2001 A BILL FOR An Act to amend the Private Employment Agencies Act 1983, and for other purposes

 


 

s1 8 s5 Private Employment Agencies and Other Acts Amendment Bill 2001 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Private Employment Agencies and Other 4 Acts Amendment Act 2001. 5 2 Commencement Clause 6 (1) Part 4 commences on assent. 7 (2) The remaining provisions commence on a day to be fixed by 8 proclamation. 9 PART 2--AMENDMENT OF PRIVATE EMPLOYMENT 10 AGENCIES ACT 1983 11 3 Act amended in pt 2 and sch Clause 12 This part and the schedule amend the Private Employment Agencies 13 Act 1983. 14 4 Amendment of title Clause 15 Title, `agencies'-- 16 omit, insert-- 17 `agents'. 18 5 Amendment of s 1 (Short title) Clause 19 Section 1, `Agencies'-- 20

 


 

s6 9 s6 Private Employment Agencies and Other Acts Amendment Bill 2001 omit, insert-- 1 `Agents'. 2 6 Replacement of s 5 (Interpretation) Clause 3 Section 5-- 4 omit, insert-- 5 `5 Definitions 6 `The dictionary in the schedule defines particular words used in this Act. 7 `5A Meaning of "private employment agent" 8 `(1) A person is a "private employment agent" if the person, in the 9 course of carrying on business and for gain-- 10 (a) offers to find-- 11 (i) casual, part-time, temporary, permanent or contract work 12 for a person; or 13 (ii) a casual, part-time, temporary, permanent or contract 14 worker for a person; or 15 (b) negotiates the terms of contract work for a model or performer; 16 or 17 (c) administers a contract for a model or performer and arranges 18 payments under it; or 19 (d) provides career advice for a model or performer. 20 `(2) However, a person is not a "private employment agent" only 21 because the person publishes-- 22 (a) for someone else, an advertisement about employment 23 opportunities; or 24 (b) an advertisement offering employment opportunities with the 25 person. 26 `(3) Also, an employer is not a "private employment agent" if, for an 27 agreed rate of payment to the employer-- 28

 


 

s7 10 s7 Private Employment Agencies and Other Acts Amendment Bill 2001 (a) the employer makes an employee of the employer available to 1 perform work of a temporary nature for a client of the employer; 2 and 3 (b) the employee works under the client's direction; and 4 (c) the employer is solely responsible for performing obligations 5 owed by an employer for the employee, including paying the 6 employee for the work.'. 7 7 Replacement of ss 6 to 8 Clause 8 Sections 6 to 8-- 9 omit, insert-- 10 `6 Licensing officer 11 `(1) There is to be a licensing officer ("licensing officer"). 12 `(2) The licensing officer is to be an officer of the department appointed 13 by the chief executive. 14 `7 Delegation by licensing officer 15 `(1) The licensing officer may delegate the licensing officer's powers 16 under this Act to an appropriately qualified public service employee. 17 `(2) In this section-- 18 "appropriately qualified" includes having the qualifications, experience 19 or standing appropriate to the exercise of the power. 20 21 Example of `standing'-- 22 The level at which a person is employed within the department. `8 Evidence of authority 23 `(1) In exercising a power under this Act in relation to a person, an 24 inspector must-- 25 (a) identify himself or herself as an inspector under this Act and the 26 Industrial Relations Act 1999; and 27 (b) produce the inspector's identity card as an inspector under the 28 Industrial Relations Act 1999 for the person's inspection before 29

s 13 12 s 13 Private Employment Agencies and Other Acts Amendment Bill 2001 omit. 1 (3) Section 17(3)(a), `(whether' to `name)'-- 2 omit. 3 (4) Section 17(3), as a penalty-- 4 insert-- 5 `Maximum penalty for subsection (3)--27 penalty units.'. 6 (5) Section 17(4)-- 7 omit. 8 13 Replacement of ss 18 to 26 Clause 9 Sections 18 to 26-- 10 omit, insert-- 11 `18 Applying for licence 12 `(1) An individual, a group of individuals or a corporation may apply to 13 the licensing officer for a licence. 14 `(2) The application must be made in the approved form accompanied by 15 the fee prescribed under a regulation. 16 `19 Licensing officer to grant licence 17 `(1) On receiving an application, the licensing officer must promptly 18 consider the application and grant the licence to the applicant. 19 `(2) However, if after considering the application, the officer reasonably 20 believes-- 21 (a) the applicant-- 22 (i) has contravened-- 23 (A) this Act or the Industrial Relations Act 1999, 24 section 408D(1) or (2); or 25 (B) a corresponding law to this Act or the Industrial 26 Relations Act 1999, section 408D(1) or (2); or 27 (ii) has not paid a person an amount the applicant is required to 28 pay under an order made under the Industrial Relations Act 29

