`4A.(1) A regulation may-- 14
(a) abolish 2 or more river improvement areas (the "previous 15
areas") and constitute a new river improvement area comprising 16
the areas abolished; and 17
(b) assign a name to the new area; and 18
(c) abolish the trusts for the previous areas and constitute a new trust 19
for the new area; and 20
(d) provide for the vesting of assets in, and the assumption of 21
liabilities by, the new trust; and 22

(e) provide for any other matter necessary or convenient to give 1
effect to the abolition of the previous areas and their trusts, and 2
the constitution of the new area and its trust. 3

`6A.(1) The chief executive may appoint persons as authorised officers. 2
`(2) The chief executive may appoint a person as an authorised officer 3
only if-- 4
(a) in the chief executive's opinion, the person has the necessary 5
expertise or experience to be an authorised officer; or 6
(b) the person has satisfactorily finished training approved by the 7
chief executive. 8

`Limitation
`6B. The powers of an authorised officer may be limited-- 10
(a) under a regulation; or 11
(b) under a condition of appointment; or 12
(c) by written notice of the chief executive given to the authorised 13

`6C.(1) The chief executive must give each authorised officer an identity 16
card. 17
`(2) The identity card must-- 18
(a) contain a recent photograph of the authorised officer; and 19
(b) be signed by the authorised officer; and 20
(c) identify the person as an authorised officer under this Act. 21
`(3) A person who ceases to be an authorised officer must return the 22
person's identity card to the chief executive as soon as practicable (but 23
within 21 days) after the person ceases to be an authorised officer, unless 24
the person has a reasonable excuse for not returning it. 25

`(4) This section does not prevent the giving of a single identity card to a 27
person under this Act and for other Acts or purposes. 28

`Production
`6D.(1) An authorised officer may exercise a power under this Act in 2
relation to someone else only if the authorised officer-- 3
(a) first produces his or her identity card for the person's inspection; 4
or 5
(b) has the identity card displayed so it is clearly visible to the person. 6
`(2) However, if it is not practicable to comply with subsection (1), the 7
authorised officer must produce the identity card for the person's inspection 8
at the first reasonable opportunity.'. 9

`Definitions
`25A. In this part-- 16
"plan area", for a draft water management plan or a water management 17
plan, means the part of Queensland to which the plan applies. 18
"proposed plan area" means the part of Queensland to which a draft 19
water management plan, when prepared, is proposed to apply. 20

`25B.(1) The Minister may make water management plans for parts of 23
Queensland. 24
`(2) The Minister may make a water management plan only by making a 25

draft water management plan, prepared under this division, as the water 1
management plan. 2
`(3) A water management plan is subordinate legislation. 3

`Content
`25C.(1) A water management plan must-- 5
(a) describe the plan area for the plan; and 6
(b) state whether the plan applies to underground water or water other 7
than underground water, or both; and 8
(c) include the principles and policies under which the right vested in 9
the Crown under section 3 is to be exercised for the plan area. 10
`(2) A water management plan may-- 11
(a) include a map or series of maps showing water resource 12
information; and 13
(b) make provision for anything about which a regulation may be 14
made under this Act. 15

`25D.(1) The Minister must give public notice when the Minister 17
proposes to prepare a draft water management plan. 18
`(2) The notice must-- 19
(a) be published in-- 20
(i) a newspaper circulating generally throughout the proposed 21
plan area; and 22
(ii) other newspapers the Minister considers appropriate; and 23
(b) invite submissions (written or oral) from the public; and1 24
(c) state a day (not earlier than 30 business days from the publication 25
of the notice) by which submissions may be made, and the 26

person to whom, and the place where, the submissions may be 1
made. 2
`(3) The notice may state whether it is intended that the draft plan apply 3
only to underground water or water other than underground water, or both. 4
`(4) The Minister must send a copy of the notice to each local 5
government whose local government area includes the whole or part of the 6
proposed plan area. 7
`(5) The Minister may send a copy of the notice to any person or group 8
the Minister considers appropriate. 9

`Principles
`25E. In preparing the principles and policies to be included in a draft 11
water management plan, the Minister must have regard to the following for 12
the plan area-- 13
(a) the total water rights vested in the Crown;2 14
(b) existing entitlements to water under the Act, including, for 15
example, entitlements of riparian owners, licensees and 16
permittees and entitlements under agreements; 17
(c) the provision of water for ecosystems; 18
(d) the extent of beneficial flooding currently enjoyed by landowners; 19
(e) future water needs; 20
(f) water flows; 21
(g) underground water levels. 22

