1 Short title

This Act may be cited as the Mineral Resources and Other Legislation 4
Amendment Act 2002. 5

`318A Significant projects excluded from pt 7A 3
`(1) This part does not apply for a mining lease that is, or is included in, 4
a project declared under the State Development and Public Works 5
Organisation Act 1971, section 26, to be a significant project. 6
`(2) Subsection (1) does not limit or otherwise affect 7
Coordinator-General's conditions included in the mining lease, under the 8
State Development and Public Works organisation Act 1971, part 4, 9
division 5.1 10
`318B What is the "road authority" for a road 11
`The "road authority", for a road, is-- 12
(a) for a State-controlled road--the chief executive of the 13
department in which the Transport Infrastructure Act 1994 is 14
administered; or 15
(b) for another road--the local government having the control of the 16
road. 17
`318C What is a "notifiable road use" 18
`(1) A "notifiable road use", for a mining tenement, is the use of a road 19
to haul loads at more than the following rate if the haulage relates to the 20
transport of minerals produced on or from land subject to the tenement-- 21
(a) for a State-controlled road--50 000 t a year; 22
(b) for another road--10 000 t a year. 23
`(2) For subsection (1), a mineral is produced only if it is-- 24

(a) mined, or released by mining, on the land; or 1

Coal seam methane.2
(b) processed on the land, including, for example, by a process in a 4
refinery or smelter on the land under which a mineral is changed 5
to another substance. 6
`(3) Subsection (1) applies even if the road is not on land subject to the 7
mining tenement.3 8
`Division 2--Notifiable road uses 9
`318D Notice of notifiable road use 10
`(1) It is a condition of each mining tenement that its holder must not use 11
a road for a notifiable road use unless the holder has given the road 12
authority for the road written notice that the holder proposes to carry out 13
the use.4 14
`(2) The notice must-- 15
(a) be given-- 16
(i) at least 10 business days before the use starts; or 17
(ii) within a shorter period agreed to by the authority in writing; 18
and 19
(b) state each of the following-- 20
(i) the road proposed to be used; 21
(ii) the type of haulage under the use; 22

· Mineral hauled

· Frequency of vehicle movements.
(iii) the yearly or other rate at which the haulage is proposed to 3
be carried out; 4
(iv) when the use is proposed to start and end; 5
(v) contact details for the holder or someone else the holder has 6
authorised to discuss the matters stated in the notice. 7
`318E Directions about notifiable road use 8
`(1) The road authority for a road may, by written notice, give a mining 9
tenement holder a direction (a "road use direction") about the way the 10
holder may use the road for notifiable road uses, being carried out, or 11
proposed to be carried out, by the holder. 12
`(2) A road use direction must-- 13
(a) be reasonable; and 14
(b) only be about-- 15
(i) preserving the condition of the road; or 16
(ii) the safety of road-users or the public; and 17
(c) be accompanied by, or include, a statement-- 18
(i) of reasons for giving the direction; and 19
(ii) that, under section 406,5 the holder may apply to the tribunal 20
to review the direction; and 21
(iii) about how to apply for the review. 22

Examples of what a road use direction may be about--
24
1. When the road may be used.
25
2. The route for the movement of heavy vehicles.
26
3. Safety precautions the holder must take.
`(3) The direction may also require the holder to-- 27
(a) carry out an assessment of the impacts likely to arise from the 28
notifiable road use the subject of the notice; and 29

(b) consult with the road authority in carrying out the assessment. 1
`(4) However, the authority can not require an assessment of an impact to 2
the extent it has already been assessed under an EIS under the 3
Environmental Protection Act, or a similar document under another Act. 4
`318F Obligation to comply with road use directions 5
`It is a condition of each mining tenement that its holder must comply 6
with any road use direction given to the holder relating to the tenement, 7
unless the holder has a reasonable excuse. 8
`Division 3--Compensation for notifiable road uses 9
`318G Liability to compensate road authority 10
`(1) The holder of each mining tenement is liable to compensate the road 11
authority for a road for any cost, damage or loss it incurs, or will incur, that 12
is or will be caused by notifiable road uses carried out by the holder that 13
relate to the road. 14

Examples of a possible `cost' for subsection (1)--
16
1. Repair costs to rectify damage to the road caused, or that will be caused, by any of
17
the uses.
18
2. Capital costs for unplanned upgrades of the road incurred, or that will be incurred,
19
because of any of the uses.
20
3. Bring-forward costs, including interest charges, for a planned upgrade of the road
21
that, because of any of the uses, is or will be required earlier than planned.
`(2) The holder's liability under subsection (1) is called the holder's 22
"compensation liability" to the authority. 23
`(3) The compensation liability-- 24
(a) applies whether or not the holder has, under section 318D, given 25
notice of the use; and 26
(b) is subject to section 318M;6 and 27

