2001 A BILL FOR An Act to amend legislation about primary industries

s1 8 s4 Primary Industries Legislation Amendment Bill 2001 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Primary Industries Legislation Amendment 4 Act 2001. 5 2 Commencement Clause 6 Parts 3 and 9 and the schedule, amendments of the Veterinary Surgeons 7 Act 1936, commence on a day to be fixed by proclamation. 8 PART 2--AMENDMENT OF CHEMICAL USAGE 9 (AGRICULTURAL AND VETERINARY) CONTROL 10 ACT 1988 11 3 Act amended in pt 2 Clause 12 This part amends the Chemical Usage (Agricultural and Veterinary) 13 Control Act 1988. 14 4 Amendment of s 4 (Definitions) Clause 15 (1) Section 4, `In this Act--'-- 16 omit, insert-- 17 `The dictionary in the schedule defines particular words used in this 18 Act.'. 19 (2) Section 4, definitions "crop", "disease", "manufactured stock 20 food" and "plant"-- 21 omit. 22

s5 9 s6 Primary Industries Legislation Amendment Bill 2001 (3) Section 4-- 1 insert-- 2 ` "animal" has the meaning given by the Agvet Code. 3 "pest" has the meaning given by the Agvet Code. 4 "plant" has the meaning given by the Agvet Code.'. 5 (4) Section 4, definitions (as amended)-- 6 relocate to schedule as inserted by this Act. 7 5 Amendment of s 8A (Use of registered chemical products in Clause 8 contravention of labels) 9 (1) Section 8A(1) to (3)-- 10 omit, insert-- 11 `(1) Subject to section 8D, a person who uses a registered chemical 12 product must use the product in a way stated in the instructions on the 13 approved label for containers for the product. 14 Maximum penalty--40 penalty units. 15 `(2) However, a person does not contravene subsection (1) if the person 16 uses the product-- 17 (a) in a way authorised by a permit or prescribed under a regulation; 18 or 19 (b) for an authorised veterinary purpose.'. 20 (2) Section 8A(4)-- 21 renumber as section 8A(3). 22 6 Amendment of s 8D (Compliance with instructions) Clause 23 (1) Section 8D(1)-- 24 omit. 25 (2) Section 8D(5) to (7)-- 26 omit, insert-- 27 `(5) A person does not contravene an instruction about using a chemical 28 product to control a pest if the person uses the product to control another 29

s7 10 s 10 Primary Industries Legislation Amendment Bill 2001 pest, unless the instruction states the product must not be used to control 1 the other pest. 2 `(6) A person does not contravene an instruction about a method of using 3 a chemical product if the method used by the person (the "alternative 4 method") is different from the instruction, unless the instruction states the 5 alternative method must not be used.'. 6 (3) Section 8D(2) to (8)-- 7 renumber as section 8D(1) to (6). 8 7 Amendment to omit headings following cross references Clause 9 (1) This section applies to a section containing a cross reference to a 10 provision of an Act followed by a heading to the provision in round 11 brackets. 12 (2) The section is amended by omitting the brackets and the words in the 13 brackets. 14 PART 3--AMENDMENT OF CHICKEN MEAT 15 INDUSTRY COMMITTEE ACT 1976 16 8 Act amended in pt 3 Clause 17 This part amends the Chicken Meat Industry Committee Act 1976. 18 9 Amendment of s 17 (Finance) Clause 19 Section 17(2)-- 20 omit. 21 10 Omission of s 21 (Processors to notify committee of agreements) Clause 22 Section 21-- 23 omit. 24

s 11 11 s 11 Primary Industries Legislation Amendment Bill 2001 11 Insertion of new pt 3A Clause 1 After section 24-- 2 insert-- 3 `PART 3A--REGISTRATION OF AGREEMENTS AND 4 ANNUAL FEES 5 `Division 1--Registration 6 `24A Committee to keep register 7 `The committee must keep a register of agreements. 8 `24B Application for registration 9 `(1) The processor under an agreement must apply to the committee for 10 registration of the agreement within 30 days after entering into it. 11 Maximum penalty--10 penalty units. 12 `(2) The application must be-- 13 (a) in the form approved by the committee; and 14 (b) accompanied by the fee prescribed under a regulation. 15 `24C Registration 16 `The committee must-- 17 (a) register the agreement; and 18 (b) give the applicant notice of the registration. 19 `Division 2--Annual fees 20 `24D Payment of annual fee 21 `(1) This section applies to an agreement in force on its anniversary day. 22 `(2) Within 30 days after the anniversary day, the processor under the 23 agreement must give to the committee-- 24

