An Act to amend the Petroleum Act 1923

Petroleum Amendment
The Parliament of Queensland enacts-- 1

Clause 1. This Act may be cited as the Petroleum Amendment Act 1996. 3

Clause 2. This Act amends the Petroleum Act 1923. 5
of new s 150 (Declaration about certain permits, leases and 6

`Declaration
`150.(1) This section applies to an authority to prospect, lease, or licence, 11
(a "petroleum interest") granted before or after the commencement of this 12
section for hydrocarbons naturally occurring in association with coal ("coal 13
seam gas"). 14
`(2) To remove any doubt, this Act applies, and is taken always to have 15
applied, to the petroleum interest as if coal seam gas were petroleum. 16
`(3) Without limiting subsection (2) and to further remove any doubt-- 17
(a) the power of the Governor in Council under this Act to grant an 18
authority to prospect includes, and is taken always to have 19
included, power to grant an authority to prospect for coal seam 20
gas; and 21
(b) the power of the Governor in Council under this Act to grant a 22
lease includes, and is taken always to have included, power to 23
grant a lease for coal seam gas to the holder of an authority to 24
prospect; and 25

Petroleum Amendment
(c) the power of the Governor in Council under this Act to grant a 1
licence includes, and is taken always to have included, power to 2
grant a licence for coal seam gas. 3
`(4) A person is not, and never has been, authorised to extract and 4
produce, or mine, coal seam gas merely because an Act authorises the 5
person to mine coal. 6
`(5) This section has effect despite the provisions of any other Act 7
enacted before the commencement, including, for example-- 8
· the Mineral Resources Act 1989 9
· the Thiess Peabody Mitsui Coal Pty. Ltd. Agreement Act 1962. 10
`(6) Compensation is not payable by the State merely because of-- 11
(a) the enactment or operation of this section; or 12
(b) anything done to give effect to this section.'. 13
