1992 A BILL FOR An Act to amend certain Acts in relation to the administration of land, and for other purposes

 


 

6 Lands Legislation Amendment BE IT ENACTED by the Queen's Most Excellent Majesty, by and with 1 the advice and consent of the Legislative Assembly of Queensland in 2 Parliament assembled, and by the authority of the same, as follows. 3 HAPTER 1--PRELIMINARY 4 C title 5 Short This Act may be cited as the Lands Legislation Amendment Act 6 Clause1. 1992. 7 8 Commencement Clause2. This Act (other than section 4) commences on a day to be fixed by 9 proclamation. 10 Acts 11 Amended Each Act mentioned in Schedule 1 is amended as set out in the 12 Clause3. Schedule. 13 14 Repeals Clause4. The Acts mentioned in Schedule 2 are repealed. 15 repeals 16 Consequential Clause5. The Acts mentioned in Schedule 3 are repealed. 17

 


 

7 Lands Legislation Amendment CHAPTER 2--STATUTORY OFFICES 1 ART 1--AMENDMENT OF BRIGALOW AND 2 P OTHER LANDS DEVELOPMENT ACT 1962 3 Act 4 Amended The Brigalow and Other Lands Development Act 1962 is amended 5 Clause6. as set out in this Part. 6 of ss.4 and 5 7 Replacement Sections 4 and 5-- 8 Clause7. omit, insert-- 9 10 `Corporation `4.(1) The Corporation of the Land Administration Commission is 11 continued in existence, as a corporation sole, under the name of the 12 Brigalow Corporation. 13 `(2) The Brigalow Corporation-- 14 (a) is a body corporate; and 15 (b) has a seal; and 16 (c) may sue and be sued in its corporate name. 17 `(3) The chief executive constitutes the Brigalow Corporation. 18 `(4) A reference to the Corporation of the Land Administration 19 Commission in any Act or in any document is taken to be a reference to the 20 Brigalow Corporation. 21 `(5) Judicial notice must be taken of the imprint of the Brigalow 22 Corporation's seal appearing on a document and the document must be 23 presumed to have been properly sealed until the contrary is proved. 24

 


 

8 Lands Legislation Amendment represents the Crown 1 `Corporation `5.(1) The Corporation represents the Crown. 2 `(2) Without limiting subsection (1), the Corporation has all the 3 privileges and immunities of the Crown. 4 `(3) Without limiting subsection (1), the Corporation is an exempt public 5 authority for the purposes of the Corporations Law. 6 Functions and powers 7 ` `5A. The Corporation has the functions and powers conferred on it by 8 this Act. 9 10 `Delegation `5B. The chief executive may delegate the chief executive's powers under 11 this Act to an officer or employee of the department.'. 12 PART 2--AMENDMENT OF LAND ACT 1962 13 Act 14 Amended The Land Act 1962 is amended as set out in this Part. 15 Clause8. of Division 2 of Part 2 16 Replacement Part 2, Division 2-- 17 Clause9. omit, insert-- 18 `Division 2--Administration 19 of this Act 20 `Administration `19.(1) This Act is to be administered by the Minister, and subject to the 21 Minister, by the chief executive. 22

 


 

9 Lands Legislation Amendment `(2) The Minister may delegate the Minister's powers under this Act to 1 the chief executive or to an officer or employee of the department. 2 `(3) The chief executive may delegate the chief executive's powers 3 under-- 4 (a) this Act (including any powers delegated to the chief executive by 5 the Minister); or 6 (b) another Act with respect to the allocation, management and use of 7 Crown land; 8 to an officer or employee of the department. 9 in Acts 10 `References `20. A reference in any Act or document to the Land Administration 11 Commission, the Chief Commissioner of Lands or the Secretary, Land 12 Administration Commission is taken to be a reference to the chief 13 executive.'. 14 ART 3--AMENDMENT OF REAL PROPERTY ACT 15 P 1861 16 Act 17 Amended The Real Property Act 1861 is amended as set out in this Part. 18 Clause10. of ss.4­8 19 Replacement Sections 4 to 8-- 20 Clause11. omit, insert-- 21 of Titles 22 `Registrar `4.(1) There is a Registrar of Titles. 23 `(2) The Registrar of Titles has a seal of office. 24

 


 