s 12 12 s 12 Primary Industries Legislation Amendment Bill 2001 (a) a return in the form approved by the committee; and 1 (b) the annual fee prescribed under a regulation. 2 Maximum penalty--10 penalty units. 3 `(3) If the annual fee is not paid, the committee may recover it as a debt. 4 `(4) In this section-- 5 "anniversary day" means-- 6 (a) for an agreement in force immediately before the 7 commencement--each anniversary of the commencement; or 8 (b) for another agreement--each anniversary of the day the 9 agreement was entered into.'. 10 12 Insertion of new pt 5 Clause 11 After section 26-- 12 insert-- 13 `PART 5--TRANSITIONAL PROVISIONS FOR 14 PRIMARY INDUSTRIES LEGISLATION AMENDMENT 15 ACT 2001 16 `27 Registration of current agreements 17 `Section 24B applies to the processor under an agreement in force 18 immediately before the commencement of the section as if it were entered 19 into on the commencement. 20 `28 Expiry 21 `This part expires 60 days after the commencement of the part.'. 22

s 13 13 s 17 Primary Industries Legislation Amendment Bill 2001 PART 4--AMENDMENT OF GRAIN RESEARCH 1 FOUNDATION ACT 1976 2 13 Act amended in pt 4 Clause 3 This part amends the Grain Research Foundation Act 1976. 4 14 Amendment of s 4 (Definitions) Clause 5 (1) Section 4, definition "the Association"-- 6 omit. 7 (2) Section 4-- 8 insert-- 9 ` "association" see section 7(1)(a).'. 10 15 Amendment of s 7 (Membership of the Foundation) Clause 11 Section 7(1)(a), `the Association;'-- 12 omit, insert-- 13 `the entity the chief executive considers is the peak industry body 14 representing grain growers in the State's grain industries (the 15 "association"); and'. 16 PART 5--AMENDMENT OF MEAT INDUSTRY 17 ACT 1993 18 16 Act amended in pt 5 Clause 19 This part amends the Meat Industry Act 1993. 20 17 Replacement of pt 7B hdg Clause 21 Part 7B, heading-- 22 omit, insert-- 23

s 18 14 s 20 Primary Industries Legislation Amendment Bill 2001 `PART 7B--ADMINISTRATION AND WINDING-UP OF 1 ABATTOIR CORPORATION'. 2 18 Amendment of s 162H (Appointment of administrator) Clause 3 Section 162H(3)(b), `section 146(2) or (3)'-- 4 omit, insert-- 5 `section 146(2) or (3), or 162N(1)(c)'. 6 19 Amendment of s 162K (Additional functions of administrator) Clause 7 Section 162K(1)-- 8 insert-- 9 `(d) if the Minister directs the administrator to wind-up the abattoir 10 corporation-- 11 (i) to wind-up the abattoir corporation; and 12 (ii) to give the Minister a report on the winding-up at any time 13 the Minister requires.'. 14 20 Insertion of new ss 162L162N Clause 15 Part 7B, after section 162K-- 16 insert-- 17 `162L Administrator's powers 18 `(1) The administrator has power to do all things necessary or convenient 19 to be done for winding-up the abattoir corporation. 20 `(2) Without limiting subsection (1), the administrator-- 21 (a) has control of the abattoir corporation's businesses, property and 22 affairs; and 23 (b) may carry on the business and manage the property and affairs; 24 and 25 (c) may terminate or dispose of all or part of the businesses; and 26 (d) may deal with, or dispose of, any of the property. 27

s 54 34 s 54 Primary Industries Legislation Amendment Bill 2001 (b) a veterinary surgeon will not be practising veterinary science at 1 the premises; or 2 (c) if the applicant is an individual--the applicant has been 3 convicted of a disqualifying offence; or 4 (d) if the applicant is a corporation--any of the corporation's 5 executive officers has been convicted of a disqualifying offence. 6 `Division 3--Conditions 7 `25G Conditions of approvals 8 `(1) The board may impose on the approval the reasonable conditions the 9 board decides, including, for example, conditions about the following-- 10 (a) the equipment used or intended to be used at the premises; 11 (b) hygiene practices, or the safe storage of drugs, at the premises; 12 (c) the qualifications or skills required of a person working at the 13 premises; 14 (d) the number of staff employed at the premises; 15 (e) the branches of veterinary science that may be practised at the 16 premises. 17 `(2) Without limiting subsection (1), the approval must state that the 18 approval holder must allow a member or officer of the board to enter the 19 premises stated in the approval to inspect the premises, including, for 20 example, fittings, equipment or records at the premises, for compliance 21 with the conditions of the approval. 22 `(3) However, the member or officer may enter the premises only when 23 the premises are open for carrying on business or otherwise open for entry. 24 `Division 4--Amendment, suspension or cancellation of approvals 25 `25H Amendment--grounds 26 `The board may amend an approval, including, for example, by adding a 27 further condition to the approval-- 28 (a) with the written agreement of the approval holder; or 29

