This Act may be cited as the Primary Industries and Fisheries 4
Legislation Amendment Act 2004. 5
Clause 2 Commencement 6
(1) Part 7 is taken to have commenced on 30 September 2004. 7
(2) Part 9 commences on 1 January 2005. 8
(3) The remaining provisions of this Act commence on assent. 9

`33B Starting an appeal 1
`(1) An appeal is started by-- 2
(a) filing a notice of appeal with the registrar of the 3
Supreme Court; and 4
(b) complying with the rules of court applicable to the 5
appeal.1 6
`(2) For the Uniform Civil Procedure Rules, section 748,2 the date 7
of the decision appealed against is taken to be the day the 8
appellant receives notice of the decision. 9
`(3) However, the Court of Appeal may, at any time, extend the 10
period for filing a notice of appeal. 11
`33C Hearing procedures 12
`The procedure for an appeal is to be under the rules of court 13
applicable to the appeal or, if the rules make no provision or 14
insufficient provision, under the directions of the Court of 15
Appeal. 16
`33D Powers of Court of Appeal on appeal 17
`In deciding an appeal against a decision, the Court of Appeal 18
may-- 19
(a) confirm the decision; or 20
(b) amend the decision; or 21
(c) substitute another decision for the decision.'. 22

`(1) Subject to registration under this subdivision, an authority 13
other than a permit may be transferred unless, under a 14
regulation or management plan, the authority is not 15
transferable either generally or in the circumstances relating 16
to the particular authority.3 17
`(2) On registration of the transfer, all rights and liabilities 18
attaching to the authority vest in the transferee.'. 19
`65A Application to register transfer of authority 20
`(1) An application to register the transfer of an authority must be 21
made-- 22
(a) to the chief executive; and 23
(b) in the approved form; and 24

(c) jointly by each holder of the authority 1
(the "transferor") and each person to whom the 2
authority is transferred (the "transferee"). 3
`(2) Without limiting what an approved form may require, the 4
approved form must include-- 5
(a) a sufficient description of the authority and if the 6
transfer is of a quota from 1 authority to another--a 7
description of the other authority; and 8
(b) a written declaration by the transferor that-- 9
(i) the information in or accompanying the application 10
provided by the transferor is true; and 11
(ii) the transferor has complied with the requirements 12
under the Act that relate to the authority; and 13
(c) a written declaration by the transferee that-- 14
(i) the information in or accompanying the application 15
provided by the transferee is true; and 16
(ii) the transferee has complied with the requirements 17
under the Act that relate to the authority. 18
`(3) The application must be accompanied by each of the 19
following-- 20
(a) the fees prescribed under a regulation; 21
(b) the written approval of each person, other than the 22
holder, who has an interest in the authority noted in the 23
register of authorities kept by the chief executive; 24
(c) the authority to be transferred; 25
(d) any other document or information prescribed under a 26
regulation. 27
`(4) The application must be executed by the transferor and the 28
transferee. 29
`(5) An application is validly executed if it is executed in the same 30
way as is provided for the execution of an instrument under 31
the Land Title Act 1994, section 161(1), (2) and (3A).4 32

`65B Registration of transfer of authority 1
`(1) An application to register the transfer of an authority is a 2
properly made application if the application complies with 3
section 65A and the transferor and the transferee have 4
complied with any requirements under subsection (2). 5
`(2) The chief executive may, by written notice, require the 6
transferor or the transferee (the applicant) to give the chief 7
executive further documents or information to enable the chief 8
executive to register the transfer. 9
`(3) The chief executive must register the transfer of an authority if 10
the chief executive receives a properly made application in 11
relation to the authority.'. 12

an individual to a prescribed government entity if the chief 22
executive is satisfied on reasonable grounds that-- 23
(a) the information would help the entity to perform its 24
function of investigating or taking action in relation to 25
criminal offences; and 26
(b) disclosure of the information is appropriate in the 27
circumstances. 28