10 Lands Legislation Amendment `(3) The Registrar of Titles is appointed and holds office under the Public 1 Service Management and Employment Act 1988. 2 `(4) The Registrar of Titles may delegate the powers of the Registrar of 3 Titles under any Act to an officer or employee of the department. 4 `(5) A reference to the Registrar-General in a provision of an Act relating 5 to the registration of instruments under the Real Property Act 1861, or any 6 Act required to be read as one with the Real Property Act 1861, is taken to 7 be a reference to the Registrar of Titles. 8 `(6) Judicial notice must be taken of the signature and imprint of the seal 9 of the Registrar of Titles appearing on a document and the document must 10 be presumed to have been properly signed or sealed until the contrary is 11 proved. 12 `(7) In acting under this Act or another Act, the Registrar of Titles is 13 subject to the chief executive. 14 registry 15 `Land `5.(1) The chief executive is to establish and maintain a land registry. 16 `(2) The land registry comprises-- 17 (a) all registers maintained by the Registrar of Titles under an Act; 18 and 19 (b) prescribed registers in which, for the purposes of an Act, 20 particulars of interests in land are recorded; and 21 (c) other prescribed compilations in which information concerning 22 land is recorded; and 23 (d) any other register or compilation concerning land that is required 24 or permitted by an Act to be located in the land registry. 25 `(3) The Governor in Council may, by regulation, determine-- 26 (a) the locations of offices of the land registry at which documents 27 may be lodged; and 28 (b) the particular documents that may, or may not, be lodged at any 29 particular office of the land registry for registration or recording 30 in the appropriate register or compilation by the Registrar of 31 Titles or other appropriate person. 32

 


 

11 Lands Legislation Amendment to office of Registrar of Titles 1 `References `6. A reference in any Act or document to the office of the Registrar of 2 Titles (either in those words or in words to the same effect) is a reference to 3 the land registry. 4 5 `Delegation `7. The chief executive may delegate the chief executive's powers under 6 this Act to an officer or employee of the department.'. 7 ART 4--AMENDMENT OF SURVEYORS ACT 1977 8 P Act 9 Amended The Surveyors Act 1977 is amended as set out in this Part. 10 Clause12. of s.8 (Members of Board) 11 Replacement Section 8-- 12 Clause13. omit, insert-- 13 of board 14 `Members `8. The board consists of the following 8 members-- 15 (a) 2 persons (at least 1 of whom must be a licensed surveyor) 16 nominated by the chief executive; 17 (b) 3 surveyors (at least 1 of whom must be a licensed surveyor) 18 chosen from a panel of 5 surveyors nominated by the 19 Queensland Division; 20 (c) 2 surveyors (at least 1 of whom must be a licensed surveyor) 21 chosen from a panel of 4 surveyors nominated by the 22 Association of Consulting Surveyors Queensland; 23

 


 

12 Lands Legislation Amendment (d) 1 surveyor chosen from a panel of 3 surveyors who are engaged 1 in the teaching of surveying at an institution of tertiary education 2 in Queensland and nominated by the Queensland Division.'. 3 of s.10 (Appointment of members) 4 Replacement Section 10-- 5 Clause14. omit, insert-- 6 of members 7 `Appointment `10.(1) The members of the board must be appointed by the Governor in 8 Council. 9 `(2) A person may hold office as a member of the board in conjunction 10 with any other office in the public service.'. 11 of new s.10A 12 Insertion Clause15. After section 10-- 13 insert-- 14 15 `President `10A.(1) The Governor in Council may appoint a member of the board 16 who is a licensed surveyor to be president of the board. 17 `(2) The person who is president ceases to be president if-- 18 (a) the person ceases to be a member of the board; or 19 (b) resigns as president by signed notice given to the Minister. 20 `(3) The president may resign as president and remain a member of the 21 board. 22 `(4) If otherwise qualified, the president is eligible for reappointment.'. 23

 


 

13 Lands Legislation Amendment ART 5--AMENDMENT OF VALUATION OF LAND 1 P ACT 1944 2 Act 3 Amended The Valuation of Land Act 1944 is amended as set out in this 4 Clause16. Part. 5 of ss.6­7A 6 Replacement Sections 6 to 7A-- 7 Clause17. omit, insert-- 8 to Valuer-General 9 `References `6. A reference in any Act or document to the Valuer-General is a 10 reference to the chief executive.'. 11 CHAPTER 3--TREE CLEARING--AMENDMENT 12 OF LAND ACT 1962 13 Act 14 Amended The Land Act 1962 is amended as set out in this Chapter. 15 Clause18. of s.250 16 Replacement Section 250-- 17 Clause19. omit, insert-- 18 clearing permit 19 `Tree `250.(1) In this section-- 20 "critical area" means-- 21 (a) land that is prescribed as being highly vulnerable to land 22