 


 

s 13 13 s 13 Private Employment Agencies and Other Acts Amendment Bill 2001 1999, section 408E, 408F or 408G1 or a corresponding law 1 to the section; or 2 (b) the applicant has been convicted, in Queensland or elsewhere, 3 within the preceding 5 years of a serious offence; 4 the officer must refer the application to the committee for its advice on 5 whether or not the officer should grant the licence. 6 `20 Licensing officer must give documents or information to 7 committee 8 `If under section 19 the licensing officer refers an application to the 9 committee, the officer must when referring the application give the 10 committee any documents or information the officer has that are relevant to 11 the applicant or the application. 12 `21 If committee advises licensing officer to grant application 13 `If after considering the application the committee advises the officer to 14 grant the licence, the officer must promptly grant the licence to the 15 applicant. 16 `22 If committee advises licensing officer to refuse to grant 17 application 18 `(1) If after considering the application the committee advises the officer 19 to refuse to grant the licence, the officer must consider the advice and may 20 grant the licence or refuse to grant the licence. 21 `(2) If the officer decides to grant the licence, the officer must promptly 22 give it to the applicant. 23 `(3) If the officer decides to refuse to grant the licence, the officer must 24 promptly give the applicant signed notice ("decision notice") of the 25 decision. 26 `(4) The decision notice must state the following particulars-- 27 1 Section 408E (Magistrate may order repayment of fees received by private employment agent in criminal proceedings), 408F (Commission may order repayment of fees received by private employment agent) or 408G (Magistrate may order repayment of fees received by private employment agent in civil proceedings)

 


 

s 13 14 s 13 Private Employment Agencies and Other Acts Amendment Bill 2001 (a) the decision; 1 (b) the reasons for the decision; 2 (c) the applicant may appeal to an industrial magistrate against the 3 decision within 28 days after the notice is given to the applicant.2 4 `23 Licence particulars 5 `A licence must state each of the following particulars-- 6 (a) the licence number; 7 (b) the holder's name; 8 (c) if the business is operated under a business name--the business 9 name; 10 (d) the place where the holder is authorised to carry on the business 11 of a private employment agent. 12 `24 Duration of licence 13 `(1) Unless a licence is sooner cancelled or surrendered, the licence ends 14 when this Act expires. 15 `(2) In this section-- 16 "licence" means-- 17 (a) an existing licence renewed under part 5; or 18 (b) a licence granted under section 19, 21 or 22 after the 19 commencement of this section. 20 `25 Voluntary surrender of licence 21 `(1) A holder of a licence may surrender the licence by signed notice 22 given to the licensing officer. 23 `(2) The surrender takes effect-- 24 (a) on the day on which the notice is given; or 25 (b) if a later day is stated in the notice--on the later day. 26 2 See part 3B (Appeals)

 


 

s 14 15 s 15 Private Employment Agencies and Other Acts Amendment Bill 2001 `26 Referral of matters to committee 1 `(1) If the licensing officer receives a complaint about the holder of a 2 licence, the officer may refer the complaint to the committee-- 3 (a) to attempt to resolve the complaint in an informal way; or 4 (b) if the committee is not able to resolve the complaint, to 5 recommend to the officer the action, if any, the officer may take 6 about the complaint including cancelling the holder's licence if 7 there are grounds for cancelling it. 8 `(2) Also, the officer may refer any other matter arising under this Act or 9 the Industrial Relations Act 1999, section 408D3 to the committee for its 10 help or advice.'. 11 14 Amendment of s 26A (Published list of licence holders) Clause 12 Section 26A, from `person for' to `functions of the'-- 13 omit. 14 15 Replacement of ss 27 to 30 Clause 15 Sections 27 to 30-- 16 omit, insert-- 17 `27 Grounds for cancelling licence 18 `Each of the following is a ground for cancelling a licence-- 19 (a) the licence was obtained because of incorrect or misleading 20 information; 21 (b) the holder of the licence has contravened-- 22 (i) this Act or the Industrial Relations Act 1999, 23 section 408D(1) or (2); or 24 (ii) a corresponding law to this Act or the Industrial Relations 25 Act 1999, section 408D(1) or (2); 26 (c) the holder has not paid a person an amount the holder is required 27 to pay under an order made under the Industrial Relations Act 28 3 Section 408D (When fees are or are not payable to private employment agent)

