An Act to amend the Major Sports Facilities Act 2001

The Parliament of Queensland enacts-- 1
1 Short title

This Act may be cited as the Major Sports Facilities Amendment 3
Act 2003. 4

This Act amends the Major Sports Facilities Act 2001. 6

`PART 3A--DECLARATORY PROVISIONS FOR 10

`30A Declaratory provision for Major Sports Facilities Authority if 12
pt 5 has not expired 13
`(1) This section applies if, on the commencement of this section, part 5 14
has not expired. 15
`(2) It is declared that the Authority has, and from 3 December 2001 has 16
always had, power to enter into a contract to acquire, and to acquire, from 17
the Stadium Redevelopment Authority, on commercial terms, and without 18
the prior approval of the Governor in Council under section 8(3) to the 19
exercise of the power, any land and improvements making up the facility 20
called `Suncorp Stadium' (formerly called `Suncorp Metway Stadium'), or 21
any part of the facility. 22
`(3) Subsection (2) applies despite any other provision of this Act, but 23
does not limit the power the Authority has under part 3, division 1 to deal 24
with property. 25

until the expiry of part 5, power to enter into a contract to acquire, and to 6
acquire, from the former Stadium Redevelopment Authority, on 7
commercial terms, and without the prior approval of the Governor in 8
Council under section 8(3) to the exercise of the power, any land and 9
improvements making up the facility called `Suncorp Stadium' (formerly 10
called `Suncorp Metway Stadium'), or any part of the facility. 11
`(3) Subsection (2) applies despite any other provision of this Act, but 12
does not limit the power the Authority has under part 3, division 1 to deal 13
with property. 14

`(1) This section applies if, on the commencement of this section, part 5 17

`(2) It is declared that the Stadium Redevelopment Authority has, and 19
from 3 December 2001 has always had, power to enter into a contract to 20
dispose of, and to dispose of, to the Authority, on commercial terms, and 21
without the prior approval of the Governor in Council under section 39(1) 22
to the sale of an estate in fee simple in land owned by the Stadium 23
Redevelopment Authority, any land and improvements making up the 24
facility called `Suncorp Stadium' (formerly called `Suncorp Metway 25
Stadium'), or any part of the facility. 26
`(3) Subsection (2) applies despite any other provision of this Act, but 27
does not limit the power the Stadium Redevelopment Authority has under 28
part 5, division 1 to deal with property. 29
`(4) Also, it is declared that the Stadium Redevelopment Authority's 30
power under subsection (2) to dispose of any part of the facility includes, 31
and from 3 December 2001 has always included, power to dispose of the 32
part despite the part having been acquired under an agreement under the 33
State Development and Public Works Organisation Act 1971, section 134. 34

`(1) This section applies if, on the commencement of this section, part 5 3
has expired. 4
`(2) It is declared that the former Stadium Redevelopment Authority 5
always had, from 3 December 2001 until the expiry of part 5, power to 6
enter into a contract to dispose of, and to dispose of, to the Authority, on 7
commercial terms, and without the prior approval of the Governor in 8
Council under section 39(1) to the sale of an estate in fee simple in land 9
owned by the former Stadium Redevelopment Authority, any land and 10
improvements making up the facility called `Suncorp Stadium' (formerly 11
called `Suncorp Metway Stadium'), or any part of the facility. 12
`(3) Subsection (2) applies despite any other provision of this Act, but 13
does not limit the power the former Stadium Redevelopment Authority had 14
under part 5, division 1 to deal with property. 15
`(4) Also, it is declared that the former Stadium Redevelopment 16
Authority's power under subsection (2) to dispose of any part of the facility 17
always included, from 3 December 2001 until the expiry of part 5, power to 18
dispose of the part despite the part having been acquired under an 19
agreement under the State Development and Public Works Organisation 20
Act 1971, section 134.'. 21
