Clause 1. This Act may be cited as the Land Title Amendment Act 1996. 3

Clause 2. This Act amends the Land Title Act 1994. 5

`Issuing
`42.(1) The registrar must issue a certificate containing the indefeasible 10
title for a lot (the "certificate of title") if asked in writing by the registered 11
owner. 12
`(2) However, if the lot is subject to a registered mortgage, the registrar 13
may issue the certificate of title only if the mortgagee consents to the issue 14
of the certificate. 15
`(3) Also, if an instrument has been lodged to register an interest in the 16
lot, the registrar may refuse to issue the certificate of title until the 17
instrument has been registered. 18
`(4) The registrar must give the certificate of title to the person stated in 19
the owner's request.'. 20
