means the period starting at the beginning of 14
6 June 2002 and ending at the end of the day before the 15
commencement of the amendment.'. 16