`25F.(1) The Minister must give public notice when a draft water 24
management plan has been prepared. 25
`(2) The notice must-- 26

(a) be published in-- 1

(b) state where copies of the draft plan may be inspected and, on 5
payment of a fee, purchased; and 6
(c) invite submissions (written or oral) from the public; and 7
(d) state a day (not earlier than 30 business days from the publication 8
of the notice) by which submissions may be made, and the 9
person to whom, and the place where, the submissions may be 10
made. 11
`(3) The Minister must send a copy of the notice and draft plan to each 12
local government whose local government area includes the whole or part 13
of the plan area. 14
`(4) A local government receiving a copy of the draft plan must make the 15
copy available for inspection by the public. 16
`(5) The Minister may send a copy of the notice to any person or group 17
the Minister considers appropriate. 18

`Submissions
`25G. Before making the draft plan as a water management plan, the 20
Minister must consider all submissions made, by the day mentioned in 21
section 25F(2)(d), about the draft plan. 22

`Draft
`25H.(1) The Minister must not make a draft water management plan as 24
a water management plan if the draft plan is different from the draft plan 25
public notice of which was given under section 25F. 26
`(2) If a draft plan, proposed to be made as a water management plan, is 27
different from the draft plan public notice of which was given under 28
section 25F, section 25F applies again to the draft plan proposed to be made 29
as a water management plan. 30

`Approval
`25I. A water management plan does not have effect until it is approved 2
by the Governor in Council. 3

`25J.(1) This section applies if the Minister has given public notice 6
that-- 7
(a) the Minister proposed to prepare a draft water management plan 8
but has not prepared a draft water management plan; or 9
(b) a draft water management plan has been prepared. 10
`(2) If the Minister decides not to proceed further under this division 11
towards the making of a water management plan, the Minister must give 12
public notice of the decision. 13
`(3) The notice must be published in-- 14
(a) a newspaper circulating generally throughout-- 15
(i) if subsection (1)(a) applies--the proposed plan area; or 16
(ii) if subsection (1)(b) applies--the plan area; and 17
(b) other newspapers the Minister considers appropriate. 18
`(4) The Minister must send a copy of the notice to each local 19
government, person or group to whom the Minister sent a notice-- 20
(a) about the proposed preparation of the plan; and 21
(b) if the draft plan was prepared--when the draft plan was prepared. 22

`Amendment
`25K.(1) A water management plan (the "first plan") may be amended 24
by another plan (the "amending plan") only if the procedures applying to 25
the preparation of a draft water management plan, and the making and 26
approval of a water management plan, under this part are followed for the 27
amending plan. 28
`(2) Without limiting subsection (1), the amending plan may-- 29

(a) change the boundaries of the plan area for the first plan; or 1
(b) amalgamate the first plan with another plan; or 2
(c) change the principles or policies of the first plan. 3
`(3) Despite subsection (1), a regulation may amend a water 4
management plan (and the procedures mentioned in subsection (1) do not 5
apply) if the amendment is only-- 6
(a) to correct a minor error in the plan, or make another change that is 7
not a change of substance; or 8
(b) if the plan states that an amendment of a stated type may be made 9
to the plan by amendment under this subsection--to make an 10
amendment of the stated type. 11

`Public
`25L.(1) The chief executive must keep each draft water management 13
plan prepared, and each water management plan made, under this part, 14
available for inspection by the public during office hours on business days 15
at the head office, and at the appropriate regional office, of the department. 16
`(2) The chief executive may also keep a plan mentioned in 17
subsection (1) available for inspection by the public at other places the chief 18
executive considers appropriate. 19
`(3) On payment of a fee, a person may buy a copy of a plan. 20
`(4) The fee for a copy of the plan must not be more than the reasonable 21
cost of publishing the copy. 22

`25M. A regulatory impact statement under the Statutory Instruments 24
Act 1992 need not be prepared for a water management plan made under 25
this part. 26