 


 

14 Lands Legislation Amendment degradation; or 1 (b) land that is prescribed as being of high nature conservation value; 2 or 3 (c) a critical habitat, or an area of major interest, identified in a 4 conservation plan under the Nature Conservation Act 1992; or 5 (d) land that is the subject of a proposal under section 40 of the 6 Nature Conservation Act 1992 for the declaration of a protected 7 area; 8 "lease" means the relevant lease, licence, occupancy, deed of grant in trust 9 or reserve mentioned in the definition of "lessee"; 10 "lessee" means a lessee of-- 11 (a) a pastoral lease; or 12 (b) a stud holding; or 13 (c) a grazing homestead perpetual lease; or 14 (d) a perpetual town lease (non-competitive lease), perpetual 15 suburban lease (non-competitive lease) or perpetual country lease 16 (non-competitive lease)-- 17 (i) that issued under this Act over Crown land on or after 31 18 December 1991; or 19 (ii) that issued on or after 31 December 1991 on an application 20 under section 207 of this Act that was received-- 21 (A) on or after 5 February 1990; or 22 (B) in respect of a lease issued under this Act and under an 23 arrangement under section 24 of the Industrial 24 Development Act 1963, or issued before the 25 commencement of the Industrial Development Act 26 1963 under a recommendation of the Minister 27 administering industrial development--on or after 3 28 October 1991; or 29 (e) a special lease; or 30 (f) a development lease; 31 and includes-- 32

 


 

15 Lands Legislation Amendment (g) a licensee under an occupation licence or road licence; and 1 (h) an occupier under a permissive occupancy; and 2 (i) the trustees of land granted in trust (other than trustees of land 3 granted in trust for the benefit of Aboriginal or Islander 4 inhabitants); and 5 (j) the trustees of a reserve; 6 "tree clearing permit" means a tree clearing permit under this section; 7 "tree management plan" means a plan of the lease that identifies-- 8 (a) the main features of the land, including natural features and 9 improvements; and 10 (b) major vegetation types; and 11 (c) critical areas; and 12 (d) stands of prescribed trees; and 13 (e) the area proposed to be cleared; 14 and includes all prescribed information, and information that in the 15 chief executive's opinion is necessary for the proper consideration of 16 an application for a tree clearing permit. 17 `(2) A lessee must not-- 18 (a) clear a tree, or permit a tree to be cleared, on the lease otherwise 19 than under a tree clearing permit; or 20 (b) contravene a condition of a tree clearing permit. 21 Maximum penalty-- 22 (a) in the case of an individual--400 penalty units; or 23 (b) in the case of a corporation--800 penalty units. 24 `(3) An application for a tree clearing permit must be-- 25 (a) made in the prescribed form; and 26 (b) accompanied by the prescribed documents; and 27 (c) lodged at an office of the department for the district in which the 28 lease is situated; and 29

 


 

16 Lands Legislation Amendment (d) if requested by the chief executive--accompanied by-- 1 (i) a tree management plan; or 2 (ii) a map that clearly delineates the area to be cleared. 3 `(4) The chief executive may-- 4 (a) issue the tree clearing permit; or 5 (b) issue the tree clearing permit, but impose conditions; or 6 (c) refuse to issue the tree clearing permit. 7 `(5) A condition may limit the area to be cleared to a smaller area than the 8 area proposed in the application. 9 `(6) If the chief executive refuses to issue the tree clearing permit, the 10 chief executive must give written notice to the applicant of the refusal. 11 `(7) In deciding whether to issue the tree clearing permit, and in deciding 12 on any conditions to be imposed, the chief executive must consider-- 13 (a) the species or types of trees proposed to be cleared; and 14 (b) the existence and extent of prescribed trees on the area proposed 15 to be cleared; and 16 (c) the effect of the proposed tree clearing on the nature conservation 17 value of the land; and 18 (d) the extent of the proposed tree clearing, and the extent to which 19 trees are to be retained; and 20 (e) the vulnerability to land degradation of the area proposed to be 21 cleared; and 22 (f) the way in which the trees are to be cleared; and 23 (g) the information contained in any tree management plan lodged; 24 and 25 (h) any other matters that the chief executive considers to be relevant. 26 `(8) The tree clearing permit-- 27 (a) must not be for a term longer than 5 years; and 28 (b) must state the purpose for which the trees are to be cleared; and 29

