PART 1--PRELIMINARY 2
1 Short title

This Act may be cited as the Primary Industries Legislation Amendment 4
Act 2001. 5
2 Commencement
Clause 6
Parts 3 and 9 and the schedule, amendments of the Veterinary Surgeons 7
Act 1936, commence on a day to be fixed by proclamation. 8

(a) in a way authorised by a permit or prescribed under a regulation; 18

(b) for an authorised veterinary purpose.'. 20

`(1) The processor under an agreement must apply to the committee for 10
registration of the agreement within 30 days after entering into it. 11

`(2) The application must be-- 13
(a) in the form approved by the committee; and 14
(b) accompanied by the fee prescribed under a regulation. 15

`The committee must-- 17
(a) register the agreement; and 18
(b) give the applicant notice of the registration. 19
`Division 2--Annual fees 20
`24D Payment of annual fee 21
`(1) This section applies to an agreement in force on its anniversary day. 22
`(2) Within 30 days after the anniversary day, the processor under the 23
agreement must give to the committee-- 24

(a) a return in the form approved by the committee; and 1
(b) the annual fee prescribed under a regulation. 2

`(3) If the annual fee is not paid, the committee may recover it as a debt. 4
`(4) In this section-- 5
"anniversary day" means-- 6
(a) for an agreement in force immediately before the 7
commencement--each anniversary of the commencement; or 8
(b) for another agreement--each anniversary of the day the 9
agreement was entered into.'. 10

(b) may carry on the business and manage the property and affairs; 24

(c) may terminate or dispose of all or part of the businesses; and 26

`(3) To remove any doubt, it is declared that part 7 does not limit the 1
administrator's powers. 2
`162M Completion of winding-up 3
`(1) This section applies if the Minister directs the administrator to 4
wind-up the abattoir corporation. 5
`(2) On completion of the winding-up-- 6
(a) the net proceeds of the winding-up must be paid to the abattoir 7
corporation; or 8
(b) if there are no net proceeds but there are debts arising from the 9
winding-up--the debts remain debts of the abattoir corporation. 10
`(3) Within 14 days after completion of the winding-up, the 11
administrator must give to the Minister-- 12
(a) a report on the winding-up; and 13
(b) any other information or documents the Minister requests to fully 14
explain the winding-up to the satisfaction of the Minister. 15
`(4) The Minister must table a copy of the report in the Legislative 16
Assembly within 14 sitting days after receiving it. 17
`162N Dissolution of abattoir corporation 18
`(1) On the dissolution day-- 19
(a) the net proceeds of the winding-up vest in the State or, if there 20
are no net proceeds but there are debts arising from the 21

premises stated in the approval to inspect the premises, including, for 20
example, fittings, equipment or records at the premises, for compliance 21
with the conditions of the approval. 22

the premises are open for carrying on business or otherwise open for entry. 24

misleading representation or document, made either orally or in 8
writing; or 9
(b) the premises are not suitable for use as veterinary premises 10
having regard to the standards prescribed or determined under 11
section 29A for conducting veterinary premises; or 12
(c) a veterinary surgeon does not practise veterinary science at the 13
premises; or 14
(d) the holder of the approval has not complied with a condition of 15
the approval; or 16
(e) if-- 17
(i) the holder is an individual--the holder has committed, or is 18
committing, a disqualifying offence; or 19
(ii) the holder is a corporation--any of the corporation's 20
executive officers has committed, or is committing, a 21
disqualifying offence. 22
`25J Amendment, suspension or cancellation--procedure 23
`(1) If the board proposes to amend, suspend or cancel an approval, the 24
board must give the approval holder a written notice stating each of the 25
following-- 26
(a) the action (the "proposed action") the board proposes taking 27
under this section; 28
(b) the grounds for the proposed action; 29
(c) the facts and circumstances that are the basis for the grounds; 30
(d) if the proposed action is to amend the approval--the proposed 31
amendment; 32

(e) if the proposed action is suspension of the approval--the 1
suspension period; 2
(f) that the holder may make, within a stated period, written 3
representations to show why the proposed action should not be 4
taken. 5
`(2) The stated period must end at least 28 days after the holder is given 6
the notice. 7
`(3) If, after considering all representations made within the stated 8
period, the board still believes a ground exists to take the proposed action, 9
the board may-- 10
(a) if the proposed action is to amend the approval--amend the 11
approval; or 12
(b) if the proposed action is to suspend the approval for a stated 13
period--suspend the approval for no longer than the proposed 14
suspension period; or 15
(c) if the proposed action is to cancel the approval--cancel the 16
approval or suspend it for a period. 17
`(4) This section does not apply if the approval is amended under 18
section 25H(a). 19
`25K Notice of amendment, suspension or cancellation 20
`(1) The board must, as soon as practicable after making a decision 21
under section 25J(3), give the approval holder an information notice. 22
`(2) The decision takes effect on-- 23
(a) the day the notice is given; or 24
(b) if a later day is stated in the notice--the stated day. 25

`(2) However, a person does not commit an offence against 10

(a) the person practises veterinary science other than for fee or 12
reward; or 13
(b) the person-- 14
(i) is undertaking a course of study, or a qualifying 15
examination, in veterinary science approved by the board; 16
and 17
(ii) practises veterinary science under the supervision of a 18
veterinary surgeon. 19
`25N Allowing or directing person who is not a veterinary surgeon to 20
practise veterinary science 21
`(1) A veterinary surgeon must not allow or direct another person who is 22
not a veterinary surgeon to practise veterinary science in relation to an 23
animal under the veterinary surgeon's care. 24

`(2) However, a veterinary surgeon does not commit an offence against 26
subsection (1) if-- 27
(a) the other person is undertaking a course of study, or a qualifying 28
examination, in veterinary science approved by the board; and 29

(b) in practising veterinary science in relation to the animal, the 1
other person acts under the supervision of the veterinary surgeon. 2

`A person in control of veterinary premises must not direct a veterinary 4
surgeon to practise veterinary science in a way that would be a ground for a 5
charge against the veterinary surgeon alleging misconduct in a professional 6
respect. 7

`25P Claims about being a veterinary surgeon 9
`(1) A person who is not a veterinary surgeon must not-- 10
(a) claim, or hold himself or herself out, to be a veterinary surgeon; 11

(b) allow himself or herself to be held out as a veterinary surgeon. 13

`(2) A person must not hold out another person as a veterinary surgeon if 15
the person knows or ought reasonably to know the other person is not a 16

(b) the approval is taken to be subject to a condition that the approval 12
holder must allow a member or officer of the board to enter the 13
premises stated in the approval to inspect the premises, 14
including, for example, fittings, equipment or records at the 15
premises, for compliance with the conditions of the approval. 16
`(3) In this section-- 17
"former section 25A" means section 25A as in force from time to time 18
before its repeal by the Primary Industries Legislation Amendment Act 19
