This Act may be cited as the Major Sports Facilities 4
Amendment Act 2006. 5

This part amends the Major Sports Facilities Act 2001. 9

`In this part-- 15
authorised ticket agent, for a major sports facility event, 16
means an entity authorised by the event's organiser to sell 17
tickets to the event to the public. 18
non-profit organisation means an organisation that is not 19
carried on for the profit or gain of its individual members. 20

Examples of entities that may be non-profit organisations--
22
a charity, church, club or environmental protection society

original ticket price, of a ticket to a major sports facility 1
event, means-- 2
(a) if the ticket was originally obtained from the event's 3
organiser--the price at which the organiser sells, to the 4
public, tickets of the same type for the event; or 5
(b) if the ticket was originally obtained from an authorised 6
ticket agent for the event--the price at which the agent 7
sells, to the public, tickets of the same type for the event, 8
including any fee, whatever called, charged by the agent 9
for the sale and included in the purchase price. 10
resell, a ticket to a major sports facility event, means to sell 11
the ticket-- 12
(a) at any time after it has been obtained from the event's 13
organiser or an authorised ticket agent for the event; and 14
(b) before the event takes place. 15
sell includes offer for sale. 16
ticket, to a major sports facility event, means a docket, token 17
or another item that entitles the person holding the docket, 18
token or item to attend the event on the day and at the time 19
indicated on the docket, token or item. 20
`30C Restriction on resale or purchase of tickets 21
`(1) A person must not, within or outside Queensland, resell a 22
ticket to a major sports facility event at a price greater than 23
10% above the original ticket price of the ticket. 24
Maximum penalty--20 penalty units. 25
`(2) A person must not, within or outside Queensland, purchase a 26
ticket to a major sports facility event from a person, other than 27
the event's organiser or an authorised ticket agent for the 28
event, at a price greater than 10% above the original ticket 29
price of the ticket. 30
Maximum penalty--5 penalty units. 31
`(3) Subsection (1) or (2) does not apply to the resale or purchase 32
of a ticket, to a major sports facility event, by or from a 33
non-profit organisation, or someone acting for the 34
organisation, for fundraising. 35

`(4) This section does not authorise the resale of a ticket to a major 1
sports facility event. 2

`30D Definitions for pt 4B 4
`In this part-- 5
advertisement includes the following-- 6
(a) skywriting or sign-writing by an aircraft; 7
(b) a banner or other sign attached to-- 8
(i) an aircraft, or a hang-glider, parachute, paraglider 9
or similar device; or 10
(ii) a person suspended from an aircraft, or a 11
hang-glider, parachute, paraglider or similar 12
device; 13
(c) matter on an aircraft, or a hang-glider, parachute, 14
paraglider or similar device, other than matter not 15
intended for advertising; 16
(d) matter on a building or other structure, or a banner or 17
other sign attached to a building or other structure, other 18
than matter not intended for advertising; 19
(e) matter on a flag, other than a state or national flag, that 20
has an area of more than 5m2, other than matter not 21
intended for advertising; 22
(f) any laser or digital projection of advertising. 23
aircraft includes airship, blimp, helicopter and hot-air 24
balloon. 25
declared event means a major sports facility event declared to 26
be a declared event for this part under section 30E. 27
declared period, for a major sports facility, means a period 28
declared under section 30E as a period for which this part 29
applies to the facility in relation to the staging, at the facility, 30
of a declared event. 31
display includes cause to be displayed. 32

`30E Declaration of events and periods for this part 1
`(1) The Governor in Council may, by gazette notice, declare-- 2
(a) a major sports facility event as a declared event for this 3
part; and 4
(b) the period for which this part applies, in relation to the 5
declared event, to the major sports facility at which the 6
declared event is to be staged. 7
`(2) The declaration must be made at least 28 days before the start 8
of the period mentioned in subsection (1)(b). 9
`30F Restriction on advertising 10
`(1) A person must not display an advertisement in airspace, or on 11
a building or other structure, that is within sight of a major 12
sports facility during a declared period for the facility, unless 13
the display is authorised under section 30G. 14
Maximum penalty--700 penalty units. 15
`(2) Subsection (1) does not apply to the following-- 16
(a) an advertisement that is a logo, symbol or similar matter 17
displayed on a building or other structure on more than a 18
temporary basis; 19
(b) an advertisement displayed on an aircraft within sight of 20
the major sports facility if the aircraft is in transit as part 21
of a scheduled commercial flight. 22
`30G Authorised advertising 23
`(1) The Authority may, on written application by a person, 24
authorise the display of an advertisement in airspace, or on a 25
building or other structure, within sight of a major sports 26
facility during a declared period for the facility. 27
`(2) However, the Authority may authorise the display only if the 28
Authority is satisfied the display is appropriate for the 29
declared event to which the declared period relates, having 30
regard to the following-- 31
(a) any effect of the advertisement on the organisation or 32
staging of the event; 33

(b) whether or not there are any commercial arrangements 1
about the advertisement with the Authority or the 2
event's organiser; 3
(c) whether or not the advertisement is consistent with other 4
advertisements approved for the event and the 5
arrangements mentioned in paragraph (b); 6
(d) any effect of the advertisement on how the facility is 7
perceived by persons intending or likely to stage events 8
at the facility in the future. 9
`(3) The Authority may impose conditions on the display of the 10
advertisement under the authorisation, including, for example, 11
conditions about the following-- 12
(a) the period for which the display is authorised under the 13
approval; 14
(b) the circumstances in which the display is authorised 15
under the approval; 16
(c) the persons who are authorised to display the 17
advertisement under the approval; 18
(d) the types of advertisements that are authorised to be 19
displayed under the approval.'. 20