 


 

17 Lands Legislation Amendment (c) if a tree management plan accompanied the application--must 1 include the final form of that plan, as approved by the chief 2 executive; and 3 (d) may state the way in which the trees must be cleared. 4 `(9) If the term of a tree clearing permit is less than 5 years, the chief 5 executive may extend the term, but the total term of the permit must not be 6 longer than 5 years. 7 `(10) A permit granted to a lessee to clear trees for use in the 8 improvement of the lease from which the trees were cleared may not be 9 subject to a condition requiring the lessee to pay any amount by way of 10 royalty. 11 `(11) Subsection (10) does not apply to a lease that consists of the whole 12 or a part of a State Forest or Timber Reserve. 13 `(12) A tree clearing permit is subject to the following conditions-- 14 (a) that the lessee must not cause or allow a tree on the lease (other 15 than a tree to which the permit applies) to be destroyed, damaged 16 or otherwise interfered with; 17 (b) if the permit sets out the way in which trees are to be 18 cleared--that the lessee must not cause or allow them to be 19 cleared in another way; 20 (c) if the permit included a tree management plan--that the lessee 21 must comply with that plan; 22 (d) the conditions prescribed by regulation; 23 (e) the conditions imposed by the chief executive. 24 `(13) A tree clearing permit continues in force for the benefit of a 25 transferee of a lease if-- 26 (a) a tree management plan was approved for the purposes of the 27 permit; and 28 (b) before the transfer is registered, the transferee gives written notice 29 to the chief executive that the transferee is aware of, and agrees to, 30 the conditions of the permit. 31 `(14) The chief executive may cancel a tree clearing permit if the chief 32 executive is satisfied that-- 33

 


 

18 Lands Legislation Amendment (a) the permit was granted on the basis of false or misleading 1 material contained in or accompanying the application; or 2 (b) the lessee has contravened a condition of the permit; or 3 (c) the clearing of trees is being carried out in a way-- 4 (i) that is not likely to be effective or complete; or 5 (ii) that is likely to be harmful or injurious to the land or 6 adjoining land; or 7 (d) there has been a substantial change in circumstances since the 8 grant of the permit and the permit would not now be granted. 9 `(15) A tree clearing permit may be cancelled whether or not legal 10 proceedings have been started for an offence against this section. 11 `(16) Despite a condition of a lease requiring the clearing or destruction 12 of trees, the lessee must obtain a tree clearing permit before complying with 13 the condition. 14 `(17) On the conviction of a lessee, the court may order the lessee to pay 15 to the State, in addition to any penalty imposed-- 16 (a) the cost of any remedial work or rehabilitation necessary or 17 desirable because of the commission of the offence; and 18 (b) the value of every tree cleared or destroyed, which is to be the 19 price that is ordinarily obtainable on the sale of such a tree. 20 `(18) Despite subsection (2), if-- 21 (a) a lessee complies with the requirements of subsection (19); and 22 (b) the lease-- 23 (i) is used for agricultural or grazing purposes; and 24 (ii) is not a lease over a State Forest or a Timber Reserve, or a 25 protected area within the meaning of the Nature 26 Conservation Act 1992; 27 the lessee may clear trees for prescribed routine management purposes 28 without obtaining a tree clearing permit under this section. 29 `(19) A lessee mentioned in subsection (18)-- 30 (a) must not remove from the lease trees cleared from the lease; and 31

22 Lands Legislation Amendment `(18) If a reduction granted under subsection (14) is cancelled, the 1 remaining instalments are to be adjusted, and if necessary the term of the 2 lease may be extended, so that the purchasing price is paid in full within a 3 reasonable time. 4 `(19) An application for subdivision under section 271 must not be 5 granted if it is received on or after 31 December 1991.'. 6 of s.194 (Terms and conditions of lease for term of years) 7 Amendment Clause25.