 


 

s 15 16 s 15 Private Employment Agencies and Other Acts Amendment Bill 2001 1999, section 408E, 408F or 408G4 or a corresponding law to the 1 section; 2 (d) the holder has been convicted, in Queensland or elsewhere, 3 within the preceding 5 years of a serious offence. 4 `28 Procedure for cancelling licence 5 `(1) This section applies if the licensing officer believes a ground exists 6 to cancel a licence. 7 `(2) The officer must give the holder of the licence a notice (the "show 8 cause notice") that-- 9 (a) states that it is proposed to cancel the holder's licence; and 10 (b) states the grounds for proposing to cancel the licence; and 11 (c) outlines the facts and circumstances that form the basis for the 12 officer's belief; and 13 (d) invites the holder to make representations, within a stated time of 14 not less than 28 days, why the licence should not be cancelled. 15 `(3) If, after considering all representations made within the stated time, 16 the officer still believes the ground exists to cancel the licence, the officer 17 may cancel the licence. 18 `(4) The officer must give the holder notice ("decision notice") of the 19 officer's decision. 20 `(5) The decision notice must state-- 21 (a) the reasons for the decision; and 22 (b) that the holder may appeal against the decision to an industrial 23 magistrate within 28 days after the date of the notice.5 24 `(6) The decision takes effect on the later of the following-- 25 4 Section 408E (Magistrate may order repayment of fees received by private employment agent in criminal proceedings), 408F (Commission may order repayment of fees received by private employment agent) or 408G (Magistrate may order repayment of fees received by private employment agent in civil proceedings) 5 See part 3B (Appeals)

s 16 18 s 16 Private Employment Agencies and Other Acts Amendment Bill 2001 (ii) standards of competence and training for private 1 employment agents; 2 (iii) disciplining private employment agents who contravene the 3 code; 4 (iv) the records that private employment agents must keep; 5 (b) if an application for a licence or the renewal of an existing 6 licence is referred by the licensing officer to the committee for its 7 advice on whether or not the officer should grant or renew the 8 licence--advising the officer on whether or not the officer should 9 grant or renew the licence; 10 (c) if asked by the licensing officer--attempting to resolve, in an 11 informal way, a complaint made by a person to the officer about 12 the holder of a licence; 13 (d) reporting to the licensing officer on whether or not a complaint 14 mentioned in paragraph (c) is resolved and if not, recommending 15 to the officer the action, if any, the officer may take about the 16 complaint including cancelling a holder's licence if there is a 17 ground for cancelling it; 18 (e) if asked by the licensing officer--otherwise helping or advising 19 the officer with any matter arising under this Act or the Industrial 20 Relations Act 1999, section 408D6. 21 `(4) In performing its functions, the committee-- 22 (a) may-- 23 (i) consult with anyone the committee consider appropriate; or 24 (ii) ask the licensing officer to give the committee any 25 information, including copies of departmental records, 26 about a matter; and 27 (b) may do all things necessary or convenient to be done for, or in 28 connection with, the performance of its functions. 29 6 Section 408D (When fees are or are not payable to private employment agent)

s 20 27 s 20 Private Employment Agencies and Other Acts Amendment Bill 2001 "representative" means-- 1 (a) of a corporation--an executive officer, employee or agent of the 2 corporation; or 3 (b) of an individual--an employee or agent of the individual. 4 "state of mind", of a person, includes-- 5 (a) the person's knowledge, intention, opinion, belief or purpose; 6 and 7 (b) the person's reasons for the intention, opinion, belief or purpose. 8 `37 Executive officers must ensure corporation complies with Act 9 `(1) The executive officers of a corporation must ensure that the 10 corporation complies with this Act. 11 `(2) If a corporation commits an offence against a provision of this Act, 12 each of the executive officers of the corporation also commit an offence, 13 namely, the offence of failing to ensure that the corporation complies with 14 the provision. 15 Maximum penalty--the penalty for the contravention of the provision by 16 an individual. 17 `(3) Evidence that the corporation has committed an offence against a 18 provision of this Act is evidence that each of the executive officers 19 committed the offence of failing to ensure that the corporation complies 20 with the provision. 21 `(4) However, it is a defence for an executive officer to prove that-- 22 (a) if the officer was in a position to influence the conduct of the 23 corporation in relation to the offence--the officer took all 24 reasonable steps to ensure the corporation complied with the 25 provision; or 26 (b) the officer was not in a position to influence the conduct of the 27 corporation in relation to the offence. 28 `(5) For subsection (4)(a), it is sufficient for the executive officer to 29 prove that the act or omission that was the offence was done or made 30 without the officer's knowledge despite the officer having taken all 31 reasonable steps to ensure the corporation complied with the provision.'. 32

