"Planning Act" means the Local Government (Planning and 5
Environment) Act 1990. 6
"proposed allotment" means a single parcel of land, other than a lot within 7
the meaning of this Act, the boundaries of which are shown, or to be 8
shown, on a plan of survey that is to be registered under the Land Act 9
1994 or Land Title Act 1994. 10
"real estate agent" means a person licensed under the Auctioneers and 11
Agents Act 1971 as a real estate agent. 12
"State leasehold land" means land leased under the Land Act 1994 or a 13
miners homestead under the Land Act 1994.3 14
"subdivision application" means an application made under the Planning 15
Act, section 5.1 4 to subdivide land into proposed allotments (within 16
the meaning of this Act).'. 17

`8.(1) A person may sell a proposed allotment of freehold land only if, 3
when the purchaser enters upon the purchase of the allotment-- 4
(a) local government unconditional approval of the subdivision 5
application for the land is in force under the Planning Act; or 6
(b) the following approvals are in force under the Planning Act-- 7
(i) approval of the subdivision application for the land, subject 8
to conditions requiring the applicant to construct works on 9
the land; and 10
(ii) approval of the engineering drawings and specifications for 11
the works mentioned in subparagraph (i).5 12
Maximum penalty--200 penalty units or 1 year's imprisonment. 13
`(1A) A person may sell a proposed allotment of State leasehold land 14
only if, when the purchaser enters upon the purchase of the allotment, the 15
lessee has the Minister's approval, under the Land Act 1994 ,6 to subdivide 16
the land. 17

`9.(1) Before a purchaser enters upon a purchase of a proposed 1
allotment, the vendor must give the purchaser-- 2
(a) a disclosure plan and disclosure statement for the proposed 3
allotment; or 4
(b) a copy of the approved plan of survey for the proposed allotment 5
sealed under the Planning Act, section 5.3.7 6
Maximum penalty--100 penalty units or 6 months imprisonment. 7
`(2) The disclosure plan must include the following-- 8
(a) the details shown on the proposal plan8 accompanying the 9
subdivision application for the land; 10
(b) the metes and bounds description of the proposed allotment; 11
(c) contour maps of the proposed allotment showing the following 12
contours-- 13
(i) natural surface contours, with appropriate contour intervals; 14
(ii) final surface contours as specified in the engineering 15
drawings; 16
(d) fill levels, and areas to be filled, as specified in the engineering 17
drawings for the proposed allotment. 18
`(3) The disclosure statement must be signed by the purchaser and 19
vendor and state the following-- 20
(a) the purchaser's full name and address; 21
(b) the vendor's full name and address; 22
(c) that the vendor or vendor's agent has given the purchaser the 23
disclosure plan for the proposed allotment; 24
(d) that the purchaser has-- 25
(i) for an allotment capable of being pegged by a licensed 26
surveyor--inspected the proposed allotment after it has been 27

pegged by the surveyor; or 1
(ii) for an allotment that is not capable of being pegged by a 2
licensed surveyor--inspected the proposed allotment; or 3
(iii) been given the opportunity, and declined, to do an inspection 4
mentioned in subparagraph (i) or (ii); 5
(e) that if the vendor or vendor's agent contravenes this section, other 6
than subsection (3)(a), (b) or (f), the purchaser may avoid the 7
instrument relating to the sale by written notice given to the 8
vendor or vendor's agent before the vendor gives the purchaser 9
the registrable instrument of transfer for the allotment; 10
(f) the day the statement is signed. 11
`(5) If the vendor or the vendor's agent contravenes this section, other 12
than subsection (3)(a), (b) or (f), the purchaser may avoid the instrument 13
relating to the sale by written notice given to the vendor or vendor's agent 14
before the vendor gives the purchaser the registrable instrument of transfer 15
for the allotment. 16
`(6) In this section-- 17
"appropriate contour intervals" means contour intervals of not more 18
than the following-- 19
(a) for a proposed allotment not in a rural or rural residential 20
zone--500 mm in height; 21
(b) for a proposed allotment in a rural or rural residential zone--the 22
smallest of the following contour intervals-- 23
(i) the contour intervals shown on a local government 24
topographic map that includes the allotment; 25
(ii) the contour intervals shown on a topographic map that 26
includes the allotment and is held in the department 27
administered by the minister administering the Land Act 28
1994 or Land Title Act 1994.'. 29

`10.(1) Subsections (2) and (3) apply if-- 6
(a) the vendor of a proposed allotment has not given the purchaser of 7
the proposed allotment a registrable instrument of transfer for the 8
allotment; and 9
(b) there is a significant variation between the details contained in-- 10
(i) the disclosure plan given to the purchaser under section 9(1) 11
and a plan of survey the vendor proposes to register under 12
the Land Act 1994 or Land Title Act 1994 ("survey plan") 13
for the proposed allotment; or 14
(ii) the disclosure plan given to the purchaser under section 9(1) 15
and a plan mentioned in section 10A(1)(b) ("as constructed 16
plan") for the proposed allotment. 17
`(2) As soon as practicable, but not later than 14 days, after the vendor is 18
given the plan of survey the vendor proposes to register, the vendor must 19
give the purchaser written notice ("significant variation notice")-- 20
(a) detailing the nature and extent of the significant variation; and 21
(b) advising the purchaser that the purchaser may avoid the 22
instrument relating to the sale by written notice given to the 23
vendor within the prescribed period. 24
Maximum penalty--100 penalty units or 6 months imprisonment. 25
`(3) If the vendor gives the purchaser a significant variation notice-- 26
(a) the purchaser may avoid the instrument relating to the sale by 27
written notice given to the vendor within the prescribed period; 28
and 29
(b) the vendor must not, until the end of the prescribed period-- 30
(i) ask the purchaser to pay the balance of the purchase price; or 31
(ii) give the purchaser a registrable instrument of transfer for the 32