`Division 3--Effect of notice of proposal to prepare plan 1
of notice under s 25D on applications, agreements, sales, etc. 2
`Effect
`25N.(1) If the Minister gives public notice that the Minister proposes to 3
prepare a draft water management plan-- 4
(a) the corporation must not negotiate about, or enter into, an 5
agreement for the supply of water under section 153 for the area; 6
and 7
(b) the chief executive must not deal with an application made under 8
section 39, 42 or 454 about works in the area; and 9
(c) the chief executive must not deal with an application made under 10
section 565 about a watercourse, lake, spring or underground 11
water in the area; and 12
(d) the chief executive must not take action under part 56 about the 13
sale of an entitlement to be issued a licence for a nominal 14
allocation of water provided by works in the area; and 15
(e) the chief executive must not grant or amend, under part 9, 16
division 3,7 a nominal allocation for specified land in the area; and 17
(f) no action may be taken under part 10, division 1,8 for 18
constituting, in relation to works in the area, a water supply area. 19
`(2) Subsection (1) applies on and from the day the notice is published 20
(the "publication day") until-- 21
(a) a water management plan for the area is notified under the 22

(b) the Minister publishes a notice under section 25J.9 2
`(3) To remove any doubt, it is declared that subsection (1) applies-- 3
(a) for negotiations about an agreement--even if the negotiations 4
started before the publication day; and 5
(b) for an application--even if the application was made before the 6
publication day. 7
`(4) In subsections (1) and (2)-- 8
"area" means-- 9
(a) until a notice under section 25F 10 has been published--the 10
proposed plan area; and 11
(b) once a notice under section 25F has been published--the plan 12
area for the most recent draft water management plan. 13

`Exceptions
`25O.(1) Section 25N does not apply to the following-- 15
(a) an application for a licence to construct works or a bore to take 16
water-- 17
(i) only for domestic purposes or for watering stock; or 18
(ii) for the watering of crops for feeding stock, if the 19
application-- 20
(A) relates to a crop area of no greater than 10 ha; and 21
(B) was made before a notice published under 22
section 25D11 was first published in a newspaper; or 23
(iii) if the application does not seek an increase in the benefit to 24

which the licensee is entitled under an existing licence; 1
(b) an application for a driller's licence; 2
(c) an application to construct a levee bank; 3
(d) an application for a licence in relation to underground water, if the 4
notice published under section 25D states that it is not intended 5
that the plan apply to underground water; 6
(e) an application for a licence in relation to water other than 7
underground water, if the notice published under section 25D 8
states that it is not intended that the plan apply to water other than 9
underground water; 10
(f) if a supply of water is required by a local government in an 11
emergency situation-- 12
(i) negotiations for, or the granting of, a permit under 13
section 56; or 14
(ii) negotiations for, or the making of, an agreement under 15
section 15; 16
(g) a water matter, if-- 17
(i) the matter is in relation to authorised works; and 18
(ii) the matter relates to an amount of water it was proposed 19
would be available after the construction of the works; and 20
(iii) the whole of the amount of water has not been allocated, 21
sold, granted or otherwise disposed of. 22
`(2) In subsection (1)(a)(i)-- 23
"stock" means stock-- 24
(a) of a number not more than the number depastured ordinarily on 25
the land to which the application relates, having regard to seasonal 26
fluctuations in the carrying capacity of the land; and 27
(b) not held in close concentration for a purpose other than grazing. 28
`(3) In subsection (1)(g)-- 29
"authorised works" means works the corporation may construct under 30

section 8 or 114.12 1
"water matter" means-- 2
(a) a negotiation about, or entering into, an agreement for the supply 3
of water under section 15; or 4
(b) an application made under section 39, 42, 45 or 56; or 5
(c) an action taken under part 5; or 6
(d) the grant or amendment of a nominal allocation under part 9, 7
division 3; or 8
(e) an action taken under part 10, division 1. 9

must not be inconsistent with water management plan 11
`Actions
`25P.(1) An action taken, or decision made, under this Act in relation to 12
the plan area for a water management plan must not be inconsistent with the 13
plan. 14
`(2) For subsection (1), an action is taken, or a decision is made, in 15
relation to the plan area if the action is taken or the decision is made for-- 16
(a) negotiating about, or entering into, an agreement for the supply of 17
water under section 1513 for the plan area; or 18
(b) dealing with an application made under section 39, 42 or 4514 19
about works in the plan area; or 20
(c) dealing with an application made under section 5615 about a 21
watercourse, lake, spring or underground water in the plan area; 22

(f) constituting, under part 10, division 1,18 in relation to works in 7
the plan area, a water supply area.'. 8