s 32 37 s 32 Private Employment Agencies and Other Acts Amendment Bill 2001 (c) display a hairstyle or other personal body ornamentation or 1 decoration. 2 "performer" means a person whose work is to act, dance, mime, perform, 3 play, sing or speak in advertising or entertainment. 4 "private employment agent" see section 408B. 5 "publish" includes-- 6 (a) publish in writing or in any other form of media; and 7 (b) cause to be published. 8 `408B Meaning of "private employment agent" 9 `(1) A person is a "private employment agent" if the person, in the 10 course of carrying on business and for gain-- 11 (a) offers to find-- 12 (i) casual, part-time, temporary, permanent or contract work 13 for a person; or 14 (ii) a casual, part-time, temporary, permanent or contract 15 worker for a person; or 16 (b) negotiates the terms of contract work for a model or performer; 17 or 18 (c) administers a contract for a model or performer and arranges 19 payments under it; or 20 (d) provides career advice for a model or performer. 21 `(2) However, a person is not a "private employment agent" only 22 because the person publishes-- 23 (a) for someone else, an advertisement about employment 24 opportunities; or 25 (b) an advertisement offering employment opportunities with the 26 person. 27 `(3) Also, an employer is not a "private employment agent" if, for an 28 agreed rate of payment to the employer-- 29 (a) the employer makes an employee of the employer available to 30 perform work of a temporary nature for a client of the employer; 31 and 32

 


 

s 32 38 s 32 Private Employment Agencies and Other Acts Amendment Bill 2001 (b) the employee works under the client's direction; and 1 (c) the employer is solely responsible for performing obligations 2 owed by an employer for the employee, including paying the 3 employee for the work. 4 `408C Meaning of "manager" 5 `(1) A private employment agent is a "manager" of a model or 6 performer if the agent, under a written agreement with the model or 7 performer, provides for the model or performer at least 4 of the 8 management services mentioned in paragraphs (a) to (f) of the definition 9 "management service" in subsection (4). 10 `(2) A private employment agent may be a "manager" of a model or 11 performer whether or not any agreement between them states that the agent 12 is the sole provider of management services for the model or performer. 13 `(3) However, a private employment agent is not a "manager" of a 14 model or performer only because of a written agreement under which the 15 agent helps the model or performer find modelling or performing work. 16 `(4) In this section-- 17 "management service" includes any of the following services-- 18 (a) handling business affairs for the model or performer; 19 (b) providing accounting advice for the model or performer; 20 (c) publicising and promoting the model or performer; 21 (d) providing services ancillary to a performance by the model or 22 performer; 23 (e) providing continuing career or artistic advice for the model or 24 performer; 25 (f) representing the model or performer in negotiations with media, 26 entertainment industry workers or the public; 27 but does not include a service mentioned in section 408B(1)(a) to (c). 28

 


 