Maximum penalty for paragraph (b)--100 penalty units or 6 months 2
imprisonment. 3
`(4) If the vendor contravenes this section, the purchaser may avoid the 4
instrument relating to the sale by written notice given to the vendor-- 5
(a) for a contravention of subsection (2)--before the vendor gives the 6
purchaser the registrable instrument of transfer for the allotment; 7
or 8
(b) for a contravention of subsection (3)(b)--within 14 days after the 9
end of the prescribed period. 10
`(5) In this section-- 11
"prescribed period" means-- 12
(a) 30 days after the vendor gives the purchaser a significant variation 13
notice; or 14
(b) the period agreed, in writing, by the vendor and purchaser after 15
the vendor gives the purchaser the significant variation notice. 16
"significant variation" means-- 17
(a) in the details between a disclosure plan and a survey plan-- 18
(i) a variation of more than 2% in details of area; or 19
(ii) a variation of more than 1% in details of linear dimensions; 20
or 21
(b) in the details between a disclosure plan and an as constructed 22
plan--a variation of more than 500 mm in height in details of 23
surface contours or fill levels. 24

`10A.(1) The vendor of a proposed allotment must give the purchaser the 27
registrable instrument of transfer for the allotment, together with the 28
following documents relating to the allotment, not later than 18 months after 29
the purchaser enters upon the purchase of the allotment-- 30
(a) a copy of the plan of survey registered under the Land Act 1994 31

or Land Title Act 1994 ("registered survey plan"); 1
(b) if works were constructed in accordance with an approval under 2
the Planning Act, section 5.2,9 a copy of the plan showing the 3
constructed works ("as constructed plan"); 4
(c) a statement certified by a licensed surveyor-- 5
(i) that there are no variations between the details contained in-- 6
(A) the disclosure plan given to the purchaser under 7
section 9(1) and the registered survey plan for the 8
proposed allotment; or 9
(B) the disclosure plan given to the purchaser under 10
section 9(1) and the as constructed plan for the 11
proposed allotment; or 12
(ii) if there are variations, other than variations of which notice is 13
required to be given under section 10--detailing the nature 14
and extent of the variations. 15
`(2) If the vendor contravenes this section, the purchaser may avoid the 16
instrument relating to the sale by written notice given to the vendor before 17
the vendor gives the purchaser the registrable instrument of transfer for the 18
allotment. 19
`(3) If the vendor contravenes subsection (1)(c), the vendor commits an 20
offence. 21

`(4) In this section-- 23
"variation" means-- 24
(a) in the details between a disclosure plan and a registered survey 25
plan--a variation in details of area or linear dimensions; or 26
(b) in the details between a disclosure plan and an as constructed 27
plan--a variation in height in details of surface contours or fill 28

`Responsibility
`32A.(1) In this section-- 5
"representative" means-- 6
(a) of a corporation--an executive officer, employee or agent of the 7
corporation; or 8
(b) of an individual--an employee or agent of the individual. 9
"state of mind" of a person includes-- 10
(a) the person's knowledge, intention, opinion, belief or purpose; and 11
(b) the person's reasons for the intention, opinion, belief or purpose. 12
`(2) Subsections (3) and (4) apply in a proceeding for an offence against 13
this Act. 14
`(3) If it is relevant to prove a person's state of mind about a particular 15
act or omission, it is enough to show-- 16
(a) the act was done or omitted to be done by a representative of the 17
person within the scope of the representative's actual or apparent 18
authority; and 19
(b) the representative had the state of mind. 20
`(4) An act done or omitted to be done for a person by a representative of 21
the person within the scope of the representative's actual or apparent 22
authority is taken to have been done or omitted to be done also by the 23
person, unless the person proves the person could not, by the exercise of 24
reasonable diligence, have prevented the act or omission. 25

`32B.(1) The executive officers of a corporation must ensure the 27
corporation complies with this Act. 28
`(2) If a corporation commits an offence against a provision of this Act, 29
each of the corporation's executive officers also commits an offence, 30

namely, the offence of failing to ensure that the corporation complies with 1
the provision. 2
Maximum penalty--the penalty for the contravention of the provision by an 3
individual. 4
`(3) Evidence that the corporation has been convicted of an offence 5
against a provision of this Act is evidence that each of the executive officers 6
committed the offence of failing to ensure that the corporation complies 7
with the provision. 8
`(4) However, it is a defence for an executive officer to prove-- 9
(a) if the officer was in a position to influence the conduct of the 10
corporation in relation to the offence--the officer exercised 11
reasonable diligence to ensure the corporation complied with the 12
provision; or 13
(b) the officer was not in a position to influence the conduct of the 14
corporation in relation to the offence; or 15
(c) that information that tended to incriminate the corporation was 16
obtained under section 30F.'. 17
