Clause 1. This Act may be cited as the Natural Resources Legislation 4
Amendment Act 1998. 5

Commencement
Clause 2. This Act commences on a day to be fixed by proclamation. 7
PART 2--AMENDMENT OF ABORIGINAL LAND 8

Clause 3. This part amends the Aboriginal Land Act 1991. 11
of s 3 (Definitions) 12

Clause 4. Section 3-- 13
insert-- 14
` "Aboriginal land claim association" means an entity formed through 15
the incorporation, under a regulation, of-- 16
(a) the members of a group of Aboriginal people who intend to make 17
a land claim under this Act on their own behalf and on behalf of 18
other Aboriginal people in the group; or 19
(b) a group of Aboriginal people who intend to make a land claim 20
under this Act. 21

"land trust" means an entity formed through the incorporation, under a 1
regulation, of the grantees of Aboriginal land.'. 2

Clause 5. After section 137-- 4

`Application
`137A.(1) A land trust is not a statutory body for the Financial 7
Administration and Audit Act 1977. 8
`(2) However, a land trust must, at all reasonable times-- 9
(a) allow a suitably qualified person appointed by the land claims 10
registrar to audit the accounts of the land trust; and 11
(b) give the person appointed to audit the accounts of the land trust 12
the help the person reasonably requires for conducting the audit, 13
including disclosing financial institution account details. 14

`137B. The chief executive may approve forms for use under this Act.'. 16

`(f) the establishment and maintenance by the land claims registrar of 20
a land trust register, including, for example, the information each 21
land trust must give the land claims registrar for inclusion in the 22
register; and 23
(g) rules for land trusts and Aboriginal land claim associations, 24
including, for example, the adoption of rules and the matters that 25
must be included in the rules; and 26
(h) accounting requirements for land trusts, including, for example, 27

maintaining accounts, preparing financial statements, auditing 1
accounts and giving audit reports to the land claims registrar.'. 2

Clause 7. This part amends the Land Act 1994. 5

Amendment
Clause 8. Section 103(1), from `only to'-- 7
omit, insert-- 8
`only to-- 9
(a) an adjoining owner; or 10
(b) another person, if the road licence is only for allowing the person 11
holding the licence to make structural improvements mentioned 12
in section 104(b)(ii) or (iii).'. 13

`(b) no more structural improvements are permitted on the road 17
temporarily closed, other than the following-- 18
(i) boundary fences; 19
(ii) pipes for irrigation purposes that cross the road beneath its 20
surface; 21
(iii) water channels for irrigation purposes that cross the road;'. 22

`Special
`503J.(1) A special perpetual mining purposes lease issued under the 7
agreement Act on or after 1 January 1995 and in existence immediately 8
before the commencement of this section, becomes, on the commencement 9
of this section, a perpetual lease under this Act. 10
`(2) A special perpetual mining purposes lease issued under the 11
agreement Act on or after the commencement of this section becomes a 12
perpetual lease under this Act immediately after it is issued. 13
`(3) Subsections (1) and (2) have effect despite anything in the agreement 14
Act. 15
`(4) In this section-- 16
"agreement Act" means the Commonwealth Aluminium Corporation Pty. 17
Limited Agreement Act 1957. 18

`Replacement
`503K.(1) This section applies if a special perpetual mining purposes 20
lease (the "old lease") becomes a perpetual lease (the "new lease") under 21
section 503J. 22
`(2) If the old lease becomes the new lease under section 503J(1), the 23
chief executive must, as soon as practicable, issue a lease document for the 24
new lease to replace the lease document for the old lease. 25
`(3) If the old lease becomes the new lease under section 503J(2), the 26
chief executive must, as soon as practicable after the old lease is issued, 27
issue a lease document for the new lease to replace the lease document for 28
the old lease. 29
`(4) The new lease is subject to all the encumbrances to which the old 30

lease was subject and in the same priorities. 1
`(5) When the lease document for the new lease is issued, the lease 2
document for the old lease is no longer valid. 3
`(6) The lease document for the new lease must be given to the person 4
who is entitled to possession of the lease document for the old lease. 5
`(7) The lease document for the old lease must be returned to the chief 6
executive for cancellation when the lease document for the new lease is 7
issued. 8
`(8) The lessee under the new lease may ask for the return of the lease 9
document for the old lease suitably marked as cancelled.'. 10

(a) the members of a group of Torres Strait Islanders who intend to 20
make a land claim under this Act on their own behalf and on 21
behalf of other Torres Strait Islanders in the group; or 22
(b) a group of Torres Strait Islanders who intend to make a land 23
claim under this Act. 24