(c) is in addition to, and does not limit or otherwise affect, the 1
holder's liability under another provision of this Act about 2
compensating the authority or anyone else. 3
`318H Compensation agreement 4
`(1) A mining tenement holder and the road authority for a road may 5
enter into an agreement (a "compensation agreement") about the holder's 6
compensation liability to the authority relating to the road. 7
`(2) A compensation agreement may relate to the whole or part of the 8
liability. 9
`(3) A compensation agreement must-- 10
(a) be signed by or for the holder and the authority; and 11
(b) state whether it is for the whole or part of the liability; and 12
(c) if it is for only part of the liability, state-- 13
(i) each part of the notifiable road use to which the agreement 14
relates; and 15
(ii) the period for which the agreement has effect; and 16
(d) provide for how and when the liability will be met. 17
`(4) A compensation agreement may-- 18
(a) extend the holder's compensation liability to the authority 19
relating to the road to any renewal of the mining tenement; and 20
(b) provide for-- 21
(i) monetary or non-monetary compensation; or 22
(ii) a process by which it may be amended or enforced. 23

Example for paragraph (b)--

A compensation agreement may provide for compensation under it to be
26
reviewed on the happening of a material change in circumstances for the
27
mining tenement, including a significant decrease or increase in the extent
28
of the relevant notifiable road use.
`(5) Subsections (2) to (4) do not limit the matters that may be provided 29
for in a compensation agreement. 30

`318I Deciding compensation through tribunal 1
`(1) The road authority for a road or a mining tenement holder may 2
apply to the tribunal for it to decide the holder's compensation liability to 3
the authority relating to the road. 4
`(2) The tribunal may decide the compensation liability only to the 5
extent it is not subject to a compensation agreement. 6
`(3) In making the decision, the tribunal may have regard to whether the 7
applicant has attempted to mediate or negotiate the compensation liability. 8
`318J Criteria for decision 9
`(1) The criteria the tribunal must consider, in deciding a compensation 10
application, include-- 11
(a) the reasonableness of the cost, damage or loss claimed; and 12
(b) if the road authority is a local government--the extent to which 13
the cost, damage or loss claimed has been, will be or ought 14
reasonably to be or to have been, met from-- 15
(i) amounts the mining tenement holder has paid, or agreed to 16
pay, the authority for notifiable road uses; or 17
(ii) rates and charges under the Local Government Act 1993 18
paid or payable from the mining tenement holder to the 19
authority; and 20
(c) any other relevant matter. 21
`(2) In considering the reasonableness of any cost, damage or loss 22
claimed, the tribunal must have regard to-- 23
(a) any action taken, or proposal by, the mining tenement holder to, 24
or to attempt to, avoid, minimise or remedy the cost, damage or 25
loss; and 26
(b) any relevant act or omission of the road authority. 27
`(3) Subsection (1)(b)(ii) applies whether or not the rates and charges 28
relate to notifiable road uses. 29
`318K Tribunal review of compensation 30
`(1) This section applies if-- 31

(a) compensation has been agreed to under a compensation 1
agreement or decided by the tribunal (the "original 2
compensation"); and 3
(b) there has, since the agreement or decision, been a material 4
change in circumstances. 5

A significant decrease or increase in the extent of the relevant notifiable
8
road use.
`(2) The relevant road authority or mining tenement holder may apply to 9
the tribunal for it to review the original compensation. 10
`(3) Sections 318I and 318J apply, with necessary changes, for the 11
review as if the application were a compensation application. 12
`(4) The tribunal may, after conducting the review, decide to confirm the 13
original compensation or amend it in a way the tribunal considers 14
appropriate. 15
`(5) However, before making the decision, the tribunal must have regard 16
to-- 17
(a) the original compensation; and 18
(b) whether the applicant has attempted to mediate or negotiate an 19
amendment of the original compensation; and 20
(c) any change in the matters mentioned in section 318J(1) since the 21
original compensation was agreed or decided. 22
`(6) If the decision is to amend the original compensation, the original 23
compensation, as amended under the decision, is for this Act, taken to be 24
the original compensation. 25
`318L Compensation to be addressed before carrying out notifiable 26
road use 27
`(1) It is a condition of each mining tenement that the holder of the 28
tenement must not carry out a notifiable road use on a road unless-- 29
(a) the holder and the relevant road authority have signed a 30
compensation agreement for the use; or 31
(b) the authority has given written consent to the carrying out of the 32
use; or 33

(c) a compensation application has been made to decide the holder's 1
compensation liability to the authority relating to the road.7 2
`(2) A consent under subsection (1)(b) may be given for any renewal of 3
the mining tenement. 4
`318M Compensation not affected by change in administration or 5
holder 6
`(1) An agreement or decision under this part about compensation 7
liability is binding on-- 8
(a) the relevant road authority and mining tenement holder; and 9
(b) each of their personal representatives, successors and assigns. 10
`(2) Subsection (1) is subject to section 318K.8'. 11
5 Amendment of s 406 (Tribunal may review lawfulness of 12
directions)

`(1) A person dissatisfied with the following may, if no other right of 19
appeal against the direction or requirement is given under this Act, apply in 20
writing to the tribunal for a review of the direction or requirement-- 21
(a) a direction or requirement given or made by a mining registrar, 22
field officer or other authorised officer; 23
(b) a road use direction.'. 24

`(1) Part 7A does not apply for a notifiable road use (the "continuing 6
use") carried out by a mining tenement holder if-- 7
(a) at any time within 12 months before the commencement of 8
section 318D,9 the holder carried out a notifiable road use 9
(the "existing use"); and 10
(b) the type of haulage under the continuing use is the same, or 11
substantially the same, as the type of haulage under the existing 12
use. 13
`(2) Subsection (1) applies even if the continuing use stops and later 14
starts again.'. 15