`(2) Also, the chief executive may disclose personal information 1
about an individual to a prescribed government entity if-- 2
(a) the entity asks for the information; and 3
(b) the entity states that the information would help the 4
entity to perform its function of investigating or taking 5
action in relation to criminal offences; and 6
(c) the entity undertakes not to use the information for any 7
other purpose. 8
`(3) The chief executive may develop a policy about matters to be 9
considered in making a decision about disclosing personal 10
information.5 11
`(4) The chief executive can not, under section 21, delegate a 12
power under this section. 13
`(5) In this section-- 14
prescribed government entity means-- 15
(a) a Minister of the State, another State or the 16
Commonwealth; or 17
(b) an entity of or representing the State, another State, a 18
Territory or the Commonwealth in relation to a function 19
the entity has under a law to investigate or take action in 20
relation to criminal offences. 21

Australian Taxation Office, Australian Federal Police, the police service
24
of the State or another State, a government entity responsible for the
25
management of aquatic ecosystems in the Commonwealth or another
26
State
personal information-- 27
1. Personal information, about an individual, means 28
information or an opinion about the individual, held by 29
the chief executive, if-- 30
(a) the individual's identity is apparent or can 31
reasonably be found out from the information or 32
opinion; and 33

(b) the information or opinion came to the chief 1
executive in the course of the administration of this 2

`36A Who may appeal to the District Court 1
`(1) A person who is aggrieved by an original decision about 2
compensation may appeal to the District Court against the 3
decision. 4
`(2) Also, a person who has appealed to the Magistrates Court 5
against an original decision, other than a decision about 6
compensation, may appeal to the District Court against the 7
Magistrates Court decision. 8
`36B Starting an appeal 9
`(1) An appeal under section 36A is started by-- 10
(a) filing a notice of appeal with the registrar of the District 11
Court; and 12
(b) complying with the rules of court applicable to the 13
appeal.7 14
`(2) The notice must be filed within 28 days after-- 15
(a) the day the person receives notice of the decision 16
appealed against; or 17
(b) if paragraph (a) does not apply, the day the person 18
otherwise becomes aware of the decision. 19
`(3) However, the District Court may, at any time, extend the 20
period for filing the notice of appeal. 21
`36C Stay of operation of decision 22
`(1) The District Court may grant a stay of the operation of the 23
decision appealed against under section 36A to secure the 24
effectiveness of the appeal. 25
`(2) The stay-- 26
(a) may be given on conditions the court considers 27
appropriate; and 28

(b) has effect for the period fixed by the court; and 1
(c) may be amended or revoked by the court. 2
`(3) The period of the stay must not extend past the time when the 3
court decides the appeal. 4
`(4) An appeal against a decision affects the decision, or the 5
carrying out of the decision, only if the decision is stayed. 6
`36D Hearing procedures 7
`(1) In deciding an appeal under section 36A, the court-- 8
(a) has the same powers as the entity that made the original 9
decision; and 10
(b) is not bound by the rules of evidence; and 11
(c) must comply with natural justice. 12
`(2) The appeal is by way of rehearing, unaffected by the decision 13
appealed against, on the material before the entity that made 14
the original decision and any further evidence allowed by the 15
court. 16

`In deciding an appeal under section 36A, the court may-- 18
(a) confirm the decision appealed against; or 19
(b) amend the decision appealed against; or 20

`36I Stay of operation of decision 15
`(1) The Court of Appeal may grant a stay of the operation of the 16
decision appealed against under section 36F to secure the 17
effectiveness of the appeal. 18
`(2) The stay-- 19
(a) may be given on conditions the court considers 20
appropriate; and 21
(b) has effect for the period fixed by the court; and 22
(c) may be amended or revoked by the court. 23
`(3) The period of the stay must not extend past the time when the 24
court decides the appeal. 25
`(4) An appeal against a decision affects the decision, or the 26
carrying out of the decision, only if the decision is stayed. 27

`The procedure for an appeal under section 36F is to be under 2
the rules of court applicable to the appeal or, if the rules make 3
no provision or insufficient provision, under the directions of 4
the Court of Appeal. 5
`36K Powers of court on appeal 6
`In deciding an appeal under section 36F, the court may-- 7
(a) confirm the decision appealed against; or 8
(b) amend the decision appealed against; or 9
(c) substitute another decision for the decision appealed 10
against.'. 11