s 32 39 s 32 Private Employment Agencies and Other Acts Amendment Bill 2001 `408D When fees are or are not payable to private employment agent 1 `(1) A private employment agent must not directly or indirectly demand 2 or receive from a person, other than a model or performer, looking for work 3 (a "work seeker") a fee for finding, or attempting to find, the person work. 4 Maximum penalty--16 penalty units. 5 `(2) A private employment agent must not directly or indirectly demand 6 or receive from a model or performer looking for work (also a "work 7 seeker") a fee for finding, or attempting to find, the model or performer 8 work unless-- 9 (a) the agent gives the model or performer a written notice stating 10 the particulars prescribed under a regulation; and 11 (b) the fee payable is not more than the percentage prescribed under 12 a regulation of the gross amount payable to the model or 13 performer, excluding any allowances or payments prescribed 14 under a regulation, for the work; and 15 (c) the amount payable to the model or performer is at least the 16 amount payable under an applicable industrial instrument. 17 Maximum penalty--16 penalty units. 18 `(3) Subsection (2) does not apply if the private employment agent is 19 also the manager of the model or performer and the fee is payable under a 20 written agreement between the manager and the model or performer. 21 `(4) In this section-- 22 "industrial instrument" includes an award or agreement made under the 23 Commonwealth Act. 24 `408E Magistrate may order repayment of fees received by private 25 employment agent in criminal proceedings 26 `(1) A magistrate who hears and decides a complaint for an offence 27 against section 408D(1) or (2)-- 28 (a) must, if the magistrate finds the defendant guilty, order the 29 defendant to repay to the work seeker the fee, if any, the 30 magistrate finds, on the balance of probabilities, to have been 31 received in contravention of section 408D(1) or (2), if-- 32 (i) the fee has not been repaid to the work seeker; and 33

 


 

s 32 40 s 32 Private Employment Agencies and Other Acts Amendment Bill 2001 (ii) the defendant is not liable to repay the fee to the work 1 seeker under an existing order under section 408F or 408G; 2 or 3 (b) may, if the magistrate does not find the defendant guilty, order 4 the defendant to repay to the work seeker the amount the 5 magistrate finds, on the balance of probabilities, the defendant 6 has received from the work seeker. 7 `(2) The magistrate may make the order-- 8 (a) despite an express or implied provision of an agreement to the 9 contrary; and 10 (b) on the terms the magistrate considers appropriate. 11 `408F Commission may order repayment of fees received by private 12 employment agent 13 `(1) An application may be made to the commission for an order for the 14 repayment of a fee received by a private employment agent in 15 contravention of section 408D(1) or (2) from a person ("claimant") for 16 finding or attempting to find the claimant work. 17 `(2) An application can not be made to the commission if the total fee 18 claimed under subsection (1) is more than $20 000. 19 `(3) The application may be made by-- 20 (a) the claimant; or 21 (b) an employee organisation of which the claimant is a member, 22 acting for the claimant; or 23 (c) a person authorised by the claimant to make the application, 24 acting for the claimant; or 25 (d) an inspector. 26 `(4) The application must be made within 6 years after the claimant gave 27 the agent the fee. 28 `(5) The commissioner administrator may, either before or after the start 29 of a hearing, remit the application to a magistrate if the commissioner 30 administrator considers the application could be more conveniently heard 31 by a magistrate, having regard to-- 32 (a) the difficulty or expense of producing witnesses; or 33

 


 

s 32 41 s 32 Private Employment Agencies and Other Acts Amendment Bill 2001 (b) another good and sufficient reason, for example, cost. 1 `(6) A magistrate may hear and decide the application as if it had been 2 brought before the commission and the magistrate's decision and order is 3 taken to be a decision and order of the commission. 4 `(7) On hearing the application, the commission or magistrate-- 5 (a) must order the agent to repay to the claimant the amount the 6 commission or magistrate finds to be the fee the agent has 7 received from the claimant in contravention of section 408D(1) 8 or (2) if-- 9 (i) the fee has not been repaid to the claimant; and 10 (ii) the agent is not liable to repay the fee to the claimant under 11 an existing order under section 408E or 408G; and 12 (b) may make an order for the repayment despite an express or 13 implied provision of an agreement to the contrary; and 14 (c) may order the repayment to be made on the terms the 15 commission or magistrate considers appropriate; and 16 (d) may order 1 party to pay costs to another party in an amount 17 assessed by the commission or magistrate. 18 `(8) A person can not make an application under this section if an 19 application has been made under section 408G about the same matter. 20 `408G Magistrate may order repayment of fees received by private 21 employment agent in civil proceedings 22 `(1) An application may be made to a magistrate for an order for the 23 repayment of a fee received by a private employment agent in 24 contravention of section 408D(1) or (2) from a person ("claimant") for 25 finding or attempting to find the claimant work. 26 `(2) The application may be made by-- 27 (a) the claimant; or 28 (b) an employee organisation of which the claimant is a member, 29 acting for the claimant; or 30 (c) a person authorised by the claimant to make the application, 31 acting for the claimant; or 32
