The Parliament of Queensland enacts-- 1

This Act may be cited as the Police and Other Legislation 4
Amendment Act 2007. 5
Clause 2 Commencement 6
(1) Section 14 commences on 30 June 2007. 7
(2) Part 4 commences on 18 June 2007. 8

This part amends the Child Protection (Offender Reporting) 12
Act 2004. 13
Clause 4 Amendment of s 14 (When initial report must be made) 14
Section 14(1), from `period' to `table--'-- 15

This part amends the Police Powers and Responsibilities Act 19
2000. 20
Clause 9 Amendment of s 42 (Power for age-related offences and 21
for particular motor vehicle related purposes) 22
(1) Section 42(1)(c)-- 23
insert-- 24
`(v) deciding whether a person is driving a motor 25
vehicle in contravention of a provision of a 26
regulation made under the Road Use Management 27
Act that restricts the number of passengers below a 28

stated age who may be in a motor vehicle while the 1
person is driving it (a regulation restriction).'. 2
(2) Section 42-- 3

`(5) A passenger in a motor vehicle does not commit an offence 5
against section 791 if the passenger was required to state his 6
or her correct date of birth for a reason mentioned in 7
subsection (1)(c)(v) and the driver of the motor vehicle at the 8
time of the alleged offence is not proved to have contravened a 9
regulation restriction.'. 10

`(1) This section applies in relation to proceedings for an offence 26
prescribed under a regulation under this part that may be 27
committed by a driver driving a vehicle carrying passengers in 28
contravention of a requirement that a passenger be over a 29

particular age or have a particular family relationship to the 1
driver. 2
`(2) In relation to proof of whether the particular family 3
relationship existed between a passenger and the driver, a 4
regulation may prescribe-- 5
(a) that a belief of a police officer, on reasonable grounds, 6
that the relationship did not exist is sufficient evidence 7
of that fact; and 8
(b) that the driver has the onus of proving the relationship 9
did exist. 10
`(3) For subsection (2)(a), the regulation may provide the belief 11
mentioned in that paragraph may be formed by the police 12
officer after reasonable enquiries made of the driver and 13
passengers when the police officer finds the driver driving the 14
passengers or soon after.'. 15