s 54 35 s 54 Primary Industries Legislation Amendment Bill 2001 (b) if the board believes the amendment is necessary or desirable to 1 ensure the premises under the approval are suitable for use as 2 veterinary premises and section 25J has been complied with. 3 `25I Suspension or cancellation--grounds 4 `The board may suspend or cancel the approval if it believes on 5 reasonable grounds-- 6 (a) the approval was granted because of a materially false or 7 misleading representation or document, made either orally or in 8 writing; or 9 (b) the premises are not suitable for use as veterinary premises 10 having regard to the standards prescribed or determined under 11 section 29A for conducting veterinary premises; or 12 (c) a veterinary surgeon does not practise veterinary science at the 13 premises; or 14 (d) the holder of the approval has not complied with a condition of 15 the approval; or 16 (e) if-- 17 (i) the holder is an individual--the holder has committed, or is 18 committing, a disqualifying offence; or 19 (ii) the holder is a corporation--any of the corporation's 20 executive officers has committed, or is committing, a 21 disqualifying offence. 22 `25J Amendment, suspension or cancellation--procedure 23 `(1) If the board proposes to amend, suspend or cancel an approval, the 24 board must give the approval holder a written notice stating each of the 25 following-- 26 (a) the action (the "proposed action") the board proposes taking 27 under this section; 28 (b) the grounds for the proposed action; 29 (c) the facts and circumstances that are the basis for the grounds; 30 (d) if the proposed action is to amend the approval--the proposed 31 amendment; 32

s 54 36 s 54 Primary Industries Legislation Amendment Bill 2001 (e) if the proposed action is suspension of the approval--the 1 suspension period; 2 (f) that the holder may make, within a stated period, written 3 representations to show why the proposed action should not be 4 taken. 5 `(2) The stated period must end at least 28 days after the holder is given 6 the notice. 7 `(3) If, after considering all representations made within the stated 8 period, the board still believes a ground exists to take the proposed action, 9 the board may-- 10 (a) if the proposed action is to amend the approval--amend the 11 approval; or 12 (b) if the proposed action is to suspend the approval for a stated 13 period--suspend the approval for no longer than the proposed 14 suspension period; or 15 (c) if the proposed action is to cancel the approval--cancel the 16 approval or suspend it for a period. 17 `(4) This section does not apply if the approval is amended under 18 section 25H(a). 19 `25K Notice of amendment, suspension or cancellation 20 `(1) The board must, as soon as practicable after making a decision 21 under section 25J(3), give the approval holder an information notice. 22 `(2) The decision takes effect on-- 23 (a) the day the notice is given; or 24 (b) if a later day is stated in the notice--the stated day. 25

s 54 37 s 54 Primary Industries Legislation Amendment Bill 2001 `PART 4B--OFFENCE PROVISIONS 1 `25L Conducting veterinary practice 2 `A person must not conduct a veterinary practice other than at veterinary 3 premises. 4 Maximum penalty--40 penalty units. 5 `25M Persons who must not practise veterinary science 6 `(1) A person who is not a veterinary surgeon must not practise 7 veterinary science. 8 Maximum penalty--40 penalty units. 9 `(2) However, a person does not commit an offence against 10 subsection (1) if-- 11 (a) the person practises veterinary science other than for fee or 12 reward; or 13 (b) the person-- 14 (i) is undertaking a course of study, or a qualifying 15 examination, in veterinary science approved by the board; 16 and 17 (ii) practises veterinary science under the supervision of a 18 veterinary surgeon. 19 `25N Allowing or directing person who is not a veterinary surgeon to 20 practise veterinary science 21 `(1) A veterinary surgeon must not allow or direct another person who is 22 not a veterinary surgeon to practise veterinary science in relation to an 23 animal under the veterinary surgeon's care. 24 Maximum penalty--40 penalty units. 25 `(2) However, a veterinary surgeon does not commit an offence against 26 subsection (1) if-- 27 (a) the other person is undertaking a course of study, or a qualifying 28 examination, in veterinary science approved by the board; and 29

s 54 38 s 54 Primary Industries Legislation Amendment Bill 2001 (b) in practising veterinary science in relation to the animal, the 1 other person acts under the supervision of the veterinary surgeon. 2 `25O Directing veterinary surgeon to practise veterinary science 3 `A person in control of veterinary premises must not direct a veterinary 4 surgeon to practise veterinary science in a way that would be a ground for a 5 charge against the veterinary surgeon alleging misconduct in a professional 6 respect. 7 Maximum penalty--40 penalty units. 8 `25P Claims about being a veterinary surgeon 9 `(1) A person who is not a veterinary surgeon must not-- 10 (a) claim, or hold himself or herself out, to be a veterinary surgeon; 11 or 12 (b) allow himself or herself to be held out as a veterinary surgeon. 13 Maximum penalty--40 penalty units. 14 `(2) A person must not hold out another person as a veterinary surgeon if 15 the person knows or ought reasonably to know the other person is not a 16 veterinary surgeon. 17 Maximum penalty--40 penalty units. 18 `25Q Using titles etc. 19 `(1) A person who is not a veterinary surgeon must not use-- 20 (a) a title that consists of, or includes, the words `veterinary surgeon' 21 or an abbreviation of the words; or 22 (b) another title, name or initials suggesting, in the context in which 23 the title, name or initials are used, that the person is a veterinary 24 surgeon or is practising veterinary science. 25 Maximum penalty--40 penalty units. 26 `(2) A person who is not a veterinary specialist must not use-- 27 (a) a title that consists of, or includes, the words `veterinary 28 specialist' or an abbreviation of the words; or 29
